I've called barclay's and they told me they sent out correspondences to everyone and if we wanted a particular provider we have to send them the request in writing for them to consider. But they also stated to me when I asked, 'what if you can't find a alternative provider' I was told that each person would be looked into individually so I would assume it meant, how much service we had gotten will deduct from what they will pay out. Its just a assumption though, but I feel it may be the case :S

 

I also signed that petition btw

 

 

Sounds like a usual stalling tac from them.....so are they going to look at 5000+ on an individual basis now then ?

Pity they wasnt so quick in moving when they are taking bank charges,re-poing peoples houses or squeezing businesses-they look at these on an individual basis too.....

I've called barclay's and they told me they sent out correspondences to everyone and if we wanted a particular provider we have to send them the request in writing for them to consider. What about people who dont use facebook - like me.

 

Is there a way to have any crucial information on there linked to here?

 

Facebook is not for everyone so there should not be pressure to go there if you have never bothered with it before.

On CAG in less than 14 days we have had almost 50k hits and 900+ posts spread across 4 threads in discussions on this.

At the end of the day it does not really matter where info is posted if it can be available to all those concerned.

We are aware that info posted on all sites that are trying to keep up to speed with developments is being exchanged.Lets hope this continues so that everyone can know exactly how to move forward and not be fobbed off by excuses....or misguided by rumours.

I've called barclay's and they told me...
Keep it in writing Folks.

 

Barclays will deny anything they say on the phone. So, I urge you all to try and avoid using the phone if at all possible. Their people are trained to tell you whatever they think you want to hear. They have more telephone lines and telephone numbers than many small Countries, and they have them for their own benefit, not yours. Nothing said via Telephone will help you if the issue ends up in Court.

 

  • Keep it in Black & White.

 

  • Send everything Recorded/Special Delivery.

 

  • Send everything to their Head Office, addressed to: The Company Secretary, 1 Churchill Place, London, E14 5HP.

Many will know this is good advice, and many more will realise it in 6 Months time when you find out what Barclays are really like.

The directors of advent have done you guys good and proper. Someone should be looking at the amount of money they were taking out of the business.

 

Buying million pound houses. Knocking them down and rebuilding them.

 

Range Rovers. The Audi R8 (AJ9) is hidden in the garage.

 

And while you are all fretting about your lost money next week they are off to Barbados to spend your cash. They are not so bothered.

Hey all, just got off the phone with BPF asking why i hadn't heard anything and because i payed off the whole thing in full so my account was archived.

 

He did say that as from now on i will be receiving correspondence from them and that they we're still working to find an alternative training provider, however should they not he said they'd be in breach of contract and would have to issue refunds to those paid up in full.

 

Sounds good doesn't it

It does sound good...and just like you I paid BPF in full before interest started amounting...no doubt they'l find a way to get us a training provider rather than money though...it'l save them a ton!

Yes they would be.

 

However I suggest you read post #829

 

It has become obvious throughout this thread that on the phone, BPF staff have said many different things to people, most of which bear little relation to what they are prepared to put in writing ie. the letters they have been sending out.

Just signed the petition hope we get the amount of signatures needed and the goverment do something useful to help out the public. Has anyone who paid out in full been contacted by a insolvency practitioner yet?

As for what he's told me on the phone, yeah i guess he could have said that just to make me happy. However on my agreement it does state that should i be unhappy with goods or services provided i can sue one or the other or both. So i feel that im am entitled to a refund should they fail.

 

Only time will tell i guess, i'll give it a week say and phone again if i've heard nothing. Will ask more questions and ask for things to be confirmed in writing to me.

No it doesnt sound that good if u r sayin that they will issue refunds to those PAID UP IN FULL. shouldnt matter who has paid, what, EVERYONE should get refunds, im might not have paid in full but 2.5k is still a lot to lose when i got 3kids..

Not quite that simple m8, as it doesnt say you CAN sue it says you MAY Be able to sue, there is many loop holes in this for them. just take ur contracts to a decent lawyer an they will tell u that these are strangely worded contracts. Also it would be very hard to find someone to take on the case of sueing them for us.. prob cost a bomb if u could get someone brave enough to take it on for u. if it was easy mate, i would av proceeded with sueing already

Claims up to 5k for money can be done either by the small claims Court or Money Claim Online.

To issue a claim fees are £1500-£3,000 - £85.00 and £80.00 respectively

£3,000 - £5,000 £108 and £100 respectively

 

 

The ceiling for small claims track is £5k (interest is not included)

Hovever a Court can use discretion where the figure goes a little higher than £5k.

Thanks for all the help and info, if not for this forum I'd be scared witless.

 

I have a feeling that we are going to all end up in court because I don't see how Barclays are going to resolve all the issues here.

 

My parents have signed as guarantor and are about to have their credit rating wrecked because of this.

 

So we stick on here and with the brilliant support from Martin, Cashins,Brw and Conniff and everyone else that is posting ideas and suggestions we can make ourselves heard and get this sorted out.

And more importantly be guided to not fall into Barclays traps to let them wriggle out of this mess and we lose out again.

 

Also Advent training ltd are still showing active so have they ceased to trade or not I wonder. or how long does companies house take to show who the liquidator is (not the liquidiser as I said in a previous post) although I would like to liquidise them at the min.,but I'm not excited about that happening either cos we would still get the thin end of the stick

Bluedo - to save me wading back through the thread to see, have you got them to freeze the account and had them confirm it in writing?

 

If yes - you (and they) don't have a problem.

 

If no - and you've just stopped paying, although they shouldn't in the case of a dispute such as this, they may well default you eventually.

Yes I copied your letter Cashins and have sent it.Just had a bad feeling it'll all go pear shaped cos we haven't paid anything yet as the interest free period is due to be up and then have to pay £5000 or else it'll be over £10,000 (need to look for exact amount)

 

Something strange is happening I have just had 2 emails from CAG forums to tell me you and Awax had posted on here why is that? do you know and what the posts say

I didn't mean do you know what the posts say just that the email stated what the posts from awax and you said.

 

Can this happen and also that the give up smoking has been moved I wonder if it's because I have been looking through lots of different parts of the site and clicked on that to have a look. and it wasn't there

On the subject of litigation-I should add that a high proportion of cases are actually settled out of Court-some being done after sending a letter before action,others after acknowledgement of claim is filed but before they have to file a defence.Barclays and others are used to being threatened with legal action,but they know only a small proportion of those will actually be prepared to follow it through.

If it does become clear that the small claims is appropriate then we will assist those wishing to go down that route,with info and draft up some stuff to get you on your way.

Martin I just got an email telling me you've posted on here what is going on everytime since awax posted I am recieving an email when someone posts and it's connected I think to when I am logging out will I try replying to the email just don't understand how it's happening

At the top of the Thread, click on Thread Tools and unsubscribe from this thread, to stop getting emails about new replies.

Ok you can configure this in your user settings by clicking on user cp in the blue task bar at top of page.

Just disable the email notifications from there.
