    • Hi friends,  I’m a bit worried I may have got confused with timings here. I thought I had 33 days from my acknowledgment to submit a defence but the date added above says 3/6/24.   have I missed the date?   if so how can I apply for an exception due to my disability and problems with deadlines and dates etc (ADHD)?   what should I submit as a defence?   I’ve had no reply from BW so far    just been back on MCOL and it says 28 days from service if I completed an acknowledgment of service so does that mean 28 days from that of acknowledgement (I.e. 16/5) which would make deadline for defence 14/6?   Thanks! Panicking here.
    • Normally we don't advise playing your cards early in a snotty letter, but as you have appealed we might as well use what you wrote in the appeal against them. There is no rush, you have until 6 July to get it to them.  See what the other regulars think too. How about something like this? -   Dear Rachael & Sean, cheers for your Letter of Claim.  I rolled around on the floor in laughter at the idea you'd actually thought I'd take such tripe seriously and would cough up! As usual you'll have been too bone idle to do any due diligence.  Had you done so you would have seen that I appealed to your client.  Indeed the driver on the day is a textbook example of having done exactly what you should do when you do not wish to be bound by the T&Cs in a private car park. Of course none of that mattered to the spivs you represent but do you really want to put such a useless case in front of a judge?     • Laura, I was surprised that the Director said that you hadn't appealed twice. I thought that the letter you posted on 24th June was the second appeal and that was to the IAS. And they did say that there was no further appeal possible. Could you please explain how many times you appealed. I am going to read your WS now. PS  Yes I meant to say that the keeper did not have a licence therefore it was wrong of them to assume he was the driver and the keeper. Thanks for picking that up.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

This is my first thread although I am quite far on my claim of £650

Advice is now needed as I have received an offer for 3/4 of the full amount, £430 :confused: . I'm very tempted to accept this offer, although I think I can get the rest of it.. do I need to respond to this offer? or just start my money claim now?

Hi, Read FAQ section and accept offer of interim payment but inform them that you will be persueing them through the courts for the rest. Try and read other threads and that should give you guidance. (hit the scales if you think that this advice is useful):)

Hi everyone :)

 

I am a little confiused, I sent my LBA last Friday 28th July, on monday I got an offer of £430 but this was in response to my prelim letter dated 4th July. Today I have recived another letter in response to my LBA saying that they will look into my claim and get back to me b4 25th August this one has a different reference on it?. I am due to write to Barclays on Monday telling them that I will accept the £430 as a part payment and pursue them through the County Court for the balance, but today when I have looked at my online banking they have charged me another £30 for being £6.50 over my overdraft:mad: Can I now add this to my claim along with intrest.

 

Again can anyone help me please.:idea:

Hi

 

I sent Barclays a letter yesterday giving them 7 days to pay up in full before I submit a moneyclaim online. Just waiting now till Monday 14th August when I will do that as it looks like you have to go down that road with Barclays to be in with any chance of getting your full claim back!

 

Will keep you all posted as to where I am up to.:)

OMG I have just submitted my moneyclaim online :o I Just hope that It all goes well and I get my money back soon I go on Holiday in 7 weeks and it will come in very handy!

Hi

 

My MCOL was isued to barclays yesterday, and today I feel very anxious. I read the updated threads everyday and can't seem to see any that have settled or at what stage they settle. Can you please point me in the right direction or give me some encouragement. I really want My money back.

 

My original claim was for £680

Now Added 8% intrest of £162.08

Plus Court Fees £80.00

Total £922.08

The 28 days starts from when the claim was served on the defendant. I think the Court assumes 2 days after they sent out the papers to Barclays. This is probably one day after you got your notification in the post - making it the 18th August.

You need to go to MoneyClaim around the 14/15th Sept and see if you can file for Judgement by Default, if Barclays have not submitted their defence in time. They seem pretty good, however, at getting in their defence at the last possible moment, thus causing you maximimum delay in getting your money.

Hi Shewolf

 

It looks like you are few days behind me. Barclays had until 17th Sept to submitt their defense which was a sunday. I called the MCOL helpdesk yesterday to see if I could file for judgment by default and they told me that I had to wait untill this morning. Still no defense so I have just filed for judgement. As to whether you should submitt another claim sorry i'm not 100% sure but I can't see why not!

If Moneyclaim has allowed you to go for 'Judgement by Default' that is really good. However, it has been known for this to fail and Moneyclaim accept Barclays late defence. Keep on trying and checking. If it really works you can then serve a warrant (costs £55) and bailiffs will go in if Barclays don't pay up quickly.

 

My advice is to not talk to Barclays, do everything by recorded delivery letters.

***Bailiffs Going In**** :D

 

Hi

 

Just a quick update, I have just checked MCOL and Judgment has been issued. I have now also issued a warrent - so I think that that means that the Bailiffs are going in and Barclays will now have to pay me a further £55!:D . Not too sure what I should do now though - do I just sit back and wait for the money? or do I need to contact someone?

Good stuff.

I suggest you call the courts this morning to see if they have heard anything and ask then what your next move is.

You have no obligations to contact the defendants......this is up to you.

Just a quick update. I have just called MCOL to find out if I need to do anything since I issued a warrent yesterday, they told me that the Warrent goes on request first and it takes 48 hours to be authorised - which takes us to Monday. Once authorised it is passed to a local bailiff and depending on their case load depends when they will go in and get me my £977.80 back in full!

 

It would be brill if this is sorted before next Friday as I go on holiday to New York on the Saturday and the extra spend will ensure that I have an even better time:D

Think you might be being just a little hopeful there of having your money by next weekend. See the thread Closey v Woolwich, she was granted judgment by default quite a few weeks ago and I don't think she has received her money yet. In saying that it shouldn't be too much longer for you now, you really appear to be on the home straight.
