Hi All, Some help please if at all possible.

 

I received my SAR from Lowell via three, this morning and unfortunately it shows all calls made to and from the mobile account. I understand there may be a termination fee set by three on this occasion £518.15, as well as the charges of telephone and related services with three equalling a grand total of £787.52. I receive ESA of £64.30 per week and they have gave me 7 days to pay up or expect further action.

 

How much can I offer them, do I have to pay them the full £787.52 in one go, not a possibility in any event or can I offer them just £5 per month until cleared. Any help would be grateful and a link to a template letter would be appreciated as well.

 

PLEASE, PLEASE HELP.:(

I guess this means you are a student? Do you accept that the call and other charges are correct?

 

If so then I presume that you are in a binding Contract and will have to make arrangements to pay.

 

They will argue with you all the way, and the only thing, in my opinion, that you can do is to be completely frank with them and offer them the £5 per month. It is unlikely they will accept, but you will need to be firm and stick to your guns.

 

Do not set up a Direct Debit as it is not unknown for these types of companies to take more than they are entitled to, better a standing order, or, as a last resort Postal Order. If that is the case I would suggest sending each one Recorded and very much on time.

if you do not despute the debt, write to them and TELL THEM as you are on sickness benefit you will give them £1 a month untill you are fit enought to return to work and start earning again.

 

You may have to keep telling them and even write in big letters to get them to understand (these people are of low intelegence so one must make allowances), but they will get the message eventually. I know this as i am in a similar position. They won't admit it but they know if it goes to court they will get no more, and they'll have to front the court costs even if they can claim against you.

I agree with Mr Ton. If you are on benefits the court can only order a maximum of around 5(?) quid a week, whereas that would never be enough for Lowell, it wouldn't cover the cost of collection. They will hound you constantly for more and more and they only paid pennies for the debt anyway. Why get roped in in the first place??

 

If you are in receipt of any invalidity/disability benefits these are usually exempted and can sometimes help toward getting a debt struck out by a court.

 

For some people court, is a far better option than getting embroiled in a pointless game of letter ping-pong with you leaving a paper trail of your own - why not take up their offer, stick to your guns, and wait and see if they will risk the court application fee?? You have nothing to lose but your chains.........;)
