Just received letter from HBOS " thank you for recent request for access to personal information held about your records ,in order for us to continue we urgently need you to contact us . please note HBOS plc is not obliged to supply records held in paper format as they do not form part of a relevant filing system , further details about the data protection act and your rights under the act are available on information comissioners web site, how should i proceed from here? telephone them or is there a further letter to send thanks

I'd be extremely surprised if HBOS's paper records are not a 'relevant filing system'. Could a bank really use a filing system that is neither indexed nor referenced?

 

ICO says:

 

The files which form part of the relevant filing system are structured or referenced in such a way that information about the applicant can be easily located. Where manual files fall within the definition of a relevant filing system, the content will either be sub-divided, which allows the searcher to go straight to the correct category and retrieve the information requested without a manual search, or will be indexed to allow the searcher to go directly to a relevant page(s).

 

HBOS's letter sounds like it's just an attempt to get you to contact them. I'd suggest writing back making clear that you have made a valid SAR, and expect HBOS to comply fully and properly within 40 days from the date they signed for your request, and that any issues they have should be raised in writing.

and possibly to ask what these possible documents that are not stored in a relevant filing system are?

This sounds like Shabby Abbey's excuse 2 years ago for not supplying statements as part of a Subject Access request. They knew you wanted them to reclaim their unlawful and immoral charges.

HBOS sound like their doing the same, as they also have something to hide, they know you'll use against them. ;)

 

A few quick words with the FOS and the Information Commisioner will confirm that computer and microfiche stored records are a realavent filiing system, as they have to be kept by law for 6 years for tax/anti money laundering reasons.

 

If it wasn't for us tax payers, HBOS wouldn't exist now. So the very least they can do, is provide copies of documents people are legally entitled to see.

I agree with the previous posters. Did you use the SARN template from this site?
