  1. I am hugely confused.com and would love someone to help - I did the whole bank claim on A&L and had my case put on hold as did we all. It was suggested to me ages ago that I may count as a hardship case, so I wrote to A&L and said I intended to claim on the grounds of hardship and they wrote back saying that as I didn't bank with them any more and therefore would not be incurring further charges from them I was not a hardship case. Can someone explain to me if this is correct?
  2. I did call and a man answered but didn't say the company name so I bottled it! I should imagine its a debt tracing [problem]

I got a postcard in the post today from UK Forwarding at Clayton House, 59 Piccadilly Manchester M1 2AQ it is a pre printed postcard saying we should contact 0161 975 6202 with a handwritten bit saying to ask for Alan quoting a delivery reference number. The card only has our address on it not our name. I am not expecting a delivery and think this may be a debt collectors - has anyone else had a card like this?
  4. I would be grateful if anyone could help me, I had £195 outstanding on my counil tax bill from a previous address. When they caught up with me I explained that I could not afford to pay it in one and arranged to repay them at £10 a week. The problem was then that I had to travel to a different town to pay it as I had moved away. This was costing me £10 a week. I requested a payment card and paid two weeks to allow for it to reach me, when it failed to arrive, I travelled back and requested it again. The third time I had to go there, they told me I did not exist on their computer system and there was no debt, then a senior member of staff found me and took my money. I explained that I could no longer afford to travel to make payments and needed the payment card immediately. That was in November of last year. I heard no more from them. Now I have had a bailiff visit with added charges. I have just been back to the council and told them why I hadn't paid and that I requested a card three times but they said it was no longer in their hands and couldn't help me. Do I have a leg to stand on complaints wise? To whom should I complain if so?
  5. Ok, I now have the payment receipt he left behind, I also got my facts slightly wrong, still think this situation is wrong though! He arrived and told her all about my debt which was £343.10 but ended up telling her that if she gave him £200 he would write off the rest of the debt. She felt she had to give him the money so he would go away and handed him her card. The receipt he has left behind says he is from Marston Group Ltd, he has written my name down incorrectly and where it says 'Debtors Address' he has put my mother in laws address in. I stress I do and did not ever live there. He has then written down the PCN number and the fee of 343.10 added on £1 for card handling, taken £201 and then under balance due written 'force completed'. He has written 'Card Payment by Phone' even though it was on her doorstep and not bothered to get her to sign the '3rd party form signed'
  6. The address on the warrant is not my mother in laws, it is an address I left in 2007 at about the time the pcn was incurred apparently. I have since found out that the bailiff came from Marston Group Ltd, he did scare my MIL into paying £200 of my bill and left nothing but a piece of paper with a reference number on it.
  7. We have no idea how they got her address having never lived or registered any cars to her address. Apparently he left a receipt and a reference number to call the council and they would talk us through paying the outstanding £144. We didn't want to call until we knew for sure he had behaved incorrectly. I will try to message tomtubby and ask him to look at this thread - thank you.

  9. A bailiff arrived at my mother in laws house today looking for me in relation to an alleged parking ticket received (not by me) in 2007. He told her it was £344 and he needed to have a payment before he would leave. She stupidly paid him £200 and he left details for how to contact the council and arrange payment for the rest of the debt. My car has never been registered at her address and we left the town she lives in (and where the ticket was issued) at the end of 2007 and we knew nothing about the ticket. Is a bailiff allowed to break the Data Protection Act by disclosing all my details to my mother in law? Should he be collecting money against my debt from a pensioner who felt threatened?

Exactly the same as you do an open account - they closed my account on me in 2005, started my claim in 2007, I had my case stayed last year and have just recently applied for them to reconsider on the grounds of hardship. They wrote back saying they acknowledge I do qualify for hardship rules but they still don't intend on paying out until the test case conclusion. Good luck I hope you get further than me!
  11. Ok, how do I do that? I also need to change the POC as apparently when it went to court Wragge pointed out I had filed the court papers in my name but the account was in both my name and my husbands ( I filed it in my name because there is nowhere to put two names on the online court claim form) and I also need to change the address as we have moved, do you know the form number for that? I am sorry to be a pain!
  12. Can someone help me please? I started a case against A&L ages ago to reclaim over £6000 in bank charges on an account which they closed on us in November 2005, it got to court last year and was stayed pending the Test Case. We have recently hit very hard times as we all have and I decided to persue my case on grounds of financial hardship, I filled out all the spreadsheets and today got this response: 'our records confirm that account facilities were withdrawn in November 2005 and no fees have been applied to the account since that time. Whilst we acknowledge your current hardship and that your reasons for requesting a refund of fees appllied to your account in the past are reasonable, we hope you will understand that we are unable to consider matters further until the outcome of the test court case is known' So they acknowledge we are a hardship case but refuse to do anything about it. Is there anything I can do?
  13. I too am wondering if I have cause for complaint. Having paid the arrears of my Council Tax bill in full, the court certified bailiff (from Ross and Roberts) decided to come round to my property to drop off a receipt. However, having done so he proceeded to knock on my next door neighbours door and ask how long I'd lived there; that he was a court bailiff and that we'd owed £x amount. Surely I'm entitled to some privacy? especially since the outstanding amount had been paid in full. Please can anyone advise if it would be worth pursuing a complaint against him?
