    • That isn’t actually what the Theft Act 1968 S1 actually says, BTW. https://www.legislation.gov.uk/ukpga/1968/60/section/1 (1)A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it;   The difference between what you’ve said and the Act? a) intent to permanently deprive rather than  just depriving (which is why the offence of “taking without consent” was brought in for motor vehicles, as otherwise "joyriders" could say "but I intended to give it back at the end") b) dishonesty : If I honestly believed A's pen belonged to B, and took it and gave it to B - B might be found guilty of theft but I shouldn't be. 
    • Received a call and follow on confirmation email from the police about my cabinets! They wanted to confirm that I was prepared to support police action for the matter and that I would be happy to provide a statement and attend court at a later date!!! I think that something might actually get done - it won't get my cabinets back I know that but hopefully it will put a stop to this so called courier doing this to people!
    • Around a month ago I had to send a sympathy card to a friend in GB. Logistically it made sense to buy a personalised one on eBay and get it sent straight to my mate, rather than faffing around getting it sent to me.  This mighty purchase set me back all of £3.05 (including postage costs). I was taken aback that, when it was sent, I got a tracking number.  For a flippin' three-quid card!  I had no idea that technology had moved on so much and that tracking was so easy.  The shop has feedback for 16,300 purchases so tracking must be easy & automatic. It's unlikely your case will get to court, but in cases that do this got me thinking that we need to aggressively challenge the PPCs where they have lied about the timescales of sending their rubbish and have no proof at all of posting - when it would be so easy to provide it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I Too Can Not Give Any Direct Advice Of How To Treat This Letter, Or What To Do In Reply. :| Postggj And Others Will Deal With That, More than Successfully I`m Sure.

 

I Am Also Sure That, You Have Looked Around This Forum? Therefore You Will Know (if my understanding is correct) That " With Out Prejudice" Means This Letter Can Not Be Used In Court, With Out The Say So Of Both Parties. :)

 

What Is The Point Of Producing A letter Like That And Then Sticking " With Out Prejudice " On The Top? In My Opinion It Is A Frightener (and it`s working). It Has Been Sent To Elicit A Reaction From You!!!:-x

Thank you so much for all your support, I do hope that you all and postggj didnt think I was pressuring him (like he would take any notice lol!)I do wonder though if i will still get a visit from one of their monkeys trying to repo the car, looking at other threads, do i put up a fight and call the police?..............xxxxxx:confused: Really sorry people to be a pain, I can normally sort things out myself but I am flummoxed. I think whether you call the police is your decision really some people hand the keys over and then fight and others refuse to hand keys over and call the police. Sorry im not much help Post will be back with his letter soon Im sure in the meantime try not to worry too much and if in doubt dont open the door ;)

sorry i cant help you,and my tale is different.(welcome secured loan),but let me assure you, i have every faith in poste and the other caggers advice on this site. keep your chin up, welcome are bully boys pure and simple, who will try and kick you when your down, but when faced with people who kick back(poste and caggers), they run for the hills.stand firm and it with all get sorted, good luck with the ****, will keep fingers crossed for you x

Thank you for all your words of encouragement, I know I'm in great hands with post, it was a natural knee jerk reaction to get worried about the 'termination' letter, and as mark rightly said i understand that without predjudice means bugger all but was still worried, i am now reassured, i wont write anything else as i know post(the sweetheart that he is) is helping other folks and I have to be patient. Sorry everyone

OMG the came and tried to repo the car today, i asked him if he had a court order he said no, i said well you aint getting the car, he said you oly need court order for paying 1/3, i was like, no your not, this went on for a few minutes and i was refusing to give him the car. Anyway hs says hes going to big eldest daughter up from work at this point 'monkey jumps into the car, and says and i quote 2as soon as i have touched this car this belongs to me..i was like yeah fnar fnar...get out...he wouldn't, he then said he was going to ring the police so i told him go ahead.......the upshot was that this monkey was trying to tell the police that i was stealing the car (i told them all about the letters and agreements) then tried to tell Mrs P.C that this was theft, which she didnt take too kindly too. He kept banging on and said he could take my car to the pound and that i could sort it out with welscum, whivh i declined as i saw, an auction site at the bottom of his 'forms', the police looked at these forms and again asked if he had a court order which he replied no, police sed he needed one, he argued the toss with the p.c and was this much away from being lifted said i was a civil case and the police agreed and said if they touch my car, hes in for it BIG STYLE,they couldn't have been more helpful, they advised me to put the car on the drive and padlock the gates, and said he could only come back if he had a court order, don't know if thats going to happen, I feel a small victory anyway and to see his smug g]face falling as the police turned against him was classic. xxxxxx

Mark, a few weeks ago before havin the the joy of stumbln on this site I would have rolled over and died and given the monkey the car, but armed with information that everybody an what I gleaned from he other threads I was fully armed with my info, monkey phoned the police and i dont know athe said but two cars came blues and twos down my street. He got so angry with one of them he demanded his name, which p.c gave quite wilingly, he then asked why whe tis happened a cpl of month ago to someone else did police say it was ok, p,c said not my case thatwas ten this inow. Also beyondhope, police said i should hide the car till the case had been disputed, he asked if i could put iin my garage but is choka block wit non garagey things, so thts the only help i could give you. :)

Thanks slim I dont have access to a drive either :( It'll be ok because im sure they would be breaching data protection if they speak to me about it and they wont be taking it without keys because there is no way they will get it out onto a lorry from between 2 parked cars ;)

Well, all quiet on the home front, i still feel as if i'm looking over my shoulder, and parking in the drive is a nightmare (i am a woman after all lol) and having to padlock the gates! I wonder if post has had any time to do the letter....heres hoping :-D
