Have just been to the post office and sent my claim letter recorded delivery for £4k +. Lets hope all works out well in the end.

Hi all.,

 

Just to let you know that I have already sent letter one and received a polite letter from Barclays and a particularly BLUE leaflet detailing their charges etc.,. and saying they would get back to me by 14th July, a bit late when their 14days were up on 30th June.

 

I have today sent my Letter B4 Action with a little alteration in the first paragraph stating that they had not replied satisfactorily to my letter of 16/06.

 

So we shall see how we go on now.

 

Good Luck to one and all in the same boat, keep paddling and we will scupper them. Oh ARGH!

Hi I need a little bit of help please - the bank have offered me £1k as a goodwill gesture and their time limit is up after the LBA let on Monday 17th July. I am not going to accept as they owe us a lot more than that.

 

What I need to know is:-

1). Do we say thanks but no thanks and give them another 14days or

2). Say thanks but no thanks and continue with Money claim on Monday?

 

All thoughts would be gratefully received.:confused:

I personally would say thanks but not thanks and give then 7 days to revise their offer before continuing to moneyclaim

Thanks for that, I really appreciate the advice - stupid question really but would you take that 7 days from today or when the 14 day limit on the LBA is up, I have read threads similar to this and have not known how to respond.

Hi Anyone.,

 

When I put in my claim to the bank I included the Monthly Account fee which is currently £10/mth.

 

I appreciate that we are being advised to only claim for charges, however I have claimed this fee as we have no benefit from it, we have never used any of the services, and quite frankly we have never been encouraged to. In other words we do not have regular information from the bank, to remind us that in fact this services exist, the only reason I know about it is because of this site, so to me they are a charge on my account.

 

When I continue with my claim which is due to be started through the court tomorrow, if I were to continue to include these fees would it be seen as an excuse to be thrown out. As you can understand I do not want to proceed along a route that could be a waste of time.

 

Anyones thoughts would be much appreciated especially if anyone out there has also claimed them and been successful.

Hi,

 

You cannot include the monthly account fee in your claim as this is a service and not a penalty charge.

 

Regardless of whether you have used any of the services offered or that they have not been promoted is irrelevant. If you do not feel that you are getting any benefit for paying for an 'upgraded' account then I would suggest downgrading and losing the monthly fee.

 

I would definately not include it when you start your claim with the Courts. I don't know whether it would be worth writing to Barclays to advise them of your revised claim or not, but hopefully someone else might. Have you done a search on Monthly Account Fee as it might have been discussed elsewhere.

Don't forget to contribute to the CAG. Without them we would probably still be drafting our prelim letters.

OH Cap One - £436/ So far received £40. MCOL submitted 17/7/06. Caved 4/8/06 for full amount!!!

OH Monument - £140, claim filed 8th May. Requested judgement by default, settled in full 4th July via out of court settlement (see thread). Total £192ish received.

Me Barclays - £630. Received letter 13th May offering £300 full and final (they can bog off). Claim filed 16th May. Acknowledgement of Service filed 22nd May to defend all of the claim. Allocation Questionnaire completed and Stay been ordered by Judge on 18/7/06!!!

Morning Alleycat.,

 

I have tried to Search this morning and it keeps throwing me back to 'Cannot Find Server'. I have read in a couple of threads that people have felt the same as myself but they haven't let on whether or not they have gone for it.

 

Any road up I will amend my claim, that should make the bank happy, I am not too worried about letting them know I have changed the claim amount as it is in their favour, and it won't make a ha'peth of difference to the claim as they have already written to me stating that the £1k they offered was all they would be offering.

 

I now have to find the £120 to take them to court, oh well I get it back so as the saying goes. Lead on Mcduff.

If you take the monthly fee off which you certainly cant claim back, Is the claim anywhere near 1000gbp.. If it is Id get in quick and accept their offer.

Hiya.,

 

No in fact it still £3.7k + int. The thing that makes me really angry is that they have switched us to this 4 years ago without us signing up to it and it is only through going through finding the charges that I have found it, and they now list it as commission/account fee so they are reaping it in from all directions.

 

So to say I am not a happy chappy is an understatement.

 

But yes if it had been near to £1k I would have bitten their hand off.

Hi has anyone else noticed that the banks are trying to be sneaky in the fact that they are now calling the Paid Referal Fees - 'Commission'.

Am I being paranoid in the fact that we can only claim charges that are actually listed as Paid referals/Overdraft fees etc.,

I would think it doesn't matter what they call them. Unless they can justify why they charged you the money and can prove it is not a 'Penalty' it still is unlawful

If they hadn't acknowledged, it would have been deemed served after 5 days (5/8) so I would start counting 28 days from 3/8 - is that what you mean :confused:

Well this is what I was wondering, would you take your 28day allowance from the 3rd which is the day they acknowledged or the 2nd when the may have been served but they could also have been served on 1st.

 

I am like this when I am ordering Chips I know exactly what I am going to say until I open my mouth, then the brain disengages from the vocal chords and it comes out as blahhhh!

 

I just want to be ready to jump on them and press the judgment button, even though I know that they are going to offer a defence at the last minute but you never know....

LOL, you'll have to take it from 3/8 when the acknowledged - 1 or 2 days won't make any difference anyway, MOTB xxx :)
