    • Thanks in advance for advice! I was shocked to find out when doing a credit score search this weekend that I have a CCJ in my name. I've spoken to the courts today and have been told Vehicle control services have taken me to court for parking without a permit in my own allocated parking bay that came with my flat rental. The CCJ appears to be to the right apartment block but the wrong address.  It dates back to 2017. The judgement was passed in April 2021 without my knowledge of the ticket or the case ( presumably fine information was sent to the wrong address) I had already been taken to court by VCS previously for parking in my own bay and I won. It seems to me that this is underhanded behaviour from VCS as they had my address from previous interactions and had tried taken me to court for something that a judge had previously ruled on. I'm seeking advice on next steps. I was told by court that i can raise a dispute on the CCJ but I also want to appeal the case altogether. Should I be filing an  N244 Application Notice with an N161? I was told I should pay the court £303. Now that I've got home and had a look, there is a long list of court fees so I'm not sure which is applicable. I was also told the £303 is not refundable. Should I be filing a counterclaim or is that something that can be done at a later date. Ultimately I feel disgusted at having a ccj and then having to pay for the privilege of getting it removed. Any advice on how to make VCS pay for this would be appreciated!

    • As gesture of goodwill, we were eventually given a courtesy car from Mercedes (after numerous complaints from us on their lack of communication / misdiagnosis / time they’ve had the car - we’re now at over 4 weeks without our car) They have literally just informed us it will be ready to collect tomorrow. If we pay the cost, where will we stand? It’s so hard to understand what we should do 😫 we will re open our complaint with the finance company then. We emailed Doves yesterday informing them of all the problems (we have touched base with them and let them know prior to this) but they are yet to respond.    Any further advice would be greatly appreciated!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I don't send cards, I don't give cards and I don't expect any in return either. It's a lot eco-friendlier for starters, eases the financial pressure on those who can least afford it and who cares about the syrupy insincere wishes from people who don't give a toss about you the rest of the year anyway?

 

Here's a simple test: You need £10 to get the essentials to see you through until payday. How many of the people on your xmas card list would you feel comfortable enough to ask AND knowing they would say yes without hesitation as long as they could do it? Any of those where the answer is "not this one", you shouldn't bother with anyway.

 

Christmas cards? Bah-humbug, if you'll forgive the expression. :mad:

I have always been terrible with Christmas cards. Every year it starts with good intentions and then I end up asking the question 'When is the last posting date for Christmas? It must be soon' only to be told that it was the day before. Opps

 

I don't expect Christmas cards from anyone, for a lot of people (and unfortunately moreso this year) putting food on the table and clothing the kids comes first, and rightly so.

Have to agree with Bookie here, I havnt sent em for years and I dont want any back either, the only people that make money are the card printers and the post office

We stopped sending cards to each other at work a few years ago and instead have a collection (what we would have spent on cards) and give it to a worthwhile cause.

oh for goodness sake, slaps head in disbelief, we send cards to peeps who we forget about the rest of the year just so they dont forget about us! And then they send one back. Unless you are sending one to someone you do care about then you send one to them to let them know you care and then they send you one back. Simple EH?

But HF, if they forget about us the rest of the year and we forget about them for the rest of the year, why on Earth would you want to be mutually reminded of one another at Christmas anyway? :-? Much better to keep on forgetting one another and keeping the quality time for those we do care about, and those, one would hope, we do care about them all the time and don't need a sparkly robin or an unrealistic snow landscape to remind them of that?

 

My very bestest friend in the whole wide world is a suave Frenchman called Jacques (yes, Lula, that one! :-D) and I have never sent him a card in the last 20+ years we have known one another. Nor has he sent me one. (the swine! no, it's ok, really. :-D). But there's not a day where he isn't in my thoughts, even if we only speak once in the traditional blue moon, and he's always there for me and I for him. No card being sent or not will change that. :-)

I love cards usually but I really hate xmas cards as they are so insincere .My friends all know I don't like them so stopped sending them to me BUT my kids love the cards .. sending and recieving them so now I have messed up as they wanna know where the cards are .. I now have had to put their cards up and their lil faces light up so now I have had to totally confuse my friends by sending them ( so the kids can post them ) and telling them I now like recieving them grrrrrrrrrrrrrr

I always look forward to the Postman bringing my Birthday cards on my Birthday, just like everyone else. Unfortunately, my Birthday is Christmas day and the little swines get the day off so that wish will never happen.

 

Cards that I normally get brought to me say Happy Christmas as well and end up in the bin within a week. So to all you that think cards are a waste of space and money, add me to your list.

 

To all you who think otherwise, then go enjoy your happy lives and waste your money. I am not a Humbuggy type person but just this once it's a large............

i want to stop sending them but don't know what to do for best - especially neighbours - now that really is insincere crap - don't speak most of the year except a quick "hiya" and then we all exchange cards at xmas.... i'm as guilty as the rest - so if i call them - i'm calling myself. i'm betting they would like to stop as well - what do you think of sending the last xmas card this year with a note that from this point on i will make a donation to a charitable cause instead of sending xmas cards.... too, too or what do you think.

 

 

and sod em - i've already made a note to myself to log on on xmas day to send you an ecard greeting.
