    • thread title updated moved to overseas debt forum. sadly as they are outside any UK jurisdiction upon DCA rules which state in the UK they must not call employers, there not alot you can do to stop these scammers. make sure you totally make private ALL social media twitter/facebook/linked in etc etc as there no-way for them to findout where you work otherwise so you must have a leak somewhere. find it. your employer details arent even legally available to UK DCA's so how have they found it out to date???  simply write to the BANK informing them of your correct and current address ALWAYS!!. if you want to arrange payment or not TO THE BANK ONLY thats upto you. never ever ignore a Statutory Demand a Letter Of Claim a Court Claimform. if if if any of those ever happen. till then ignore and rewash. dx

    • Hello All,  I’m hoping someone can help me urgently here. Firstly, I’d like to say I have read multiple other threads and have some what an idea of what I should be doing, however my case might be slightly different so coming with my own questions here.    my situation is I lived in Dubai and had a credit card and a loan, loan with HSBC and credit card with Emirates (or the other way round), I lost my job and was forced to leave the country as I was staying in the country on my companies visa.    since coming back, after a few years 2 different debt collections agencies have been approaching me (one being IDRW and the other J&P). I’ve never answered IDRWW and they constantly chase me by calling and messaging me and my employer. My current company is ok with this as I explained the situation but I’m soon to be joining a new company who definitely won’t be ok with being messaged and called. I’m afraid to continue to ignore them as they may message and calm the new employer as they have before and I’ll lose my job. However, it seems clear from these forums that dealing with the debt collection agencies is never a good idea. You shouldn’t agree to the amount or pay anything.    j&p caught me on my phone but I still haven't sent them any money or confirmed the amount they’re saying is owed, they keep pushing to pay off the “principal” amount by making monthly payments, from reading these forums it seems like if I make one of those payments (they have provided bank details for ENBD), then it’ll just be paying off interest and not actually clearing the principle debt and the bank won’t even approve receipt of payment or that it’s coming off principle.    this is my predicament as ignoring them might not be an option if they chase my new employer. Maybe there’s a way to ensure the debt collection agency don’t contact my new employer?? I don’t know? Massively appreciate peoples help here. Thanks,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

I have just recently got my licence back after being banned for 15 months, which got knocked down to a year after taking the drink driving course.

 

I was at t in the park exactly a month before the medical which involved 3 solid days of drinking, then i was in manchester for the amir khan fight a week later which i was pretty drunk for.

 

so for the next 3 weeks i stopped drinking, except for 2 tins of beer on one sat night and then a couple pints the week after. the weekend before my medical i didn't touch a single drop.

 

Also i took milk thistle for around a month straight leading up to the medical.

 

DVLA received my medical results and within a couple weeks my licence was back out to me.

 

 

Just thought i would let people know that are wondering how much heavy drinking affects the medical.

 

 

For the record i was done with drink driving for 'the morning after' so im no an idiot or an alcohlic that thinks its fine to jump in a car when you've had a good few. im 22 so i enjoy a drink with my friends!

I phoned DVLA to try and get my test results and they gave me an email address to send a request to but it ended up being a dud address so i still haven't called them back to ask again....so not sure what the liver function test would have been like if they even tell you.

 

As for milk thistle you can buy this from tesco, semi-chem, superdrug etc

i did my medical yesterday 28/10/2009 worried sick as hell i wont pass i tryied quiting for 4 months inbetween the 4 months i had a small aftershock bottle coz 2 suprise tickets come up for the united vs arsenal match aug 29 do you think ill pass my medical coz i got little baby girl and every saturday i have to catch a taxi just to go to town and it killing me wud be nice for some advice tahnk you

Alright mate,

 

If you haven't drank since august the 29th which is nearly 2 months ago i would say you will be fine! If you read my post and consider that i have drank every weekend since i was 16 probably and i passed considering the above details then you should be fine.

 

By drinkin every weekend im just ur usual goin out with ur mates and having a laugh drinker. don't drink excessively durin the week or that.

 

Also im sure i drank a h ell of a lot more over the 3 day course at titp and 4 days later being really drunk again in manchester...and i still passed by staying clean of drink for the next 3 weeks.

nick mattew if you dont mind me asking nick wat were your drinking habbits like coz i used to drink like a a half of hennsey every day for about 4 months i just worried because i got a little baby girl depending on the decsion off the dvla had my medical on 28/10/09 am im worried sick time is not passing at the moment and just brought a car aswell with cost £4500 so i dont wana fail thank for your advice mate

When i lost my licence i drank more, probably every friday saturday goin out in the town and ending up really drunk. then hitting the pub on a sunday from around 2-3 and drinking till 12 then going home. You would think getting done for drink driving would deter you from drinkin but it just gives you nothing to do as it takes your freedom...then out of sheer boredom and realisation you can't go anywhere and do things you want to do you end up drinking with your mates.

 

back to my drinkin habits in my post a few above you can see how much i drank the month before so if you have done better than me you should pass. I think with taking the milk thistle and not drinking for 3 weeks solid i did feel better.

I wouldnt think so they just tend to take a while with the medical as they do with everything else lol. I didn't get my results back until nearly 3 weeks after the medical! I do think this is the DVLA's plan to try and get every penny they can out of you, i was in the same situation as you worried sick if i would pass or not thinkig that titp and the venture down to manchester for the boxing would make me fail.

 

Not a problem mate glad to of been a little help, i know how stressful it can be!

well happy today just rang the dvla and they said that i have passed and they have sent my license out this morning lol nice one nick you help throw a hard period i felt confident after your advice thanks alot for the help mate hope this never happens to anyone else but i dont think that possible :D:D:D:D:D:D YEAAAAAAAAAAAAAAAAHHHHHHHHHHHHHHHHHHHHHH

Yeah I'm with elephant with my cousin who is a 30 year old female as a name driver, I'm 22 with 3 years no claims, been passed for over 4 years, i declared my drink drivin conviction and also driving without due care and attention conviction, my car is a 1.6 16v corsa sport and im £620 for the year which is very good considering the convictions.

 

When doing the quote with elephant changing small details like yearly mileage to 5000 and that you keep your car in a private car park helps bring it down.

 

I'ts a 10 month policy which you get a years no claims for when done...im paying £62 a month, was only paying around £35 before my ban when i was with Quinn Direct :(

Hey all. Iv been reading some of your coments over the last day or two with regards to the medical to get my licence back. Im worried sick as my medical is due next tuesday 17th november. The worry is I have recently appealed against my ban which was due to run out later this year, and won. Only problem is, I have been given a date for the medical almost straight away with almost no time to prepare.

Im probably a worse case axample, I work in a pub, and do a bit of DJing so drink is readily available all the time. I wouldnt consider myself to be a heavy drinker, but I would consider myself a binge drinker, drinking only at the weekend.

If im honist, I had quite a few drinks friday 6th, but since then been pretty good, had a couple saturday, thats it. Im not goin to drink now at all untill the test, and have taken some advise, and been taking milk thistle as of today. Im just woried it might be too little too late, with only aprox 10 days since my last drink before the test. But as I said iv had almost no time to prepare.

Im wondering if it might be better if I try to delay the test.

Ive heard of people not giving up drinking at all before the test and still passing. I cant afford to wait another 6 months as my job depends on it.

Any ideas?. Ill keep you all informed anyway. Thanks for all your comments, its been helpfull.

Hi Nick.

Noticed you saying your insurance policy is only for 10 month, but they give you 1 years no claims. Be carefull, as sometimes this is a [problem], as only they will recognise it as a 1 year no claims bonus no body else. Its to force you into having to re-newing with them next year. They wont give you the full year in writing when your policy runs out.

Be carefull mate. phone them and check before you hand over anymore money.
