I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Hi everyone:)

 

Well, surprise surprise - today I received a letter from Norton stating that they are in the process of arranging to settle my complaint in accordance with the FOS final decision!

 

They need my authority to allow them to discuss with Swift the details of the PPI and interest paid as well as any rebate received, so they have enclosed a form for me to sign. They estimate they will be in a position to forward settlement details in 6-8 weeks.

 

So far so good - I will return the signed form and see what develops from there, although I am sceptical as to whether Swift will -

 

a) be willing to assist as they have been as helpful as choccy sunglasses when it comes to reclaiming the unfair charges they applied to my account; and

 

b) be truthful in stating how much of a PPI rebate they gave at the time the account was settled early - i.e. I don't believe (from the paperwork I have) that any PPI rebate was received, yet I have visions of Swift telling porkies to Norton by saying my redemption figure included a PPI rebate.

 

Only time will tell ;)

Hi Landy, I hope you dont mind me hi-jacking, although I was hoping you could give me some advice, my husband and I were in a similar pickle to you back in around 2004 and we took out a second mortgage with them (I think it was around £20,000) - to cut a long story short we went through the same rigger marole as you and your OH and ended up in the Courts - we had to gather money together to stop our house being reppossed and eventually take out a mortgage to pay off our first and second mortgage to dig us out of a hole. I dont have any paperwork that I can find at all about the Swift mortgage but I am pretty certain that we took it out via Norton Finance - do you think it would be worth me sending a request or do you think it might be too late and untraceable? Would really appreciate your help

That's okay - hijack away (although if you don't already have a thread on this it would be a good idea to start one in order for you to get specific help suited to your own particular circumstances!).........

 

Sorry to hear that you have had problems with Swift/Norton also - there seem to be more and more people coming forward to tell their horror stories about their experiences with Swift.

 

Pompeyfaith is right, I would definitely recommend that you go ahead and send a SAR to both Swift and Norton. They should keep info on you (the data subject) for six years from when your relationship with them came to an end.

 

When did you get shot of Swift? If your second mortgage with them was taken out in 2004 and you had it for a while you should still be within that time-frame.

 

As the Office of Fair Trading (OFT) are building a comprehensive case against Swift and their activities it is worth copying all your correspondence to [email protected] and [email protected]

thanks guys - I heard an advert on the radio and thought hmmm thats interesting! I didnt start my own thread yet because of the little, well actually no information I have, wasnt sure if it would be worth it - my OH and I are just having a big argument over when exactly it was - the first thing I did when our relationship with them ended was destroy everything - just the sight of their name made me feel quite sick! they were so uncooperative and unhelpful! We know that we definately took out our new mortgage in February 2004 so it would have been then - would that be out of time as it goes over the six years?

 

I will start a thread now so Im not clogging up yours thanks again xxx

Maybe, maybe not never heard of a financial company yet that destroys documents bang on the 6 yrs.

 

I have been successful in getting documents as far back as 1996 before now.

 

As I say its is worth the £10 statutory search fee to see what the request throws up.

You're welcome! I'm sure you'll get plenty of help as you are not alone in having been ripped off by Swift/Norton :mad: I for one will pop over and take a look to see if there's anything I can suggest.

 

Can you remember how long roughly you were with Swift before you ditched them?

 

If you know for certain you took out the mortgage in Feb 2004 and you got to the point where they attempted repossession some months must have elapsed so hopefully you are still within the 6 years............as PF says, it's definitely worth a shot - nothing ventured etc etc!

The deadline that Norton quoted for getting back to me with settlement details has passed so I contacted the FOS to see if they could chase things up for me, but apparently Norton are blaming Swift for the delay..........they said that Swift are having problems providing them with the relevant info to calculate the refund due :(

 

Unfortunately despite this being a complaint which is legally binding, having been upheld by an ombudsman, the FOS say it isn't unreasonable for Norton to require longer to sort out the details of the settlement and there is nothing further they can do to assist at this time.

 

Looks like Norton/Swift are still trying to wriggle out of paying out on this one :mad:

 

Just wondering if anyone knows at what point (if any) I would be in a position to get the court to enforce this one please? I guess it would have to go the full 12 weeks at least that was originally quoted by the FOS?

Nope dont think so, proceedings can be issued at anytime, it would just be up to you to show that you have been reasonable and prove that they are not forth coming - would be an idea to produce a letter before action though I would have thought

Hi everyone!

 

Well today, 17 months after I first put in the request of a refund of mis-sold PPI on this account and over six months since it was upheld by an ombudsman at the FOS (after the broker refused to comply with the original adjudicator's decision) my refund cheque finally arrived :lol:

 

So success at last and hopefully some encouragement to those currently struggling to get their money refunded, particularly in the light of the judicial review.
