GUS fail to send CCA agreement advice please.

hi guys, I requested a cca copy from my catalogue and they have now posted me a letter saying ' Unfortunately we are unable to locate a copy of an executed agreement, but for your information we enclose a copy of the current agreement which applied to this type of account. this version includes all contractual variations which have taken place.' they only state when I roughly opened an account with them on this same page and a seperate page of their agreement terms which doesn't have my or their signature or any date on. Is this unenforceable?

NO...., no agreement then it will be unenforceable.....if they pass the debt on to a debt collection agency, please let us know....may I ask how old the account is ? If they do decide on legal action, they will hope you won't defend....

Its been found that many Catalogue firms are unable to provide CCA documentation.

What periods does it relate to?

Has it been defaulted,and are there any DCAs involved ?

Studio sent me a CCA to sign and send back (like I'd fall for that trick)

 

Copy the letter I sent back to them and change to match your details and circumstances and send it back recorded delivery. No signed CCA, no debt.

 

I used to work in mail order, they are fully aware that any fees are non enforceable. I used to work with a company called Greetings Direct (mail order cards) and the call centre were advised that should anyone query the admin fees for late payment they should take the outstanding amount and write off the admin fee as a goodwill gesture, at no point were they to state that the admin fee was a legally enforceable debt.

 

Didn't help that there was a massive bug in the system that meant no one actually knew what had been paid and what hadn't, we had accounts showing debt of thousands of pounds for a £15 pack of cards.
