Hi all,im a newbie on here,8-)

my problem is i have an agreement with mnba to pay xx amount by dd.

now i am finding it hard to keep this up i have been paying it for 2 years so im not running away from the debt,

but i need to lower my payments but mbna are refusing to accept the x amount i have offered to pay a month.

could someone tell me can i change the agreement,this was done on the phone like i said 2 years ago,

so should i cancel the dd and send another letter to there c/s dept and wait for there reply.

ps hope im on the right forum.:wink:

Hi Rover66,

Can you give more details, ie was the account (presumably credit card?) defaulted hence the monthly payment plan?

Have you requested a copy of your original credit agreement?

If you're on a voluntary payment plan you should only pay them what you can afford. It's up to you not them to decide. Also, have you considered reclaiming back any unfair charges?

Someone more knowledgeable than I will be along to advise too, but welcome-you've definitely come to the right place for help :)

Hi thanks for reply yep had a cca enforceable :(

had charges refunded and got behind with payments,due to illness,i did a budget plan and they said right you have xx amount spare so will accept that,so they did railroad me into the amount,as i did offer one amount and they refused,so i thought i was under an oblihgation to fill it out and pay what they deemed fit,mind you i was clueless at the time,the internet is a good tool.:D

Love the internet! And I have to say I'd be lost without this site!

My personal view would be: No more phone calls - they'll say anything to browbeat you, so keep everything in writing from now on. If they start pestering on the phone send them the telephone harrassment letter in the templates library.

Write and tell them that due to your financial situation from now on you are only able to pay £x a month. Important: Change your direct debit to a standing order (that way YOU call the shots) and start paying your chosen amount.

They have no right to demand your Income & Expenses,only a court can do that. Point out to them that if the matter was to go to Court they would be granted far less a month than you are offering.

Any other more expert opinions welcomed,but that's what I'd do if it was me :)

I would second that advice. Do not talk to them on the phone. My experience was that they will bully and harras you and in my experience lie to you to get what they want.

Thanks to both of you for the replies,i will cancel the dd now and send off a letter will also send the telephone letter as they have my works number,and i dont want the hassel of having to explain to all and sundry why im getting these phone calls.

Hi Rover,

 

Any chance you could scan your MBNA agreement up so that we can all see what it looks like? MBNA agreements are very often not enforceable for one reason or another.
