Afternoon all,

I'm having some difficulty trying to find out who is responsible for repairing my Vax VZL-704. I bought this 9 months ago in a local department store (Bodgers Ilford) but unfortunately I did not get a chance to use it straight away but rather a few months later.

Upon using the VAX I realised that it did not work properly as it just wasn't pulling anything up. I spoke to the store and they informed me that I would have to take it up with the manufacturer as a few months had lapsed since the purchase was made. VAX repaired the unit under warranty and sent it back to me, the only problem is that it still does not pull anything up.

I spoke with their customer support team at VAX and they said that as they had carried out the repair and were happy with the job done, they would not be prepared to take another look at it. As far as they are concerned the unit is not faulty.

The department store want nothing to do with it and VAX refuse to help. Is there anything that I can do to try and resolve this situation, I feel rather hard done by.

Thank you

Hiya, have a read of this page. It should tell you all you need to know.

BBC - The One Show - Consumer Blog: Don't be fobbed off: Sale of Goods Act - letter download

Send the letter recorded delivery.

On a side note, I have a VAX and its crap. If your after a carpet shampoo'er then rent a Rug Doctor for £20 from Morrissions. They are great and do a really good job.

This is probably the simplist question ever asked on here. There is only one person to contact and that is the one with the sole responsiblility - the shop it was purchased from.

No ifs, no buts only where it was purchased from.

The thing with VAX is there is a big sign on the box when you open it to contact them, and they tell all retailers to get the customers to contact them. This essentially acts as the repair agent for retailers, I don't class it as a fob off if everything comes back fine.

If however VAX are now refusing to repair it and it is still not picking anything up then the retailer is still responsible as posted above. I would ask the manager to make a mess on the floor and clean it up with your vax if he is so confident that its not faulty. I doubt they would but there we go. Tell them if they are not prepared to repair or replace the item as a retailer you will have no option but to seek other options under the Sales of Goods Act. Remind them its there responsibility and not VAXs as you purchased it from them and not VAX.

Ex-Retail Manager who is happy to offer helpful advise in many consumer problems based on my retail experience. Any advise I do offer is my opinion and how I understand the law.

Hey that's a great idea, I'll pop down there tomorrow with my husband and do a bit of cleaning. Thank you for your reply.
