BAYV

I have unapproved your post.

I expect to see BAYV contribute to threads relating to them with CONSTRUCTIVE and HELPFUL advice, and NOT to simply provide a link to their customer service department. I also expect to see full CLOSURE on any BAYV threads. By doing this, it allows OTHER people to learn and benefit from any advice.

Any further BAYV posts that do simply refer the complaint to their customer service department will be removed.

I still firmly believe that the BrightHouse forum is still the best place for BAYV and Perfect Home threads. This is because we have some very good Hire Purchase experts here, and both BAYV and Perfect Home simply use the same BrightHouse business model.

But I will not allow any BAYV threads to simply come to an end due to the posting of a customer service email address by BAYV.

CAG welcomes input on this forum from BAYV - and would like to encourage the company to contribute. But this does NOT mean simply providing a link to their customer service department. By doing so just takes the problem away from this site, and other members cannot learn from any advice (or solutions) given.

Cheers

Hi nicolefrenzy

No doubt you are quite angry with your treatment by one (or both) of the companies you mention. However, comments such as yours do nothing to improve things, nor do they encourage the said companies to participate.

Please keep your comments constructive.

Thank you.

for referance here is a copy of that post;

At BAYV we have two types of cover available, both of which are optional.

Customer can purchase optional service cover which in the event of a breakdown covers: product collection, repair, parts and where necessary a loan product if the customer’s purchase cannot be repaired immediately or in the event any product cannot be repaired, a full replacement. This cover can be cancelled at anytime by writing to

Registered Office :-

We also offer optional cover for theft and accidental damage. Under the terms of the Higher Purchase agreement it is required that the customer has sufficient insurance to cover the value of the products. If the customer decides not to take out cover with ourselves they should ensure that their own household insurancelink8.gif covers these products. We simply ask for a copy of the household insurancelink8.gif policy for our records.

This cover can also be cancelled at any time following the above process, provided the customer can demonstrate that they have obtained adequate alternative cover.

BAYV takes any complaint received from our customers very seriously. Due to the anonymity of postings on this website, it is impossible to investigate an issue without knowing the customers details notably: their name, address, phone number or account number. We would not recommend that anyone posts details of this nature on a public forum such as this.

Hi again, BAYV. Thank you for reproducing your earlier post here.

As you will no doubt be aware, I have replied to this post on the original thread you refer to:

buy as you view but same problems as bright house

For your reference here is my reply again:

"...As is the case with BrightHouse Service Cover and Damage Liability Cover, I have long suspected that the BAYV versions are optional, and can also be cancelled at any time (in writing) by the customer. This, however, appears to cause much confusion with many of the BAYV customers we encounter here at CAG, so it is of great value for us to now be able to confirm this.

Can you reassure CAG that when a customer requests the removal of service cover and/or theft and accidental damage cover, the customer is NOT required to sign a brand new Hire Purchase agreement and, by doing so, lose their accrued "protected" status on any goods more than one third into an agreement, and their rights against repossession without a county courtlink8.gif order?..."

Your further response would be appreciated.

Cheers

Lefty

Hi, the service cover and damage liability accounts are seperate to the main product account.

When removing either of these we do not need to modify the main product account. Therefore the customer does not lose their protected status on their goods if applicable.

If the customer wishes to have further clarity or reassurance on this, she should call Linda Davies, Customer Service Director.

I hope this helps.

Thank you for clarifying that point. Very much appreciated. (I shall reproduce this statement into the original thread on your behalf.)

I only wish a certain "competitor" of BAYV took the same simple approach, and didn't cause their customers to unwittingly throw away their consumer rights!

Thanks again!

  • 2 weeks later...

I am currently working on a CAG "Buy as You View" customer advice factsheet - a similar item to our existing CAG BrightHouse factsheet which you may have already seen.

CAG has received a lot of complaints about BAYV recently.

I have placed a thread in the "sticky" section of the forum HERE for anyone to contribute with their experiences, horror stories, GOOD SERVICE STORIES, or anything they feel would be of interest, and of use, to the factsheet.

PLEASE DO NOT ADD YOUR VIEWS TO THIS THREAD. Add your views HERE

Many thanks

Cheers

Hi ,I would like to share my experiences of Buy As You View ( BAYV) ,I have already posted on many Buy As You View threads on here .

I was a customer with Buy As You View from 1990 - 2007 ,back as far as the days of Just Rentals before th comapny nam changed to Buy As You View .

It was a handy way of purchasing goods when financially unable to afford them upfront . However I suffered with illness and fell into arrears with this company and to cut a long story short ,I was harrassed by an employee of Buy As You View in 2007 ,he rang the local cafe I would go to for a cuppa with friends asking for me ,due to the fact he telephoned my mobile and my son who was 12 at the time and staying with my sister due to my ill health answered the mobile phone as I had given him my mobile phone so my son could keep in contact with me whenever he wanted . My son not knowing any different told this employee of BAYV that I go to this certain cafe in town .

The following day this employee turned up at my home ,i was unwell and he introduced himself as a debt collector for BAYV .He explained that he was there to take the goods from my home . I was alone in the house and would not let him in ,and he said he would return the following day ,I then asked a good friend of mine to be present when he called .He had a sheet of a4 paper with him and at the bottom it clearly stated goods probaly not at customers home ,probaly sold ,due to a drug habit . I remember crying and my friend being very disgusted and annoyed at this statement ,as the only drugs I have ever taken have been prescribed to me by a consultant due to a history of severe depression and a nervous breakdown ,of which I have suffered since the birth of my son in 1995 ,and still do .

I showed the goods in question to the so called 'debt collector' to prove I was still in possession of the goods and they had not been sold . The empoyee obviously realised how upset I was and the severity of the allegation made of the items being sold for drug addiction ,and soon changed his manner .In light of the situation he took the television I had from Buy As You View ,paper work of return of tv I still have in my possession . He however didnt take the pc and monitor ( which is still in my home ) . I heard no more off Buy As You View as he told me the remainder of the account balance would be written off as a gesture of goodwill .

It was recently due to media coverage ,internet sites I learned of mis - selling of payment protection Insurance ,and remembered all the times Buy As You View added maintencance vouchers to hire purchase agreements ,and not on one occassion asking did I want this warranty ,explain to me what it was for ,how it worked ,or if I had my own insurance to cover the goods .I was mis sold to believe that you had to have this to be able to have goods with them . In my view I was Mis-sold these warrantys ,and also adding interest on the warranty in the hire purchase agreements . I emailed a complaint initially to Graham Clarke ( Chief executive ) ,who then replied stating he had handed my complaint over to Chris Webb ( Regional Director ) ,I then emailed back asking for my agreements under the consumer credit act 1974 . Chris Webb informed me he was dealing with my complaint ,and would search the archives for information I had requested . He then asked to set a meeting up with himself at my home ,which I agreed to . However he only had 1 agreements with him of my accounts before 2007 ,when i ceased to become a customer with BAYV. I also told him of the allegation made about being accused of selling the goods due to a drug problem . I felt this meeting to be a waste of time .I received my agreements ,voucher maintenace order forms through the post ,as I had requested all information held on me ( Subject Access Request ) ,Upon receipt of these documents I was very concerned to see 2 agreements which had signatures on which were not mine . .I contacted Chris Webb of this ,asking he look into it . Again cutting a very long story short , I received a final response off Chris Webb ,denying any liability of mis-selling of warranty ,staitng that employess of BAYV are all trained and instructed to explain the full range of options available to their customers along with their associated benefits . That the maintenance cover is clearly indicated on agreements . and I have signed to accept the relevant terms and conditions . I however disagree strongly with his comments of mis selling ,in the hire purchase agreement ,nowhere does it explain in simple form ,that the maintenance is optional and can be cancelled at any time . The box of termination rights ,is about terminating the agreement that they will then be entitled to the return of the goods and half of the total amount payable under an earlier agreement as modified by this agreement .Also the maintenance order forms ,have no clear terms /conditions on them .However on a maintenance voucher I managed to find part 9 of this voucher states that the rights to receive a voucher repair shall not apply where the company shall in its absolute discretion deem that the equipment can no longer be serviced efficiently or economically . Yet they charged me on 1 agreement alone £75.00 for warranty on a video recorder costing £89.99 ,with a 1 year manufacturers warranty ,why would anyone need an extra extended 3 year warranty ,totalling 4 years with manufacturers warranty . Would a vcr expect to be serviced efficiently or economically . In Chris Webb's final response he made no comment or answer to my complaint of the signatures that arent mine . I have involved trading standards now ,and have received my form to send off to the Financial Ombudsman Services ,I have also been approached by 2 reporters 1 from BBC and another from HTV ,I will do anything to protect people from the harrassment,to customers ,and mis selling this company do . I did email back to Chris Webb ,Graham Clarke ,and Adrian Hill about ignoring my concerns of the 'forged signatures' as yet not 1 of them has replied .

i did work for this company, and believe me, they are anything but honest and upfornt with thier customers, most of the contracts are unenforceable due to bieng hand written by so called account managers, but dont worry guys, they didnt just stuff the customers they even stuff thier own staff, i was charged monthly for private fuel on the fuel card even tho i had my own car, when i asked about it they said because i was field based i had to pay for the fuel used to go to thier offices mmmm i quit shortly after, should any1 need any advice then if i can help at all i will.

Hi there, i was just reading your post about some hand written agreements not being enforcable, i have a refinance agreement that is hand written and we havent received a fully printed version of this agreement. Could you elaborate on your post and also how this could effect me please.

I have been with bauv since 2007 i had a 32inch TV off them an yes they would break they would have to go back for repairs. I have also had a freezer microwave an hoover in 2009 my microwave was taken back 4 weeks after i had it as there was not enough money in the meter i singed to say they could take it back afew weeks later i got a new contract stating what my new payments were but the signiture was not mine when i phoned an told them i was asked was i sure it was not mine. my reply i no my surname as my collector had singed in my madin name not my married name as bayv will not change the surname on my account. i did not get an apology on that but i never saw that collector again i was told by the new collector he had been sacked...

In march 2010 my tv broke yet again so was sent back for repairs an i was given a 26inch tv after askin every 8 weeks to all my diffrent collectors where is my 32 inch tv i gave up an last month phoned there main office the welsh lady i spoke to was very shocked that i had still not heard anythin an it had been a year an said she would put it straight through to complaints when i phoned the next day i was told its there new policy they do no longer replace tvs they just wipe what you owe on them and had wiped the £250.00 off my account but would keep the loan tv till my other items were paid for..

then saturday just gone 2 men from bauv turn up to collect my loan tv i was out an my sister answerd the door they said they would call back monday they didnt. but when i phoned my collector askin why they had come for it he said he would get back to me as it did not make sence as i would not be able to pay for my last 2 items. he did call me back an agreed they did come for tv an i would have to call head office on monday to find out what was going on but if i would like a new tv he would come out an i could have 1 ( er no not when i have paid well over 1000 pound for a tv that was deemed non repairable an i will never see no way in hell i will get another one )i really can not wait to to pay the last of what i owe now as they really are a load of rubbish and thanks to some very kind hearted people out there i got a free tv off freecycle it may be an old type but it works an my lil boy can watch his cartoons
