    • I doubt HMCTS holds any data on whether arrests by AEAs required police assistance.  They couldn't or wouldn't provide data on how many of warrants issued were successfully executed - just the number issued!  In my experience, arrest warrants whether with or without bail are [surprisingly] carried out with little or no fuss.  I think it's about how you treat people - a little respect and courtesy goes a long way. If you treat people badly they will react the same way. Occasions when police are called to assist are not common and, having undertaken or managed many thousands of these over the years, I can only recall a handful of occasions when police assistance was necessary. On one occasion, many years ago, I arrested and transported a man from Hampshire to Bristol prison on a committal warrant. It was just me and he was no problem. I didn't know the Bristol area (pre Sat Nav) and he was kind enough to provide directions - seems he knew the prison.  One young chap on another committal warrant jumped out of his back window and I had to chase him across several garden fences.  When he gave up (we were both knackered) I agreed to drive by his girlfriend's house to say farewell for a while.  I gave them a few moments and he was fine. The most difficult are breach warrants but mainly in locating the defendant as they don't want to go back to prison - can't blame them.  These were always dealt with by the police until the Access to Justice Act transferred responsibility from them to the magistrates' courts. The fact was the police did not actively pursue them and generally only executed them when they arrested someone for something else and found they had a breach warrant outstanding.  Hence the transfer of responsibility.

    • as long as aos is done by day 19 from the date on the claimform they get a total of 33 days to file a defence. (whereby the date top right on the claimform is ONE in the 33 day count) dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys,

 

Been reading here for some time and only just found the time to post - I wondered if someone could put my mind at ease.

 

I am 25 yr old man who has worked since the age of 16, I have recently become unemployed due to the economic downturn and I am having to claim JSA.

 

I have mortgage commitments of £1100 per month on a interest only rate - after the 13 week waiting peroid if still on JSA I can ask the governement to pay my interest repayments to my lender.

 

The only thing is this is a joint mortgage with a ex partner ( I cannot trace her) and I have been making all mortgage payments for last 18 months, my question is this ..... will i be allowed to claim for full interest payments to my lender or only half as she is half liable?????

 

I have also been signed off as being clinically depressed ( you never think it can happen to you - but believe me it does) so I will then need to claim for Employment Support Allowance or ESA - How much is ESA per fortnight and also does the government still support paying the interest for your mortgage if you are on ESA or ca you just claim this on JSA?

As an aside, do you have any payment protection insurance [PPI] through the mortgage company? I know it doesn't have a very good name on CAG, but when I was first ill, I claimed on my credit card PPI for the monthly repayments, I think it was [long time ago], and also on my mortgage protection insurance that covered sickness and redundancy. It helped quite a bit in my case. I suggest you read the wording if you have anything like that, or contact them.

It is about £65 per week during the "assessment" phase (first 13 weeks). After this, if you pass the medical, it will go up by about another £25 to £30.

 

The above is based on contributions and is not means tested. There is also some additional money available depending on your assets.

 

You need to get some legal advice on the mortgage question re your ex partner. This needs sorting sooner rather than later as she may be able to claim part of a property she is not paying towards. Sorting this should make getting the interest paid by the state easier. I would try to go to the CAB, a law centre or see if you can get a free half hour with a solicitor.

I'm not sure this makes any difference. My friend claimed all of her mortgage interest even though her husband had run off to Australia. Although they were married, the house was in his name only.... yet DWP paid it for years. I'd fill in the paperwork, submit it and see what happens, but going by her situation.... you should be fine because you're on the Deeds.

I havent got anything that covers me for mortgage payments :(

Thanks for your advice re the solicitor my local CAB office have given me the details of local solicitors who will give me a free 30 minute consultation - I am going to set up a meeting with them and see where I stand legally.

 

I have asked her to write a letter and sign it stating that she doesnt contribute to the house and she wants off the mortgage ASAP to show DWP if they need it.

 

At the moment I am on JSA CB and I need to be on JSA IB to be eligible for Mortgage interest support.

 

Here is my problem - hopefully someone can give me advice on this:

 

I have been signed off sick from the Doctor but I am unsure whether to sign off my JSA CB and apply for ESA.

 

The reasons for this are Im not sure if the 13 week period for help with the mortgage interest will have to start again from the date of my new ESA claim.

 

I have also read about the ESA medicals being geared towards physical disabilites and therefore I am concerned that I will get a raw deal and just because I can bend down and pick something up they will declare me fit for work.

 

The reality is I am a nervous wreck, I am constantly having panic attacks and anxiety attacks and I have been prescribed Lorazepam and Prozac by a mental health specialist that my GP referred me to.

 

To even think about going back to work fills me with fear and I just feel like I cannot take the stress and pressure of another field sales job just yet until I am better.

 

Can anyone advise me on what I need to do next to ensure I get the Mortgage interest support? do I stay on JSA CB or do I start a new claim for ESA and risk being told to go back on JSA.

 

I already have a MI12 form filled in aswell as a JSA 3 form - do I send these in now or wait for the 13 week period? Anyone getting Interest Support and now the timescales I should work to?
