    • Replying to above  this was on the day that two store detectives approached me and my friend and took us into the back room and spoke to us when they explained they have been watching
    • as my learned friend above...and.. sadly because just like DCA's and initially yourself in this case, you believed they have some magical powers ...they DON'T. 85% of people blindly pay DCA's cause they know no better and think they are BAILIFFS. only the RETAILER can ever do court and none have done this on a silly member of joe public that did something stupid since the infamous 2012 Oxford case on retail loss. BAILIFFS can only ever be involved after you've been to court and lost a CCJ, fat chance re above... and anyway, no BAILIFF has any right of forced entry anyway on consumer debts even with a judgement so......... stop panicking and thinking everything that doesn't apply.. forget about them but p'haps a confidential GP visit might be a very good move... what slightly concerns me more here is:  who are 'them' that told you they'd reviewed a week of CCTV and come up with several shoplifting instances over that time amounting to the above? have you directly contacted or had contact from Sainsbury's? and know they HAVE done this? or is this DWF willy waving and they tricked you into  admitting several previous successful thefts... this is not the norm...  dx      
    • next step then await the N157 from her local court giving the time and date of a future hearing some month in the future. now she MUST file a witness statement 14 days (typically) to both the court and kearns .  so cant allow to much of a time lag before you are aware of that and get her WS done. wack us up 2 multipage pdf files please  one of what they returned for the CRP reply . and one for everything they sent back in 2022 you've found.  we do not need statements. ideally it would be nice to see their WS before hers is finally filed. dx

    • DWF can't do anything as they act for a client. In this case, Sainsbury's. Sainsbury's could take you to court and ATTEMPT to get a CCJ but it's unlikely. They had no interest in dealing with you at the time. All DWF can do is send out pointless threatograms. They'll threaten to divert an Iranian drone to your house if you don't pay. However, they can't attempt to get a CCJ against you. IGNORE THEM. It's more important now to understand why you were allegedly shoplifting, and you should speak with your GP and try and get yourself signposted to the support that's available.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Use this form to complain about Baliffs.

Simply fill it in and send it into the County Court.......its there to be used and theres no charge !!

Martin - thank you for this -I have asked at my local county court about procedures for complaining to the court re certificated bailiffs and have not got very far. This will be very useful. Incidentally I was also thinking about an application to the county court for a taxation hearing for excessive (and I think illegal costs in relation to council tax -the bailiff has added £350 in van fees but does not have a levy). Any advice on this?

Yes of course Ellie there is a list of things.

This is quite a new form the courts have introduced I think only since last month.

I advise taking a copy of it once you have filled it in and send to your court Manager.

The fact that this is a logged complaint would be to your advantage if you seek further redress later/or are not satisfied.

As for your other points.

May I suggest you ask Zooman this he is active in this section and is online right now.

Baliff fees are regulated and they are required by law to issue you with a breakdown of them.

 

There are a number of things you can do.

My advice on that issue would be to read the thread by chrismc titled philips baliffs........he has challenged van fees and has been offered a refund !!

Thanks - I have read the the thread - but I would still prefer to go for a taxation hearing rather than a counter claim - as this would help in setting a precedent even if the case was unreported - the problem I have is that when I challenge fees on individual cases the bailiff company capitulates - but always says something along the lines of "we are entitled to charge these fees but as a gesture of goodwill etc etc".I would like a more persuasive decision that would apply in general which could be used for similar cases as a legal precedent. A decision from a District Judge would be helpful I think.

Ellie I know where you are coming from and I commend you.

 

I must say as I feel I would be failing you if I did not, that before you commence hearings you must give then a chance to correct matters. And I would also suggest that you inform them of your intentions to start proceedings from the outset. Also I must remind you that to avoid paying costs you must get a reduction by the courts of at least 20% to avoid costs.

Thank you Zooman - I will ensure that impatience/frustration does not get the better of me - and will give the company opportunity to respond first and go though complaints procedures etc etc...thanks very much also for the advice about costs I was not aware of that - incidentally is that figure a rule of thumb or set down in statute/statutory instrument somewhere??

Any costs awarded are at the discretion of the District Judge so it doesn't automatically follow that you will be ordered to pay costs if you don't succeed in persuading the DJ to reduce the fees by 20% + although of course there is a risk.

 

I would also say that if you are simply challenging the fees on grounds of reasonableness of the amount charged, then you must go down the taxation (now called detailed assessment) route rather than the money claim.

 

However, if you are challenging the fees from the point of view of being charged for e.g. visits that were not made or letters not sent, you will be asking the Court to make findings of fact so the small claim procedure would be the way to go for that.

Thank you - the situation is this: the bailiff has charged fees for two van visits - the first at £350 and the second at £280. There are also other costs - a "redemption fee" which always seems to be added and charges for payments by credit cards. The bailiff is collecting for unpaid council tax and does not have a levy. From your reply I gather that a taxation hearing is inappropriate as what is in question is the legal right to charge the van fees? If there was a levy and I wanted to claim that the van costs were excessive then I could go for a detailed assessment. Have I got that right? Thanks for you help.

Does anyone have any info regards bailiffs knocking on neighbours doors asking who lives in my house and when was the last time we were seen. Then they gave the documents to my daughter and told her everything that was in it!!! Aren't there cofidentiality laws against this?

I too am wondering if I have cause for complaint. Having paid the arrears of my Council Tax bill in full, the court certified bailiff (from Ross and Roberts) decided to come round to my property to drop off a receipt. However, having done so he proceeded to knock on my next door neighbours door and ask how long I'd lived there; that he was a court bailiff and that we'd owed £x amount.

 

Surely I'm entitled to some privacy? especially since the outstanding amount had been paid in full. Please can anyone advise if it would be worth pursuing a complaint against him?

i would assume the DPA would come into fource and they should not have been discussing anything with ur neighbours.
