What was the date of your last payment? May 2021 Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? Yes at the time I communicated with all my creditor's that I was running out of funds to pay the original agreements once my redundancy money ran out that was when my accounts defaulted. I then wrote to all my creditor's with pro rata offers of payments but debt collectors took over the accounts.
    • Just an update for all. I received about a letter every other week, increasing in threat levels. Then I hadn't had one for a about two weeks, then Saturday received a carbon copy of the very first letter they sent me in February. Made me laugh, rinse and repeat. 
    • So, your response was not received by the SCP as you did not send it with a valid stamp. Therefore, from my two option in post #14, the first option is the only one available to you, but you do not have the option of asking to be sentenced at the fixed penalty level as the reason the SCP did not receive your response was down to you. Here's a reminder of what to do: Respond to the SJPN by pleading “Not Guilty” to both charges. In the “Reasons for pleading Not Guilty” box state that you are willing to plead guilty to the speeding charge providing, and only providing, the “Fail to Provide Driver's Details" (FtP) charge is dropped. This is a tried and tested method to deal with your problem and is almost always successful. Before the pandemic it was necessary to attend court to do this "deal" because it needs the agreement of the police prosecutor.. During the pandemic courts made every effort to have as few  people as possible attend and they began doing this deal under the "Single Justice" procedure without the defendant's attendance. Some courts have carried this procedure on whilst others have reverted to a personal attendance being necessary. If you are required to attend, your case will be taken out of the SJ procedure and you will be given a date for a hearing in the normal Magistrates' Court. If that is the way they do it in the area involved you will have to attend, see the prosecutor and offer your "deal" in person.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My medical was a month ago. Came home today, message on phone to call back about the results.......Doctor didn't fill out the results of my physical examination so I have to go back!!Grrrrrr! This saga just drags on and on!:mad:

OMG now I am a really worried man. Those questions are so leading. I could answer YES to half a dozen of them. I have been off the drink for 2 weeks and my medical is 3 weeks away so my blood should be fairly good but I wasn't expecting these questions. What if I just say no, do you think they will check with my GP anyway. My GGT is 65 but it was 137 last November. I have found most comments on this forum really useful and helpful and well done for copying the questions

Hey everyone.

Sorry iv not been on for ages iv been really busy over the xmas period. Well, I went for my medical on 22nd December, took apox 15 mins, they were very friendly and efficient, went in to see a nurse first, told me to fill out a questionnaire, asked me a few questions, the obvious, when I had my last drink, do i take drugs etc, and told me to wee in a cup, and took some blood.

Then she took me in to see the doctor, he had a feel around my abdomen, told me to touch my toes, lift one leg at a time, twist from side to side, raise one arm in the air at a time, quick eye test (read wall chart), pointed out a few answers in my questionnaire, again the obvious, last drink etc.

He said I was physically and by what he’d seen and id told him, i should receive the good news in a few weeks.

Anyway, about a week ago I received a letter from the DVLA, I was really worried because I was expecting my driving license, but when I read it, it said I had passed my medical, and they wanted a new photo for my photo card, as my old one was nearly ten years old, pheeew!!!. Yey!!, im soo happy.

Please for people who are worried about the medical, it might be a good idea to read some of my earlier posts, as iv said before, I am what most people would call a binge drinker, drinking quite a lot on the weekend, and maybe even a few in the week if im honist.

Please no nasty comments, because im telling you all this for to give people information and to try and help, but I have been known to dabble in cocaine just for recreational use with friends on the weekend, however , I didn’t mention this in my questionnaire, but I don’t think the blood test picked it up. (I have heard that cannabis does stay in the system for a long time though). But I don’t smoke.

My advise to you, is to quit drinking at least 3 weeks before the medical and take milk thistle 3 times a day, as this this seems to have worked for me, and I have been a bit of a binge drinker for over 10 years now. I must add though that I am a 27 year old, active (gym 3 times a week), fit healthy, man. So it may vary for women, age, fitness etc.

I do sympathise with some of the posts iv read on here with people having taken much more drastic action, quitting drinking for months maybe even all together and still not being able to pass, it doesn’t seem fair, maybe you should try and seek some legal action.

Anyway, thanks for all your posts over the last few months, they have been so much help, and I wish all of you the best of luck with any future medicals. Please try not to worry, but I no how hard it is, as I have lost many a nights sleep myself, its a nightmare.

Im getting quite worried now i had my medical on the 18th December and still havnt heard anything? DVLA sent me a letter last week saying i didnt fill my doctors details out correctly. So i had to fill it in again and send it off. So im thinkin they obviously are going to contact my doctor :s has this happend to anyone else? Also im supposed to be driving again on the 6th Feb.. its gettin close less then 2 weeks away now.. anyone have any suggestions? Thankyou :) x

I had to go through my medical again after only getting my licence back for 1 year after 18 month ban, this medical was in more detail checking my reflexes, steady hands, how fast responses questions was yes and no and asked exactly the time of your last drink and how much you drank now and also in the past, told them the truth was binge drinker in the past but now under control which I am, did stop drinking for 2 weeks and eating more veg and fruit. Now only drink and 2-3 times a week maybe a bottle of wine a time at the most. Was shocked got my licence back this week after 3 months to make there mind up and now got a full licence.

Also this medical I didnt have to pay for DVLA paid for it. So good luck to you all.

Hi. I have dreaded medical 26th Feb.. I had an alt test done privately at the cost of £100 last Sep. It came back U/L 17, the average being 20 apparently, so I was well within the normal range. However I'm a binge drinker maybe every 3 to 4 days. I get through a couple of bottles of red on average. I'm going to buy milk thistle and try and not drink at all.

Not too sure if I'll pass. I could even spend another £100 doing a private gamma test. Or get one done with my GP. Any advise? Thanks

I have just bought milk thistle in tablet form 185mg I think. Try a major chemist or a quality health store. Holland and Barrett. I'm not sure if the liquid is any better than the tablet form. May get into your system more quickly. Good luck. Let me know how you get on.

I dont know when test will be, as I just posted the D1 form to DVLA last week, they told me it could take a month at least before they write to me and then I have to book the Medical.

 

I was told to be careful of the MCV, as this can tell them if you have been drinking long term, i looked on the net and it takes up 120 days for MCV levels to lower, but I have not had a test done so dont know any of my levels.

 

Thanks for the advice on the Milk thistle I will buy some tomorrow, and best of luck in your Medical.:-)

Hey all.. Here is my full story for everyone elses help...

 

I was banned in summer 2006 after being an idiot, reading of 90. Banned for 24 months.

 

Sent off my application on 16th November 2009, received response on 5th December. Booked medical for 15th Jan.

 

I'm definitely not an alcoholic in any respect. I'm young and do a fair bit of weekend partying but during the week I don't have any alc at all. I was at university until last summer though and did a LOT of drinking. I'm interested to see if my liver is still showing signs of last year's antics.

 

Also I drank heavily (6-10 pints) almost every weekend since summer and didn't stop for the medical, so very interested in fact to see what happens.

 

Still haven't heard anything back as of yet (been 2 1/2 weeks).

Ooh also, my medical...

 

Arrived at 8:30am for 8:40 medical. Was made to wait until 9:30am and filled out the questionnaire. Eventually went into doctor's office. Doctor asked me if I was intoxicated at present, said no. Asked when I last consumed alcohol, said my last drink was around 2am Sunday morning. Asked how much I had on an average night out, said 6-10 pints. Asked how many times I drink per week, said Friday/Saturday, sometimes neither, sometimes both. Asked if I smoked, I said I had stopped month and a half ago, she said too early to put down so how many did I smoke, said 10 per day. Asked if my name was spelt correctly on 2 blood sample bottles. She looked at my chest, checked my heart, said ok. Asked me to put my hands out, hit my wrists with a little hammer, said ok. A nurse then came in and took my blood. No blood pressure was taken. I was then asked to lie on a bed and the nurse felt my stomach area, said everything was ok. I was then asked to take most of my clothing off until I had 1 layer on (cold day) and asked to go into the toilet and urinate in a cup (I assume the clothes was so I couldn't take some spare urine in). Gave the cup to the nurse and he took it into a room. I went back into the doctor's office and asked what the urine was tested for, she said "We're testing to see if its ok" (useful). Put clothes back on and the nurse came in and said "urine is clean". She then said everything was good so far and I would just have to wait for my blood results. She asked for £96. Then I left.

 

Note that there are a few things mentioned in other people's reports which I didnt do, I didnt forget anything this is literally everything that happened. No eye/blood tests!

It's a real pain you had to go back for this Lucy. Have you got your results back now?

 

I had my medical last Friday, the procedure sounds similar to everyone elses experience on here. I didn't drink for 4 weeks before this and took a liver tonic daily which has high levels of milk thistle amongst other ingredients supposed to benefit the liver.

 

I think i'll be ok as i had a private medical in October and all my liver enzyme levels were low. I also don't drink a great deal (12-16 units a week) but i still can't help worrying!

Well 2 weeks after returning to do the physical part of my medical I gat my full license through the post. No letter of confirmation of passing the medical or anything!

 

Very glad it is all over though, there is a lot of waiting on things, waiting and preparing for the medical, waiting for the results, waiting to drive! I have been driving on a temp license since Dec but apparently this is going to be stopped in the future.

 

Thanks for all the advice I have had on here it's been a real help. And also to come on and speak to people in the same position who don't judge:)

 

I hope everyone elses process goes smoothly and I shall keep popping on to see if I can offer advice to any1 else.

 

Oh and also one more thing. I know what we have all done is wrong but the dvla are a law unto themselves!

Lucy I'm really pleased for you - it feels so good when you get that Licence thru - mine runs out in 2046!!! Just got back on the road last Thursday so still trying to get to grips with it but its great. Just taking the kids to school is the best. I never thought I'd love the school run as much as I do now.

Anyway so pleased for you. And to all others who are waiting for your medical - just keep off the booze for a few weeks and you should be fine. Happy driving x

know what you mean about taKing the kids to school. I felt such a failure to them as I couldn't take them to any clubs after school and if he missed the school bus it took me about 2 hours to get him there even though it's only 4 miles away! (rural location no public transport!) I felt so good taking them out to meet their friends etc.

 

Was scary at first though as my first day back driving was ed city centre in the snow lol!

 

Definately learned my lesson though and also changed my drinking habits, I would always have a wee drink or 3 on a sat night but not bothered tonight so habits have changed.

 

Congrats to you also and hopefully many happy years ahead of you and everyone here, driving!

Pleased to hear your news Lucy. Still waiting to hear back about my medical but I'm still not drinking a drop until I get confirmation in writing just in case there are any problems and I need to go back for more tests.

 

I'm looking forward to driving my daughter to nursery again soon but it feels like such a long time since I've driven I can't imagine what it will feel like to being driving again.

How long have you not been driving for Chewie? I was 14months and I was a bit rusty but it soon comes back to you. When is your ban up? I was worried about the medical as I thought it would show up my years of being a binge drinker but it was fine, I went for a month without and likewise abstained while waiting for results, which all in all has taken nearly 2 months!

 

Really hope you get a good result, I;ll keep my fingers crossed for you (and everyone else!)

I'm so pleased to have found all this info! I've been searching for ages but not found anything useful and then found this thread!

I got banned December 08 and should get my license back this June. Unfortunately I have an all inclusive holiday in April this year which I booked not long after receiving my ban-to cheer myself up!! I'm thinking I might have to go and just drink soft drinks for 2 weeks!

I'm terrified I'll fail this medical! I guess I'm a classic binge drinker. I don't drink all week but will go out either Friday or Saturday and drink more than I should. To be honest I've not thought about the medical untill recently and now I'm wondering if I've left it too late to do anything to pass it? I did buy some Milk THistle tablets so I'll start taking that straight away. SHould I quit drinking altogether?! They guy that took my drink drive awareness course said not to quit but to stick to the limits-have eg one drink a day? To keep my alcohol levels 'normal' . I don't really want to have a drink every day though! But he said not to stop altogether as the medical will show that I've just stopped to pass the medical!!?!

If anyone can give me any advise I'd appreciate it! It's good to find people that have been through all this! My friends are great buy saying "don't worry-you will be fine" doesn't really help!!

HOw long before the ban is up do you have the medical?

Hi jess, the dvla write to you about 3 months before the end of your ban. You complete the d1 form and return it and shortly after that they'll send you details of a dvla registered doctor in your area who you'll need to make an appointment with.

 

With regards as to whether you should completely abstain or not I don't believe the dvla would look at you unfavourably for doing this as most people will want to pass the medical and won't want to risk driking for at least a few weeks before it. Also to show that your able to go long periods without drinking shows a degree of self control\willpower and should help to prove you're not dependant on alcohol.

 

I'm still waiting for my results though so could be completely wrong on this!

Im currently doing my 3 day drink drivers awareness course... and only just found out i have to do a medical!?!?!

anyway, im in the army and train 8 times a week

i dont drink during the week but will drink every fri and sat and maybe a few on a sun (fri 8 - 12 beers, sat the same sun 4 beers)

is that me ****ed for ages? will i have to wait months? i eat plenty of fruit and veg and lots of water, ill add milk thistle into my diet as of this weekend, whats the amout of time you recommend i stay off the ale before i book my appointment? and do GP's do the blood counts for free (and if so why do the DVLA insist on raping u out of more money?)

any help will be much appreciated

well i passed the medical and have now received my license back so very happy.

 

For those yet to take the medical follow the advice on this forum and you should pass. I guess a lot comes down to how much you drink and over how long a period so if in doubt maybe get a test done privately first.

 

Anyway good luck to all and i hope you're safely back on the road soon.

hi jspeno, well ive just completed my third day out of four on my drink driving course and my course speaker has instructed me to go 3months with NO drink before my medical if i wanted to guarantee passing.

Personally i dont have a drink problem and usually drink once during the week(2-3beers) and on fri-sat night ( maybe bottle wine and few pints) pretty average id say, ive been doing this about 8months now, before i used to drink a bit more but nothing over the top.

The medical people are suppose to contact you about 6weeks before you get license back so if you minus 6weeks from the date you get your license back, then 3months, you apparently will pass everytime, a pain in the **** i know but worth it in the end.:)

As long as you havnt had serious alcohol abuse in the past and you stick to what i said above, this(i have been instructed)WILL pass you.:D

I understand people have given up for much less time than 3months and still passed but you can never be sure???

Everyones liver is different at how quick it metabolises and i think you may be playing with fire if you keep drinking so i wouldnt chance it, whats three months when you can drink for a lifetime there after.?..............
