    • A) Bollards, or B) county court action for trespass onto your private land, or C) retain one of the private parking firms, ensuring that they'll offer to take payment for the private parking space(s) on your land. (What you don't want is for them to put up signs saying "no parking" ... as then there can't be a contract to park to be broken .... read up on the parking threads to see what can be used to get out of such a private parking charge....) The PPC offers parking, with the proviso that a) they pay, and b) they provide contact numbers for the cars to be moved when needed. Make the payment required sufficient that it isn't attractive to them to chose to park there (& pay)....... Bollards may not be the cheapest option, but it will likely be the simplest / most effective.

    • The garages are used - just car currently being fixed.  I have no need of what they offer.  It is conscious trespass - and the law allows. Which is frustrating.  It's just v annoying that they do this. Isn't there a law that someone cannot prevent access to a public highway from private land?
    • The problem with sending it too early is that Jake might try to write something called a Supplemental Witness Statement to undermine yours.  It would be better to send yours right on the court's deadline. The problem is that we don't know when that is.  In 90% of cases it's 14 days before the court's deadline, so 21/06.  However, in the odd case the judge decides differently.  
    • Signs and notes on windscreens wouldn't deter me either. after all. it's private land and very little deterrent to stop drivers from abusing it. A physical barrier, IMHO is the only way you will stop them abusing it.....or, depending on what businesses they are, why not rent out your garage to them, ask them for a staff discount if you purchase anything from them? Whilst it is irksome, how much money have you got to throw at it, and is it really that important in your life? If you were using your garage, different story.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

Halifax decided that although i was paying without fail for one year on an interest free basis that they would now charge stupid interest, which basically i cannot afford now.

I sent a CCA and i got the following back after the 12 plus 2 days limit.

Could somebody take a look to see if this is enforcable ? 2 pages stapled together..............

Hi a cager on here called wilko999 was taken to court over this CCA and lost his was printed on the reverse tho like most of ours are ,,i did send for mine twice the 2nd time the reverse did come on a different sheet of paper ...mmmm I think wilko is the only one that i know of that has been to court..alot of the others have been sold on ..mine is still with the halifax ,,but if it ever does go to court i do have a invalid DN ,,i havent payed halifax for a yr..i think if they did have any ace cards up their sleeves why havent they used them yet :)

Hmm, it has the prescribed terms but can you determine whether picture two was originally on the back of picture one when you signed it? It's hard to say, maybe there is stuff which didn't show up in your scanner, like fold marks the photocopier picked up, or can you see reverse print on image 2 etc.? Does it look like a photocopy of a photocopy, ie they have destroyed the original and kept a copy, or a scanned image?

Good point lunar...

 

roadsteruk...my default notice was in jan 2008..was only giving 7 days to pay ..they didnt allow for postage so i only had 6 days to pay...the 7 days changed to 14 days..so either way its invalid:)..i have no assets either and live in rent accom,,haliprats can pick the bones outta that if they wish :p

Hi Yes good point ! actually i cannot tell but the shape and size of the terms are much smaller suggesting it could not have been printed A4 size on the back of the original? Also there is no connection between the two sheets , ie terms and conditions overleaf , or page numbers , nothing......

 

Can anybody remember when signing this sort of agreement if there was anything on the back ?

I can see a situation arising in court where the CC/DCA pulls out an original two sided document (application form on the front and the prescribed terms on the reverse), but the defendant has believed this to be two seperate documents (viewing their application form as an unenforceable agreement) and their defence is ruined because of this.

 

Surely there must be a way of forcing the CC company/DCA to declare the nature of the document, maybe under CPR pre-action protocol?

 

I'm in a similar situation with NatWest so I'd be interested in finding out how to take that forward!

Surely if these documents were front and back then wouldnt there have to be some sort of reference to say the perscribed terms are on the back..IE overleaf , PTO ,page numbers etc,,..and no road thats the trouble none of us can remember if we had anything on the back ..mine was in 2001 brain isnt has good as it use to be lol

Morning ....Its worth ago asking to view at local branch..But i think you may have along wait ...Kennyruss another Cagger did the same that was a few mths back and they have totally ignored his request...he has the same app/agree as me with terms on the reverse..if halifax were that confident why not just let him view it at the branch then if it enforcable then he could start paying them,,IMO as i have said before on other threads i havent payed them a penny for a yr ,,and if they thought they had ace cards up their sleeves why havent they used them yet,,:)
