To answer your question, the value of the laptop is £255.  When filling in the online form to prepare the shipment it asked what the contents of the parcel was and the value and I specified "laptop" and "£255".     • Before you start this claim you need to have a lot more confidence in what you're doing which means that you need to understand the way forward in the principles involved more thoroughly.     • Hi, I've been reading the invaluable advice on this forum and reading about the problems with Evri and lost delivery of items.  From what I gather the initial steps after having exhausted every's own lost item claim process is to draft a Letter of Claim, I think it is called and to register with the government Money Claims.  I have got a login for Money Claims and have made an initial stab at the letter but I'm not certain I have got it right. Am I right to assume that having exhausted Evri customer service's claims process and having received the denial of any compensation because the laptop I was sending is on the non-compensatory list that my next step would be to send the Letter of Claim to them? Let me provide some basic details which I hopefully have addressed in the letter. I purchased a laptop through Amazon.co.uk which a business in Belfast sold refurbished laptops through.  They had a 30 day money back guarantee for a full refund if you have any issues with the laptop.  I have the invoice from Amazon showing the purchase.  On 27 April, 2024 before the end of the 30 day period I used their ParcelShop (inside a Tesco) to send the laptop back and have the tracking reference mentioned in the letter.  As mentioned in the letter there was they advised they could not give me or sell me any insurance because laptops are on the non-compensatory list so I just paid the normal delivery cost.  It was scanned as leaving the ParcelShop on 29 April and the tracking has been like that ever since.  After a 28 working day Evri claim process they gave the expected response that they could not provide any compensation and simply could not proceed with my claim. I was hoping to get some advice on whether I go ahead now and email this to Customer Services straightaway and should I send a hard-copy to the Evri address as well?  Or are there any steps I have missed out on first?  I believe 14 days is the reasonable period of time for them to respond so if I were to send it tomorrow, for example 12 June then I should expect a reply by 26 June, is that correct and fair?  And assuming they don't reply with a full refund then I would then go down the government Money Claims site to proceed with that? Sorry for all the questions, I want to make sure I go about it properly.  I'll continue to read through other cases on here so I can get an even better handle on the process.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey guys, new here !

 

I have now requested my bank statements for the past 6 years from Halifax..to which I have paid £5 for.

 

I have heard allot of people say that they have been sent them & all transactions are in 'code' & you cant understand them ?

 

Some have no charges listed on them..

 

I didnt mention to them when I called that I wanted these included.. do they have to provide details on my statements of these charges ?

 

Also is there anybody who has had thier money back from Halifax as yet ?

 

Cheer is advance . I really want to do this but I dont want to mess it up..

Hi Lisa, it looks like people that have followed the FAQ instructions to the letter have all received a full payout. I'd get yourself acquainted with the step by step instructions, they're so good and it makes it far less daunting than it would otherwise be.

 

I'm in the same boat as you in that I requested my statements yesterday.

Im really nervous Im going to fluff it up.. Im not the brightest of sparks !!

 

I have just read the bit about people making mistakes with these claims ? One of them is not claiming back for interest occured..

 

This is something that will really confuse me & I wouldnt know where to start..

 

Is is hard ? On your statements does it clearly state how much interest ?

 

Im thinking this will be very confusing & if I do get it wrong, could that mean bad news for me ?

Blimey, you could worry for England! Calm down, deep breath ....and relax.

 

There are 2 instances of interest you can claim:

 

1.When you go overdrawn the bank will charge you interest, perfectly lawfully.

 

However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.

 

Vampiress has a spreadsheet, (the advanced one), in the bank templates library, which attempts to calculate this

 

It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother

 

This is the interest referred to in the preliminary and LBA letters.

 

 

2. Section 69 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before moneyclaim

If I dont claim for the interest It doesnt matter does it ?

 

Instead of messing it up, as it will be very little, I would rather just leave it out !

I received my statements quite quickly, 97 pages of them. They did not drag their heels, I have requested my money back - stage 1, and they took 16 days to reply, they have offered me £100.00 "in full and final settlement" ...I think I will wait and get thousands I think they owe!

I am also very confused by everything, and very worried asbout it all but I am determined to get my money back...then we are after the TSB, HSBC, credit card companies etc!

Please read the frequently asked questions section to familiarise yourself with what you need to do, all the advice is there to help you, and i am sure you will be alot calmer once you aquaint yourself with it.

I am worried that by the time I have my statements & sent the 1st letter that they would of found a way to get out of it/.. How long have has it been since the 1st claim was made ? They must be pulling thier hair out as news is spreading fast, hence more £££ being paid out..

 

And yet charges remain the same..people are still being charged hurrendous amounts from banks etc..

 

How come they havent stopped ? Or at least reduced them ?

Contract law would have to be altered, they are the ones on the back foot, they dont want a single case to go to court, they have paid out because they have charged us unlawfully.

Yup, Cos they are making something like 3billlion a year from us in charges, they wont stop till they are forced to.

It is estimated that they make between £1 Billion and £4 Billion in charges per year.

 

Even if they "only" make £1 Billion and the total paid out to this users of site and all other similar sites, plus all others also claiming is £10 Million (which is unlikely, probably nearer half that in truth) then it represents only ONE PERCENT of what they made just last year alone based on the lowest estimate!

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

I have had many people tell me Halifax have a habbit of sending statements that list NO CHARGES..

 

Others have said that the charges are listed in code & arnt easy to identify ..if so what transaction codes am I looking out for ??

 

I want to know I am claiming for the right things !!

My advice would be to list the name of the charges or codes you do not understand and others will help to unscramble the code. Or try a google search under the codes and charges.

I didn't have any trouble working out which were charges as they were all clearly marked CHARGES AS NOTIFIED

The prices crept up over the four years, I've banked with them from £30 to £39.

The only thing that I found with Halifax is that if you incurred more than one charge a day, they lumped the totals together under one charge.

Halifax settled

Halifax (again) settled

Nationwide settled

Natwest settled

Don't forget to donate to this site, they gave us the backbone to put up a fight, we've learnt how to reclaim our rights and proved banks are all nothing but........ rubbish <wink>

Hi Lisa

I sent my request on 18th Aug too (to Halifax), they are going to be very very busy! I spent around a week just reading everything over and over before I decided I should go ahead and printed loads of info off so I could find it easily. It is daunting and scary but the more you read and familiarise yourself with the process the less scary it seems.

 

Let me know when your statements arrive and Il let you know. I tracked my letter I sent them, its not been signed for yet so Il check it again tomorow.

Good luck and chill out or youl be a wreck by the time your cash comes back to you!!

Have figured I have paid out £377.00 over past 6 years. I am still waiting for my Halifax Visa Statements, also from my Egg Card & Argos Card..I know they are going to be hurrendous!

 

I am just about to do my spreadsheet..does this simply have to state date & amount charged ? & then total it up ?
