Look at the final quote from someone at CCCS about "people paying their debts insteaad of looking for legal loopholes". All well and good, but onus on lender to "get it right" and this is even more the case if debt sold to a cretinous DCA.

Surely CCCS shoud be wrokgin FOR the debtor, and not taking the lenders' point of view. That said, as I understand it, CCCS is funded by the LENDERS in some way - so guess no unexpected. I guess just an alert to people to not expect CCCS to be your unbiased advocate if you are dealing with them.

Frances Walker at the Consumer Credit Counselling Service, said: “where will it all end?”. Maybe the financial sector will obey the law and follow agreed guidelines!

Hi angry cat

You said

The judge also said that because Ms Thorius was mis-sold payment protection insurance (PPI), which added thousands of pounds to the overall debt, she should have her slate wiped clean."

The mis-selling of Payment Protection Insurance is not a loophole

Do you mean its not a loophole but a fact, or are you saying that PPI sold to someone who would never receive any benefit from it , such as the self-employed, or others that would also not benefit from it ,now i call that miss-selling

in this case it is a loophole created by the banks etc in their haste to sell you a policy not fit for purpose, thus allowing you to re-claim your money back
