I said, "Can you recommend a free offline pdf editor" this is so I can merge the pdf's into one file as requested. Online utilities can be helpful, but we only have their word that they shall delete the uploaded documents in a given timeframe, but have no means of validating this, neither can we confirm that their security is up to scratch, if they were hacked and they weren't deleting as they claimed, then- And so, as I do not wish to upload my documents to a free online pdf merge utility, and that bona fide tools such as Adobe quite rightly aren't free, and you have a maximum upload of 4.88MB, I offered my website - a source that I can control as a viable alternative.     • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think this is an apalling tragedy - and one that could have been avoided if regulators and others had been doing their job. Where was the Dept of Justice in allowing firms to act like this and stay regulated. Ditto OFT. Where were trading Standards?

 

There must be other stories out there - increased stress, marital problems etc - that will never come to light. And for what?

 

So that a bunch of DCAs can try to (pointlessly) extract blood from stones. Their interests (greed, enrichment) pale in comparison to the harm they do.

 

And where were the regulators to stop the PPI and other misseling in the first place?

 

Rules need tightening up - and NOW.

 

(i) DCA can make one phone call. If debtor says he is not going to pay that is it. Further calls are barred;

(ii) IF no CCA then DCA cannot chase the debt. Why shoudl they still be able to hase debts that are not legally enforceable;

(iii) ditto for Statutory Barred debts;

(iv) 3 stikes and they are out. Breach rules three times and lose license. Automatically;

(v) Liability for damages if cause "harm". Swinging financial penalties if rules broken;

(vi) no CCA. Immediately stop processing data. AND clear credit file;

(vii) other

 

I would HOPE the OFT will come down hard on the DCA (and the OC who had the original file) who caused this woman and her family such distress. They shoud lose their license - and tomorrow. I fail to see why these "regulatory agencies" just lack the "balls" to lamp down on these DCAs. They are there to PROTECT consumers - not shelter DCAs.

 

A sorry, but predicatable, outcome iresulting from the failure to control the DCAs and their outrageious behaviour!

Sentencing her, Judge Patience said “the life of a happy, bright, talented boy was wasted”.

 

The debt collection agencies are to blame for this...

Clearly, they drove the poor woman to insanity!

personally think that suicide due to debt ,is far more wide spread than the occasion reports which only come to light when it as tragic as this.

what about the attempted ones day in,day out.the cries for help.

 

to read the story was upsetting enough.

but the comments left,who are these unfeeling morons?

why the need for vile comments?

why the need for comments at all,by the obviously never being pushed to the brink of despair.suffered till they can not see any other way out.

The Mail in particular contains some really bigoted, crass, simple-minded and unhelpful comments, which is just about what I'd expect from that paper.

 

Shame that none of the articles seem to name which agencies/companies were involved in driving the situation to something as desperate and as upsetting as this.

When I was being jounded by Chandlers Bailiffs I said to the woman that was apparentl the manager... When you hound people like this its no wonder people kill themselves...Her reply

This country really is well & truely f*cked up Pompeyfaith....

Money & big business rules.

People have become totally de-humanised as a result of it all.

We care nothing for our neighbours anymore - simply how much money they do or dont have...

I am angry that taxpayers money has bailed out the banks & the government will pay a heavy electoral price for that.

But the economic crash we've just had ironically may have been a blessing in disguise & may just have re-humanised people a bit so to speak, to make us all care for one another that bit more.

Remember that the a$$holes who make those comments are very often up to their eyeballs in debt themselves. I find it satisfying to think that every day of the week some of them are losing their jobs, or becoming too ill to work. They'll be having plenty of time to dwell on their nasty comments then, when they suddenly find the boot on the other foot, and find out what DCAs are really like.

I agree re the MDs and others at the DCAs. That said, what about the Regulators. FSA, Dept of Justice, OFT?

 

The government, and us the taxpayer, have to pay to deal with this, including the costs of detaining this poor woman. The banks have already had a write off on the debt, and accompanying tax breaks - so the only "winners" are the DCAs.

 

The Regulators should be held to account - and immediately take STRONG AND DECISIVE action to "rein in" the DCAs. Those that were involved in chasing this woman (the DCA and the OC who hired them or sold them the debt) should be NAMED AND SHAMED and their licenses suspended, at the very least.

 

This is (another) wakeup call re the (totally unnecessary) DCA industry.

Dear me; I had to stop reading part way through the Daily Mail comments, some very angry not terribly intelligent people venting their spleen about I think their own inadequacies, rather than the experience of this poor woman.

 

That newspaper always makes me despair for humanity. As someone else has paraphrased 'there but for fortune go you or I'

 

I find it very difficult not to hope they find themselves in a similar situation.

 

The main cause of this seems to have been the lack of a reliable support network, it's a great pity she did not find her way to this website. One wonders if she sought help somewhere and found Daily Mail readers.
