    • Since you were stopped at the time there is no requirement for the police give you anything there and then or to send you anything before they have decided how to deal with the offence.  They have three choices: Offer you a course Offer you a fixed penalty (£100 and three points) Prosecute you in court  The only option that has a formal time limit is (3). They must begin court proceedings within six months of the date of the alleged offence. Options (1) and (2) have no time limit but since the only alternative the police have if you decline those offers is (3) they will not usually offer a course beyond three months from the date of the offence and will not usually offer a fixed penalty beyond four months from that date. This is so as to allow time for the driver to accept and comply with their offer and to give them the time to go to option (3) if he declines or ignores it.  Unless there is a good reason to do otherwise, the action they take will usually be in accordance with the National Police Chiefs' Council's guidance on speeding enforcement. In a 40mph limit this is as follows Up to 45mph - no action. Between 46mph and 53mph - offer a course Between 54mph and 65mph - offer a fixed penalty Over 65mph - prosecution in court So you can see that 54mph should see you offered a fixed penalty. Three weeks is not overly long for a fixed penalty offer to arrive. As well as that, there has been Easter in that period which will have slowed things down a bit. However, I would suggest that if it gets to about two months from the offence date and you have still heard nohing, I would contact the ticket office for the area where you were stopped to see if anything has been sent to you. Of course this raises the danger that you might be "stirring the hornets' nest". But in all honesty, if the police have decided to take no action, you jogging their memory should not really influence them. The bigger danger, IMHO, is that your fixed penalty offer may have been sent but lost and if you do not respond it will lapse. This will see the police revert to option (3) above. Whilst there is a mechanism in these circumstances  to persuade the court to sentence you at the fixed penalty level (rather than in accordance with the normal guidelines which will see a harsher penalty), it relies on them believing you when you say you did not received an offer. In any case it is aggravation you could well do without so for the sake of a phone call, I'd enquire if it was me.  I think I've answered all your questions but if I can help further just let me know. Just a tip - if you are offered a fixed penalty be sure to submit your driving licence details as instructed. I've seen lots of instances where a driver has not done this. There will be no reminder and no second chance; your £100 will be refunded and the police will prosecute you through the courts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I know he's a very busy man, but if there are issues and 1st Credit are taking advantage of people by improperly sending Statutory Demands and so forth pt can be very handy.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

Thanks Enron, understood - and it is only my fear of the sd, because debt is over 750.00 and thus being a homeowner, will shout once i get to that stage but am self learning every day to understand legal processes, as this is now all become a bit of an addictive passion for me

Hi All! Sorry not been on for a while, been looking after my dad hes out now,been getting him settled in his bedsit! He has been assigned to the parkinsons clinic now! Wondering if anyone can help? He has an over draft with lloyds tsb who also wont freeze the account thus he keeps going over every month he is paying £10.00 a month to get back in credit then charges are taking him over! i would be grateful for ideas? THANKS FOR ALL YOUR SUPPORT XXX

you would be best served in making a formal complaint to Eric Daniels in the first instance, he is their Chief Exec and from my own experience is very very helpful. i had a problem with them and one email to Mr D and it was sorted promptly and you have never hear the word Sorry used so many times

Thank you for all your help! I am now trying to get my Dad some help in the way of a carer,as he is really struggling with day to day (I am at work 4 days of the week so cannot be there as much as he needs me) He has had a previous assessment with social services who have said his needs were moderate and offered me help! I refused.

Social services were saying it was a mental health issue and the clinic he was sectioned in were saying it was organic from the neurological condition, His cpn has signed him off now and his psychiatrist has verified the psychosis was down to the neurological conditon. All we know is there is something wrong with his brain which has resulted in him having seizures, memory loss, psychosis,walking difficulties,speech impairment and his body shutting down,to the point he cant get out of bed some days .

He leaves pans on and they boil dry,drops them,Turns up for appointments days early or days late! He is still untrusting and has become reclusive.

 

He has been awarded middle rate care and lower mobility,which has been notified will continue now for five years before review.

Does anyone have any ideas as to what or how i can get social services to help? Thanks

Hiya

 

Lovely to hear from you,sorry ive not been in touch.

Well things have moved on slightly although my dad had to be sectioned again 3 weeks ago,he is out again now and so far hes stable although we have been told it will happen again (psychosis)

 

I have now given up my job and my dad employs me 17.5 hours a week.

I still need to be with him everyday all day to make sure hes ok,so therefore have asked for a reassesment (fingers crossed)

 

We are still awaiting a cpn to be allocated more for my piece of mind really as this time once again the gp wouldnt help he doesnt think its his job! He says hes fed up with the crisis team not doing their job. cpn had discharged him and the crisis team didnt want to know so I had to get my Dad detained by the police on a section 136 (this is so the police can take him to a place of safety) which is something id tried so hard to avoid, and sectioned by the relevent professionals at the police station after they had to physicaly restrain him!

Although Im no expert in mental health I can honestly see why people are harming themselves and others as there is no help out there, Its disgusting.

 

I know and see the signs and tell all the professionals that he needs to go into hospital but they just palm me off and send me round in circles telling me its everyone elses responsibility.

Im not sure what else to do now.

They should be able to help u with alsorts like forms for benefits and housing to setting up home grants from charitys and restbite assistance for you. Even if this is just a couple of hours a week.

Thanks again, I think all I want is for when it happens again is not to have to get him physically restrained and held in a cell for 18 hours which is harrowing-6 police officers grabbing him hitting him with a truncheon when all he knows is hes terrified they are all plotting to kill him and he needs to escape!

The police were very good and realised how terrified he was but they arent trained in mental health, I caled his doctor and went to the surgery twice he wouldnt even speak to me.

I called the crisis team who said see the gp the first time then the second time told me the had no psychiatrists available and to go to a&e (no chance when hes in that frame of mind as he needs to keep running from the visual and auditory hallucinations)) then they told me I would have to get him picked up on a section 136.,because he had been discharged community mental health team wouldnt do anything.,neither would the clinic as i needed a refferal from one of the previous three mentioned. argh.. they make me mad!

Yep welcome to the mental health issues of Great Britain. The police are useless.

 

I would get in contact with Mind. I have been to the local branch and they are wonderful. The local branch are wonderful and full of useful info and stuff.

They have a duty of care and it seems that he is not on the right meds or isnt taking them. Is there a crisis team? Usually called The Access Team?

Overdone.

 

This is the way mental health services are run.

 

MM has already said the crisis team wont help her so she has no where to turn to.

 

MM is there a way u can get him long term sectioned so he can be put on the correct meds?

Hi overdone there is a crisis team but I dont know why they are called that they dont do anything i just get fobbed off wether it be by the gp crisis team community mental health.

He does take his meds he is on a high dose of quetiapine 600mg daily but he also has a neurological condition yet to be diagnosed! (basal ganglia antibodies )

Hi godmother they will only section him if he is a danger to himself or others (when his mind goes he like knives, skewers,screwdrivers ) you get the jist.. therefore hes classed as a danger to others on that basis they will section him,however hes very good at fooling people-he will say anything to escape. After a few days 7/8 days hes stable enough not to be a danger so they have to lift the section,he gets frustrated angry and bored. Hes then technically allowed to leave if he likes although this time they asked him if he would stay for 10 voluntarily which he agreed to.Then hes deemed fit to be discharged and hey presto guess what Im back to square one !

 

They dont want him in there anymore than he wants to be but getting a care plan agreed for discharge -lets just say it doesnt happen,hes still waiting for a cpn.

Its so frustrating x
