    • I have a similar issue, I was caught shoplifting in M&S last fortnight (which I'm ashamed of) and I received a letter from DWF with the £125 fine and the price of the goods. I've paid the money. The police were not called, but a police letter was sent to a presumed suspect. Will this letter affect the options I choose when applying for a visa (I checked many posts and found no one who has received a similar letter). Is it all over after paying the money? I'm so anxious about it all!
    • I used to go to the Sainsbury's in the Cromwell Road London and my wife used to get PCNs there. I just spoke to a manage onsite and they were good enough to get them cancelled. If you take in the PCN , they photograph it and that is the end of it. Which is what should happen with major companies when their customers are ripped off by the rogues. Are you listening Mcdonalds and Starbucks?

    • well you could begin by laughing. the idiots at Europarks have had two attempts at sending you a compliant Notice to Hirer and have failed both times.🤣 For the second time they have quoted 28 days to respond but the protection of Freedoms Act 2012 Schedule 4 Section 14 [2][b]requires 21 days notice. They keep asking who was driving which is irrelevant, only the hirer is liable which is why the notice is to the hirer which seems way over their heads. They should have sent you a copy of  the original PCN , your hire agreement and confirmation that you are responsible for motoring offences at the same time, which I assume they didn't do once again. You have more chance of being made a Dame of the British Empire than losing against these numbskulls. Just relax and ignore anything else they send you. I doubt they will send a letter of Claim but if they do let us know straight away so we can have a laugh and send them a snotty letter.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hmm, there appears to be a right old muddle here doesnt there and all down to the Court's administrative department.

 

When you say the documents you have conflict with the defence, do you mean the other side's defence ?

 

I think all you can do at this late stage is to detail, bullet poiint fashion, everything that has happened to date. Take copies for you, the Judge and the other side.

 

If you have the other sides defence, then you will also need to be able to counter all of the arguments they have put forward.

 

If the other two judgements have been put aside then this should be a totally new hearing, with probably all the facts that been raised before.

 

In the first hearing you were awarded judgement and costs.

 

The only reason the 2nd hearing went against you was because you didnt attend. This because you were under the impression that it had been vacated as judgement had been given previously.

 

I imagine that had you known about it and attended the 2nd hearing that either the cock up would have been noticed and that judgement would still have been given to you.

Thank you so much for your support CitizenB as always your word of wisdom have helped me to sort this out in logical order, I have now bulletpointed all the important facts which dispute the defence, within a document which I will give to the Judge tomorrow.

 

Hopefully I will have some news after the Hearing and I HOPE this matter will now be resolved. If not rest assured I will post up for advice. :)

Thank you Slick32 and also CitizenB for the good advice given..

 

we arrived at court for 9.30 for a 10.00 am hearing, they kept us waiting as the defendant did not turn up even at 10.20, so we went in and sat down, I gave our bulletin point document and also indicated that this is the 3rd Hearing to consider this matter and we have incurred considerable expense.

 

He read through the documents we submitted and said "I would have liked to have questioned the defendant on some of the issues he has raised as he is clearly, misinformed, when I look at the documents you have submitted" we asked if the matter would be final today and he said " Yes I accept that there is now no defence to your claim, and I accept your claim in full"

 

I asked if we could have the costs of £230.20 reinstated (ones which this judge dismissed previously) he asked if we were claiming for today and I said yes 2 hours for reaserch and travelling and parking and also 2 hours waiting and the cost for the copies of the documents to date.

 

We were awarded 230.20 plus 44.20 for today ..................

 

Thank you all again - IVE HAVE TO NOW ENFORCE THIS JUDGEMENT as the builder is not going to pay, so the Judge advised that the matter should be transferred to a High court Sheriff as they have more powers.

 

This has been done today......................I will keep posted

I dont mean to alarm u but depending on where you live is if the high court sheriffs will get involved.

 

I know for England you have to have judgement for over £600.00 b4 they can be involved.

I think the claim is for considerably more than £600.00 (please re-read the first sentence of the thread) ;).

High Court Enforcement Officers do have considerably more more powers available to them, so hopefully you should see a return of your money.

I would advise you to read the thread aswell due to the OP stating that she was awarded 230.20 and 44.20 for today.

 

Which when i left school in 1997 came to a total off 274.40 which is under the 600.00 for high court enforcment well when l went to school they may have taught me wrong which i would not put past them.

I'm not doubting your mathematical capability at all, TGM. :)

 

However, the Judge would be referring to the Judgment Sum owed (not yet paid by the Defendant) plus the awarded and re-awarded costs................ comes to considerably more than £600.00 ;)

I may have confused issues but the total claim as SS stated is for over £5000, We have started High Court enforcement as the Builder has now decided that he will be appealing the judgement as he was on Holiday again!!!

 

It seems he has a lot of money for holidays, so he can now explain this to the Baliffs - Some people like this builder just use and abuse the system and hope they will scare others off, I am grateful to every one at CAG and their support in my various matters.

 

Without this site I would have been lost and given in some months ago..........so all help and advice is respected as I believe everyone here is here to help others, less fortunate or wealthy enough to fight on their own.

Keep on adding your costs on............and address any Court Correspondence to the Judge who heard the last hearing.

another hoilday he must have more money than sense. I have not had a holiday for over 6 years and b4 that for over 10 so if he is always going on holiday maybe he should give a few to me.
