I have been parking @ this car park for the past 6 months 3/4 days a week paying 3.50 for all day parking. Last Thu's (27th) i came to my car from work finding the Parking ticket.(copy attached). I have no intention of paying them £80 for a 3.50 car parking space- that i have paid for. I will state this in a letter to them today.

 

My question is this. As you can see on the PCN they have stated i was parked in 'Globe Road 4' But i wasnt, i was parked in Globe Road 3- like i always do, my P+D also shows i was parked in Globe Road 3. Does this mean they have no case at all to fine me- as they have written me a ticket for a car park i wasnt even in?

what is P+D . . . and how does it show you were in globeroad3 ?

why were you fined if paid for all day . . . ?

and are the globeroad3 and globeroad4 seperate or joined car parks ?

P+D = My Pay and display ticket i bought and placed in my windscreen- but on that day i put it up the wrong way round. It states on the Pay and display ticket that It was bought in Globe Road 3. and yes they are seperated.

 

I was fined a code 83- i.e not correctly displaying the ticket.

 

Also, I wont until iv had advice, But i want to end this before it begins. I dont want to have to write a series of letters.

So you have been fined (£80-for displaying a (legal - as fully paid) ticket upside down!!!) - in a car park you weren't even in . . .

I think you should pen letter you intend to send in response to this . . on here for the scrutiny of those who have dealth with this before - so they can ammend for you, and advise you - to make more effective, prior to sending . . . Initially, i dont think they could enforce this - but im not 100%, so take more advice on here first . . .

 

Never admit your wrong . . .

Pen your letter to sound like your distressed, due to the fact that you feel you have paid-in-full for parking service.

State that you feel it is not legally enforcable - tell them you have taken legal advice from family member - This suggests to them that your not a fool they can bully!!!

Make clear your intention to fight it to the death - even if this is not the case - these fools only persue the ones they know they can win (thery're predators) - if it sounds like a costly case for them, as your willing to fight all the way, they might let it go . . .

 

Also, wait for and take all other advice on here . . .

Parking Ticket Serial No. VC/0042219 A

 

I have been parking in the Globe Road car parks for almost 6 months 3-4 days a week and flawlessly been paying for an all day car parking space. I am outraged at getting a parking ticket and will not pay any amount you ask for.

 

Regarding above stated matter. I am appealing this charge on a number of reasons.

 

Firstly, attached is a copy of the Ticket I paid for on the 27th of November. By showing this proof of payment (see enclosed parking ticket and Pay and Display Ticket) I claim that you have not lost any revenue and absolutely deny that I am liable to pay you any amount further.

 

Secondly, and somewhat more importantly. I was parked in the ‘Globe Road 3’ car park, and your parking officer has written the ticket for ‘Globe Road 4’

I cant be charged for a ticket when my car was not even there.

 

I must tell you that I work in a highly recognised Solicitors and I have a lot of legal information at my disposal.

 

So, To summarise, Your company has fined me £80 for displaying a (legal - and fully paid) ticket upside down, In a car park I wasn’t even in.

 

I trust this will be the end of the matter.

Wait! If it's a private company then you should not write to them under any circumstances. Any "appeal" will be binned and they will then have more information about you.

 

Was it a council ticket, or from a private company?

Private- i want to sort this ASAP, i dont want to have to wait for them and have to mess abotu sortign it. Surely a good letter will let them know I know that there Wrong.

I have to park in this car park all the time, i dont want any unlawful so and so's to go near my car again.

 

Why have template letters if the advice given is ignor evrething they send you?

Its up to you, if you want to waste your time go ahead, they will ignore anything you say and will not accept any logical explanations so the more you write the more they think you are concerned and the more demands you will get.

Its unenforceable so the best way for it go away is to ignore them and they will give up.

Forget about the location, it's irrelevant. The ticket is an invoice and has no legal meaning. You do not have to pay.

 

The usuall advice nowadays is not to contact them. The template letters were written earlier but were ignored by the parking companies so are now considered a bit pointless as it's become clear they obviously aren't interested in trying to resolve disputes.

 

As you did pay and display a ticket it might be worth an initial letter just stating this and saying they will not be paid and you expect no further action. If they go into autopilot mode, just ignore them.

It is not aquestion of fining you, as they cant do that anyway. Even if the correct location was stated; you dont have to pay so why are you bothering. Now if it was a legal ( council or on road offense ) ticket it would be worth chasing and appealing the ticket.

 

If it did go to court ( 1 in a billion, as it would cost them money to do that ) what would they claim for, you had paid the parking fee and displayed it, do you think a magistrate or judge would award them anything just because the ticket was upside down; I dont think so.

 

These operators rely on putting tickets on vehicles for any reason and hope people will pay up! unfortunately a percentage do.

Hi,

 

I would personally ignore it. I got a ticket for parking on a bit of private land to drop my DJ'ing equipment off. The ticket was for £35 (I think, the story about it is on here somewhere) and i got it in July. It is now 3rd December and I have never heard anything back. Have a look at some of the stories on here about Private companies and how their tickets are more or less worthless.

Il proberly write a letter to them with photocopy of Pay n disdplay ticket.

 

Now, I was thinking to not put a name or return address on it. I know and understand if i write with my address and name then they will have it easy and be able to contact me when evre but if i dont they will have to go through the DVLA,so hopefully wont bother. Good idea? or not?

 

 

If i get letters back off them I will ignor them or use the templates.

I would still ignore them. you have done nothing wrong so why waste your time telling them this. Its up to them to prove you were in the wrong so let them do it (which I doubt they will). For them to get in contact with you they have to go to the DVLA and even though I'm not 100% sure about it I think the DVLA will charge them for releasing information.

 

The choice is yours but you should let them do the chasing.

If i send them something like that they will still have to go through the DVLA if they want to, but it shows I have made contact IF (very unlikley i know) This goes anywhere.

 

Im sure you think your talking to a brick wall, your not i understand your points and im pretty positive that ignoring it would work. I just dont like leaving things

Well that is up to you. You have put your point across to them and thats fine. You haven't left them a way of getting in touch with you so again thats fine. Its completely up to you, either way I expect you will get the same result but it is whatever will make you feel better :)
