I owe approx £35,000 to various creditors. I am unable to work now and living on Incapacity Benefit and Income Support.

I have been to CAB last year. They advised me to go bankrupt when I could afford the fee, and in the meantime to offer nominal payments of £1.00 per month.

I was due to make a payment to Apex on 24/07/09 but could not do so as my money did not go into bank.

I had a telephone call from Apex and the lady informed me that they would take me to court and attach my benefits. I know they cannot do this and told her so.

Since then I have paid nothing and told them, by telephone, that I will not make any payment to them until they withdraw their illegal threat to attach my benefit and instruct their reps in the law.

They told me they would not do this.

I emailed them today and requested a letter withdrawing their illegal threats.

I am now waiting for them to take me to court.

I know that Halifax debt is probably all bank charges but they will charge me to get copies of statements and I have no money. I have sent email to Apex re stopping phone calls (letter from here) and will do so to other companies.

It will take thousands of years to clear debts at £1.00 per month. Will go bankrupt when I can. Thank you for your replies. Will post update soon as I get reply.

You can send a SAR to Halifax, it costs £10 and they have to send all the data they hold about you regarding any & all a/cs you hold with them, and that includes agreements & statements. http://www.consumerforums.com/resources/templates-library/86-debt-collectors/576-subject-access-request-debt-a-dca

If you're on benefits, £1 per month is too much to offer - make it 1p.
