    • The 3 pieces of mortar that fell on the same day, at the same time, were approx. 25-30cm long and weighed around ½-1 kilo each from a roof that is above the 2nd floor; they were by no means tiny pieces of mortar but large chunks falling from a rather great height. I believe the size and weight is enough to cause serious injury and if it falls on your head, I assume it could potentially be lethal if unlucky, but we don't wish to put that theory to test... We can't in good conscience let a contractor install a patio and a gazebo as it is in the exact spot where the mortar fell, nor do I think anyone would be willing to take the chance. Looking at the roof, there are multiple other remaining pieces from the same 'line' or 'row' of mortar that can potentially fall. The mortar is right underneath the slate tiles on the neighbour's roof and I don't know whether the tiles are also (becoming) lose due to the loss of the mortar. I was trying to upload a photo but it seems it's not allowed. The first contractor to work in our garden in preparation for the patio and gazebo is scheduled to start on 10th June, that leaves the neighbour 5 workdays to sort their roof which is unlikely, so it seems we will have to postpone our patio contractor without knowing when they can come back. We have already had extensive work done in the garden in preparation for the wedding reception and it will become very costly for us if we have to move the wedding reception to a venue (if we can even get one at this short notice) rather than have it at home which was our dream.

Initially the phone worked well until I used the camera and found debris in the camera lens spoiling pictures making it not fit for purpose. I contacted the seller who offered a replacement which I initially accepted but later rejected and wanted a refund in full which the seller refused saying they Do Not give refund is unlawful and goes against the Consumer rights act 2015. Therefore I intend to issue proceedings against you in a county court without further notice unless you reimburse me the above amount in Full within 7 days from the date of this Letter     ------------------------------------------    I think its best if i hand him the letter as posting it might not get through so can claim expenses traveling up there ?   or would it be best to just post and get 'Signed for'  ?   Should i also put in the letter of claim interest added or leave that till the Particulars letter ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just saw you post whilst I typed away ... unfortunately, even if someone else copied it, it will still be unreadable. If you are scanning it correctly, you may be able to increase the image sharpness/quality if you have a photopackage on your PC. Don't know what else to suggest.

Thanks, nope that is the way it came, I am scanning it correctly it is just a really shoddy copy of the original application form. No prescribed terms/conditions on it. Even says it is an application (from what I can make out on the form)

So, as received as 'pasted?' :D I am not experienced enough so may be wrong ... so will post what I know ... if it's an application form ... then ... may not be a CCA.

 

Also, if it's illegible, sure I read something on here about getting a better quality from them as they would not have fulfilled your request correctly ... if it IS that illigible then it's not acceptable.

Try this:

 

Put the image in your scanner and if you have PowerPoint, from the menu bar, use Insert>Picture>From Scanner or Camera. When it's in the document page you can then resize it and block out the personal details. Powerpoint has an option (File Save As) to save as an .jpg file which you can then upload to Photobucket.

Cant see it its all out of focus as well, but if it doesnt have the prescribed terms on the page you signed then its not enforcable IMHO, the up to date version of an agreement is a red herring and should be ignored

Ok, any of you wonderful people able to help with with an official looking letter to say, you haven't sent me a true copy of the signed CCA at all but a very dodgy copy of the original application form which is in fact a pre-contract agreement. I did draft this one up but not sure if it reads right.

 

 

 

Dear Sir,

Thank you for your letter dated 4th July 2008. Unfortunately you have not sent me a true copy of the signed CCA as I requested but a poor copy of the initial application form which infact just a pre-contract agreement As you are aware the application form is not a CCA as it does not include the necessary prescribed terms within the copy. According to Section 127 (3) of the Consumer Credit Act 1974 the prescribed terms for a running account agreement such as a credit card, and which should be included in the CCA are details of:

(1) Repayments.

A term stating how the debtor is to discharge his obligations under the agreement to make the repayments, which may be expressed by reference to a combination of any of the following~

(a) Number of repayments.

(b) Amount of repayments.

© Frequency and timing of repayments.

(d) Dates of repayments.

(e) The manner in which any of the above may be determined; or in any other way, and any power of the creditor to vary what is payable.

(2) Rate of Interest.

A term stating the rate of interest to be applied to the credit issued under the agreement.

(3) Credit Limit.

This may be a term or the manner in which it will be determined or that there is no credit limit.

You have included a copy of a credit card agreement, however this is not signed. Therefore you have failed to respond to my legal request to supply me a true copy of the original Consumer Credit Agreement for the above account and so the claim in your letter that “…the information we have provided you with is all the information we are required to provide you with under Section 78 of the Consumer Credit Act…” was not correct.

The document that you are obliged to send me is a true copy of the executed agreement that contained all of the prescribed terms, all other required terms and statutory notices and was signed by both your company and myself as defined in section 61(1) of CCA 74 and subsequent Statutory Instruments. If the executed agreement contained any reference to any other document, you are also obliged to send me a copy of that document. In addition a full statement of this account should have been sent to me detailing all debits and credits to the account.

I therefore will allow until the 18th July 2008 for you to send a true signed copy of the Credit Agreement, before taking further action. I would appreciate your due diligence in this matter.

Good letter but personally I would keep it as short as possible and dont give all the goods away (why make it easy for them?)

My thoughts would be something like this (its your choice tho :) ):

 

Dear DCA,

 

I refer to your previous communication dated where you provided me with a copy of an application of which has been has been noted and kept for complete audit.

 

My request under statutory law was for a fully executed consumer credit agreement however the document sent does not satisfy the terms under the Consumer Credit Act (1974).

 

I'm sure you are more than aware of your timed obligation to honour this request however I must point out that failure will result in serious complaints being made to the relevant authorities.

 

I would also suggest that if you do not have the evidence as requested that you close the account and confirm this in writing.

 

I look forward to your provision of requested evidence and fully expect your due diligence in this matter.

When you have scanned it you must have made it smaller. Its not you uploading it's when you have scanned it.

 

try rescanning it and make sure you have full size or something ticked

From what I can see, this is def an application form but not sure if it doubles as a CCA. If it does, I cannot see all the prescribed terms....
