  2. Morning all, well, having successfully got my money back from barclays i am on to the next one in line Virgin. i have to say they have been great and reduced their charges to £12. So will i get anywhere if i am claiming back £12's in charges or is that concidered acceptable? i really need to know before i write them a lovely letter i don't want to look a wally. Hi, I was reading your thread and just wanted to say i am going to claim some charges back from Barclaycard (not that they know that yet) But 1 week ago they reduced my credit limit which was quite handy really for me. So i think that it is something they are automatically doing at the moment to account that are perhaps not great. I have been paying mine off really well recently too so as much as i hate them i think it is a good thing? Good luck with your claim.
  4. hello, Make sure you hang on in there !! My court dat was for 21st December and they paid up (before i had sent my bundle into court) on the 1st December the whole lot. I rang them up to say i didn't agree with their terms and conditions and he said fine and gave me the money anyway. It is worth the wait, they will pay up. Its your money afterall. Good Luck.
  5. Hurrah, I rang up MR Celyn Evans and explained that i didnt accept the terms and conditions to the payment so he said i could just cross through anything i didn't agree with. So i did just that and faxed him the copy and put the original in the post and 20minutes later he rang me to say the money was in my account ! So a right result !! Hurrah !!
  6. Keep going you'll have all your money back soon, but be prepared to go through the court route. They settled with me 21 days before court date it is very satisfying. I got charged the other day for being £4.21 overdrawn and they won't give it back so i will have to go through the whole performance again. Good Luck
  7. Hello, I know what you mean about getting confused! i have managed to stumble through the whole process and today i got a lovely letter saying that they would pay up in full. My court date was 21st December so it was up to the last minute really. Don't get too confused everything is in the FAQ section and don't forget everyone is in a similar boat. You will get your money!! Good Luck

  10. Well Blow me down with a feather !!!!! As i sat at home trying to work out the court bundle a lovely letter from barclays landed on my door mat saying :- As you can see from our defence, we consider your claim lacks meritand that it will fail ( i love that bit) in particular we disagree with your legal analysis that the charges levied to your account with barclays amounts to penalty clauses and are unfair. We do however, recognise that the sum at issue between us is relatively modest and as such, it is not cost effective for either party to take this matter to trial. Therefore, in order to avoid the inevitable time and cost associated with pursuing the claim to trial, we are preppared to settle your claim upon payment of charges applied to your account, together with the statutory interest and costs totalling £380.00 subject to the terms set out in this letter. This offer to pay £380 is in full and final settlement of your claim and is strictly without any admission of liability on our part. By accepting this offer, you agree that the existence and the terms of this offer are confidential between us. (Not likely) If you agree to the terms of this letter please sign and return a copy of this letter to me (Celyn Evans Legal clerk) at the above address within the next 7 days. You will also need to notify the court in writing that you have dicontinued your claim against us. Please forward a copy of your letter to the court when you return a signed copy of this letter to us. Should you decide to reject this offer, then we reserve the right to disclose this letter to the court. Do i have to sign this particular letter? I don't agree to not tell anyone! after all i just have told everyone! Ha Ha. Also the £380 doesn't include any interest, i never asked for any but they have put in their letter they have included it. What should i do? To everyone who is thinking of taking the pathetic offers they put out at the begining of the process DON'T ! Just give it a go, does this not show what they are all about? they push you to the very end hoping you will give in, and unfortunately lots of people still do! GOOD LUCK !!

  12. Well, i have got my date and it is the 21st December 06 at 10am which is much quicker than i had imagined it was going to be! Good old Barclays they keep going to the end don't they! I know it is probably a dim question but how will i know if they are going to settle out of court? What is the latest i will hear from them? Is it ever on the actual day? I really hope everyone out there who is going through this process doesn't accept anything other than the full amount owed, just remember it's your money!

  16. Well good luck i find it a great help to know others are in the same situation. My claim with barclays is going along the same lines as yours i paid my money through moneyclaim the 28 days are up and they have filed a defence so it is no longer being dealt with through moneyclaim. I am dead nervous but as someone said they will give in before us!! Good luck again and i look forward to hearing that you ve got your money back ! (hopefully without going to court!)
  17. Well the 28 days are up and barclays have filed a defence! I started the claim through moneyclaim on 22nd September and now it cannot be dealt with through moneyclaim anymore, so i am waiting for a date for court. (scarey stuff). barclays seem to hang on the longest don't they? Well when its all over my bank account will definately be moved elsewhere!! Good luck everyone else in this situation! xx

Well, don't know if this has happend to anyone else but i was checking out my statement online last month and much to my suprise i had been credited £75 to my account after checking through past statements i had been charged this amount in 'penalty charges'over a period of a year. I was totally shocked as i had not ever asked for them back!! Is this unusual for MBNA?
  19. Hi, I really hope someone can advise us what to do. My sister is due to move out of her rented flat in London and has put a deposit on another rented property in Sussex. The letting agents for the new property have been waiting for the reference from the agents of the property she is in at the moment and are starting to get inpatient. When my sister called to ask why the reference was taking so long they told her it would cost £40 for them to write a reference! She is totally stuck because unless she pays it they won't write the reference but nothing is in the contract etc. Where does she stand?? it is a total disgrace she has been in the property for 2 years and it is immaculate!!! HELP

  21. hello, i am at the same stage as you as i received my letter today saying that £220 was their final offer ! I am going to send them a letter as you have although i am not too sure how to word it saying i am taking them to court. I really don't know how to go about the next stage although i will stick with it too the end !
  22. well hello again they really are sending lots of standard letters out now !! I have just received my letter back today saying if i was unhappy with there (rubbish) offer of £220 then sorry i feel i have to make a claim, so i also will be seeing them in court !! Do you think it will get to court? i will keep going i need that money back !! i am so glad i am not alone or i might have bottled it by now !!
  23. hello, sounds like my claim is almost exactly them same !! My charges totalled £550 and i received my letter saying as a gesture of goodwill they will pay me £220 !! What a joke they were more than happy to take it and i could really do with the money, but after speaking to David Chapman on a direct phone number he was very pleasant but stated it was only a gesture of goodwill and they didn't have to give me anymore as he had assesed my account and decided that it was a fair amount ! So on with my claim !! Not too sure if you have a standard letter for the next part of my claim ? Good luck with your calim !
  24. Hi, I have been reading everyones stories and i am so happy that i am not the only one out there suffering these terrible charges. I have read through the library and FAQs and am about to post my first letter requesting £550 overdraft charges back one of which i recieved yesterday. Am i correct in thinking i have to send my letter to the customer relations team not my local branch? Wish me luck. Thanks for all the fab advice and well done to everyone who has not given up in getting there money back!!
