I am going through the small claims and have received my allocation questionnaire which I have filled out and posted back to the court.

 

The defendants solicitor has sent me a copy of their allocation questionnaire and has asked that I send a copy of mine to them, stupidly I did not take a copy before I posted it off.

 

Is it a requirement that I send a copy to them or can I just ignore them?

Or shall I email/write to them and let them know I do not have a copy?

Hi,

 

Ive always found court staff pretty helpful (although others have different experiences!) Since the only copy is with them I dont see any alternative but to contact them and see what they advise.

I have no legal qualifications whatsoever, so please check any input I have for accuracy. And please correct me if you disagree!

Sorry to double post/change the thread.

 

What also happens if I have ticked the box to say I would like to resolve it without going to court and the defendant has chosen no?

 

Im not too hot on court procedures, but I can relay some advice CAB gave me which suggests that will work in your favour. They told me that as court is seen as a last result judges like to see that you have acted reasonably and tried to settle without court. So they instructed me to tick that box.
