  1. Hmm.... the letter from wurst crudit is standard template job. To me I feel this has all the prescribed terms however this is not definite. Can someone who knows pass comment please?
  2. Oh dear... for them! You can choose to either contact them and let them know they have not supplied a fully executed agreement or you can just hang back and watch their next move...
  3. Much better. I would say that the page on its own does not contain the prescribed terms applicable to a running credit agreement. Is that all they sent?

  6. You are quite correct, application forms can double as consumer credit agreements but they must state that consumer credit agreement regulations. Your application form does not contain the prescribed terms and is nothing more than proof that you completed an application form....
  7. Bet is was LCS... They are just part of Wurst Credit so dont get phased. Can you provide some info on when the loan was taken, was it secured etc etc?

  10. Its your call where you write to, my letters came from Hull, every reply went to Saltcoats and in every instance I got a reply within 3 working days (with Hull on the envelope) so everything was working fine
  11. It would be good to see if they have a deed of assignment, I would guess not tho - it would seem that Wescot are acting on behalf of Barclays
  12. Indeed, I went through this cycle with them, may be worth a read - also a good letter you may wish to use
  13. Good move, be sure to let them know that the law states they must provide the evidence NOT you, refer then to your previous letter which asked them for proof. Also let them know that all communication must be in writing for audit....

I would also like to point out that the Office of Fair Trading: Debt collection guidance (July 2003), Sec. 2.8, Subsection 'a' clearly states a deceptive and/or unfair practice as: "sending demands for payment to an individual when it is uncertain that they are the debtor in question, for example, threatening debt recovery action to 'the occupier' or sending a payment demand to all people sharing the same name/date of birth as a debtor in the hope that contact with the correct debtor will be made" Oh dear, another breach right?
  17. NO! Dont give them any information.... The Office of Fair Trading: Debt collection guidance (July 2003), Sec. 2.8, Subsection 'j' clearly states a deceptive and/or unfair practice as: "requiring an individual to supply information to prove they are not the debtor in question, for example, driving licences, passports, full name, date of birth, signatures" They have contacted you and they must have had evidence right? Wrong.... The law is on your side, they must prove you are the alleged debtor and trying to get more information out of you to confirm this ONLY goes to prove they are unsure Its a clear breach of OFT guidelines....
  18. It means nothing. They have 12 + 2 days to produce the CCA or they will be in default and the account will become unenforceable (you can choose to stop paying if you like) An additional 30 days and they have committed a criminal offence...
