    • Hi,  It has been very stressful. I have just received a letter of 'Notice of Transfer of Proceedings' which states the case has been transferred to my local court and to await judge's directions. Is there still a possibility that it will not go to court? The other issue I now have is that I am moving abroad for work in the next few months and now might not actually be able to attend the court hearing!  I am not sure what the best course of action is now. I feel like after all this, the MET are going to win anyway! HELP! 
    • Thanks for jumping in Bazza.  I understand that some people would suggest this.  But no. The moot point is that there should not be any debt.  There shouldn't be any reason for me to be made B.  The lender / receiver are responsible for the property not selling in a timely manner.  Whoever heard of a (well-located nice) property not selling in >5y?    They have no reasons.   Disclosure has subsequently offered staggering evidence which corroborates lender bad behaviour, bribery, and collusion/ interference with the receiver.  I am holding them to account for this.  It is clear they don't want this evidence in the public domain - it will shred their reputation.   (One also has to understand that the ceo - with collusion and conflict of interest (using same lawyers as lender) and receiver - tried to get the property cheap for his own use) They now want to agree a settlement.  I have separately reported a lawyer for negligence to the LO and SRA. I want to report the receiver as soon as I understand how to.
    • Same as Barclays one I have just updated on. PRA group have written back and told me they intend to proceed with claim, have also sent another stack of documents, similar to last time round. I did fill in an online income breakdown etc on their website  offering to pay them x amount of money back each month,  a couple of weeks back, they haven't acknowledged that ?  
    • Hello, I wasn't able to update the defence, so they got the daft one.  Pra Group have responded dated 25th April saying they intend to proceed with claim. I have also received a stack of documents, similar to last time - print outs of old statements, but this time around they have send me a copy of the Barclay Card Conditions. Unsigned and dated. The address is an old address.  A consumer credit agreement with current address. Pages of it and no signature. I have uploaded onto a PDF what I have. The CCA agreement looks like a generic print out, I5 pages + long, I've included the 1st page that had my details on (redacted) don't know if its necessary to upload all of it.  Barclays 26042024.pdf

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can anyone advise please sent £10 postal order for my sars from MBNA as they only sent me a copy of my application when I sent for cca they have returned the postal order and stated without identification showing my signature they cannot send my sars for security reasons

 

Sent for copy of cca I got a copy of my application so sent £10 postal order for my sars had a response stating MBNA cannot send it for security reasons without proof of my signature which they`ll accept a copy of either my driving licence or passport what can I do now?

If I were you I'd send it to them. These idiots don't care that they have always communicated with you at your address, they are awful, tragic bent liars....that is the world we live in.

 

Send back your £10 and tell them to provide forthwith and quickly; but the most important thing is reporting them to the massively useless OFT (I know, I know, still worth it though)

 

I take it you know what awful bent, filthy liars MBNA are?!

Really appreciate the replies sent for Sars as had cca come back for 2 accounts my husband had with MBNA husband had a brain injury so I am having to deal with everything he as been paying into a dmp with CCCS since July this year none of creditors accept the low payment and starting to get default notices, can`t offer more than is available so started off with MBNA sending for cca 2 things have come back which are applications for 2003 and 2005 I would like the Sars but if I send back the £10 postal order what do I actually put in writing to them? and no idea how to post my husbands cca up onto the site useless on a computer lol

Before I can complain about them don`t I have to write to them to allow them to put things right?

Joined this photobucket thing how do I scan things onto their and then onto here at a total loss how to do that

If I send the postal order back for the sars from MBNA without proof of who ,my husband is am I just running risk they`ll return it again? what can I put in writing as such to tell them to send it and to stop acting the goat already reported them to ICO and advice please how to scan agreements onto the consumer site pleaseee

If MBNA don't comply with the SAR request then make sure you report them to ICO ( The ICO will charge MBNA at least £500 to cover the investigation costs ) and also go to court to force their compliance.

 

Have a look how FUAFB did this against Lloyds TSB.

 

The tactics used are the same against any financial institution that fails to comply

Isn`t it hard to understand copied that url thing up in space but it says my name then when I click on it no file comes up just the photobucket web site thanks Scott think it would be a big help for people to recognise not everyone understands computers urls, pasting etc is all nonsense to me no idea what uit is

Looks like I`ll have to wait been trying for 4 hours now to download cca all I get is the photobucket web site with name of the account holder wish it was as simple as copying pasting to microsoft office or ebay

The 2 items I have posted are what MBNA sent me as copies of my husbands CCA this is my husbands application the terms and conditions are barely readable it states the rest of your terms and conditions 4-19 can be found in the full conditions which we must give to you, which my husband never had. 2nd paper is the back of the application. Sent along with these 2 papers are 4 pages of what they say are a copy of the agreement which as my husbands name and address printed on the front which I believe as been added in as others like this I have seen for 2003 and 2005 do not have the name and address on the front the terms and conditions sent are the same for the 2003 MBNA account and the 2005 MBNA account apart from the rates of interest and the default charges are the same £12 each on agreement papers though on the applications they have sent back the default sums are £20 in 2003 and £25 in 2005. As with the 2005 application at the bottom where the cardholders request and declaration is it asks you to read section 11 in the terms and conditions provided before signing but there is no section 11

What was sent with request for CCA name and address typed in but noticed this not on others I have seen and default £12 on the 4 page cca yet it was £20 on terms and conditions on application The 4 pages of what they state is a copy of the credit card agreement has nowhere where it can be signed but the application as been signed
