    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'd heard this before but dismissed it as an urban myth, but today a few of us were bored so we tested it out and it works, so I'll post it here.

 

If the lift you are using has a door close button ( I stress a door CLOSE button and not a door open) if you keep your finger on that door close button the lift will NOT stop at any other floor en-route to the floor that you have pressed.

 

So if (like us), you work in a tall office block and you are running late and don't want to stop at every floor where people are waiting for the lift (OK let's be honest if you just want a bit of devilment) then keep your finger on the door close button and let them wait a bit longer.

I would reckon itll depend on the lift manufacturer....

 

Personally I'm scared of these things so wudnt wanna mess on with it!!! :D

Im a lift engineer and if this is the case this must have been specified by the building owner during the installation.

 

99% of lifts will not have this facility

Im a lift engineer and if this is the case this must have been specified by the building owner during the installation.

 

99% of lifts will not have this facility

 

To be honest I didn't believe it either but we really tested it out. 4 or 5 of my colleagues walked down to various floors, when the lift was on my floor, they all pressed the 'call button' and it stopped to pick them up. Once we reached ground floor we went back up dropping them off at various floors and when I was at the top I pressed 'door close' kept my finger on it and pressed 'Ground Floor'.

 

It went past the lot of them and didn't stop until it reached Ground Floor, I know for a fact they had pressed the call button because that was the whole idea of testing it out.

 

Incidentally for the first time ever, when I left to go home the lift never stopped at any floor below me despite it been a busy time. This I put down to pure coincidence and was in no way anything to do with me or my finger!!!!!!!

I want to know - if you are in a falling lift, and just before it hits the floor you jump up, would you get hurt?

Unfortunately, yes. If you get Discovery Channel, look out for the episode of Mythbusters where they put this to the test. (If you want the explanation, let me know)

To be honest, I thought it was a bit of a daft question having thought about it afterwards. forgot that little bit that, as the lift is falling at great speed - so are you!:eek:

Yep - although you are jumping relative to the lift upwards, you are NOT relative to the ground :)

 

Besides which - in most lifts, how would you know when you are about to hit the ground?
