Tosh we are in the same boat only mine sold to 1stCredit..I remember you ..Im still intalks with 1st crud..they keep saying the application form is the CCA I aint having none of it..Mine is SB nxt year in March ,,

I think Halifax refunded me 3 late payment charges (even though they missed one) onto the account back in April 2009 and so I don't think it is SB until April 2015.

..If you haven't payed anything off the account since 2008 then I don't think them adding late payment charges would set the SB clock..After all its them adding not you

Have you ever done a SARS ,,( A request for all the paper work on the account) ? if not is cost £10 and send to the OC,, ..that should tell you when the last payment was made on the account

Lets be clear on these points:

1. Statute barred = no payment or unequivocal written acknowledgment in 6 clear years, i.e. the date a payment was due and not made, after which no further payment was ever made.

 

The Default date will be up to 6 months after the last payment, the two are NOT interchangeable.

 

A default has a 'life' of 6 years on CRA files and is removed after 6 years paid or not.

Just been going through my statements and paperwork. I have been charged repayment cover from 2003, even more but I don't have statements that go that far back. If I add all these up I think that Halifax will owe me money.

 

I also wrote to them about PPI back in 2010 but did not receive a reply.

Received a letter from Lowell, They have investigated and will be taking no further action, and closed the account. Can I request a SAR from Lowell?

You request the SAR from OC

No point in sending a SAR to a DCA the data it would have would only date from date the DCA acquired the debt.
