    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

last year we got taken to court for our council tax and ended up paying for it through my husbands wages. A couple of months in my husbands firm changed hands , we informed the council in writing of his new pay office address didnt hear ne thing for a month then got a baliffs letter. On contacting the council they said they had recieved our letter and sent one to his new firm who hadnt responded.When asked wot adress they were using they reeled off my husbands old firm adress so instead of changing it they had carried on with the old one. When the mistake was pointed out to them they just said well its not our mistake on told us we would still have to pay baliffs fees of 42. We didnt pay the baliffs cost and didnt hear ne thing else. At the beginning of the year my husband started a new job and to make doubly sure nothing went wrong with the c tax he rang them and informed them of the change of details. We recieved a confirmation letter so we thought all was well. That was until friday the 19th of Feb when my husband was woken by a banging on the front door , a baliff had arrived with a c tax demand for 1400 ... which isnt even the amount we owe as we have been paying through his wages for the last 6 months. We had , had no letter informing us that they were coming when my husband finally got hold of the council the woman was snotty and wouldnt admit it was their fault yet again and said we would have to pay the baliffs cost from last time and probably this time too , Which i think is unfair as we did everything we were supposed to both times. My husband was extremely upset and the baliff is coming back tuesday to collect the fee please advice.

There is no point in phoning councils

 

send a formal complaint letter to the CHIEF EXECUTIVE of your council

Make the council aware that you are prepared to go through the councils complaints procedure and escalate it the local government ombudsman

ask them for a copy of there complaint procedure

send all letters recorded deliver

make sure you put FORMAL COMPLAINT at the top of your letter (like i have)

 

your council should not have passed this over to the bailiff as it is getting paid you are not responsible for the councils maladministration and should not have to bailiffs fees

Don't pay them, and don't allow them into your house. They cannot put a foot in the door or force their way in. If you have a car, keep it in a locked garage or hide it some streets away.

 

Bailiffs have to give you notice of them calling and it would seem they haven't.

 

If you have paperwork for all this, you are in a good position to claim against the council.

 

As above, have a good read of the regulations

its not the full council tax bill we have to pay its just the baliffs costs which are 42.50. My husband made a verbal agreement with the guy on friday that he would phone and then collect the 42.50 on tuesday its not a great deal of money but i still feel that we shouldnt have to pay it as it was the councils mistake. My husband is not sure we shouldnt pay it .. i dont know wot to do

my husband says if he pays it he will get a recipt and then we will write the appropriate letters to the cheif exec etc we have all the info but i am also hoping citizens advice will get back to me tomorrow and maybe able to make a few calls on our behalf . I really would like to sue for the emotional stress that my husband went through on friday he coped all day by himself without telling me because i am already on medication for my nerves. Lets hope we can get something done so this doesnt happen to anyone else. Its always those with less money like us who suffer this rubbish
