Borrowing in April 2024 was £1.5 billion more than in April 2023 and £1.2 billion more than the £19.3 billion forecast by the Office for Budget Responsibility (OBR). Public sector receipts grew by £1.6 billion compared with April 2023, however, this growth was outstripped by a £3.1 billion increase in spending over the same period. Excluding the Bank of England, debt was 89.9% of GDP, 8.0 percentage points lower than the wider debt measure.     • That's very interesting to hear! I received a notification of a CC verification from Coles in Australia on the 12th May - also a Sunday evening. Not having been to Oz for about 30 years I was somewhat suspicious and so immediately cancelled the card. Guess what, it's the one I use to pay Lyca with........... If you've got any further information I'd be interested in hearing it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all.

 

A friend of mine got a letter yesterday from Castlebridge Crecdit Mangement yesterday regarding a payday loan that they say he owes their cleint. In the letter they state that they will carry on attempting to take payment from him using his card details.

 

Now my friend has never had any prior dealings with this company and until yesterday had never heard of them. He also cant be sure if hes heard of their client either so ive told him to do a request for a CCA and notice of asignment etc.

 

But my question is. Is it legal for a company to pass on your credit/debit card details to a DCA, and is it legal then for the DCA to take payment using those details without your consent being given to the DCA to take such payments?

I thought it was illegal to do so, but thought id ask here first before giving him any advise on how to respond to them stating they would do that.

 

are there clients also liable or acted illegally by passing on such details to the DCA if so what law have they broke? and what shall i tell my friend to write in a letter in response to that. because if they have broke the law passing on those details, then am sure my friend would like to stick it to them

I would point out that I have never had any such dealings with this company in the past.

 

On a more general note, what concerns me is that you state that you will be passing card details on to another company, as I understand it this is against the law.

 

I am fully familiar with the Office of Fair Trading Debt Collection Guidance which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable.

 

What I require:

 

I would kindly ask what information you hold on me that made you contact me in the first place, and where you acquired my information from.

 

What steps are in place to ensure this does not happen to me again.

 

Confirmation in writing that I do not owe you or any client you represent this amount of money.

 

Confirmation that you have not placed any adverse data on my credit files.

 

A written apology for this mistake which led me to a state of panic.

 

As an OFT Licence Holder, you must have in place an official complaints procedure, I now require this within 14 days, if this is not forthcoming, I will report your actions to the Office Of Fair Trading.

 

I look forward to your reply.
