NO Even if they showed you a copy of the PCN they sent, can you still wear that they actually sent the first PCN to you? NO Why are still quibbling  when the real argument is why they have broken the Act by telling you that you hadn't paid when in reality they shouldn't have sent that letter out probably until Monday which  would have been deemed received  on Wednesday? If you are that bothered about it, just leave out the start about the windscreen ticket since it isn't why you are complaining.
    • I am sorry that you have come across excel -possibly the most inhumane of all the rogues that ruin parking in private car parks. i am more sorry that I have missed your thread until now. As I understand it, their artic. was parked in front of their parking sign and the Blue badge places forcing you to stop somewhere else in the car park to observe the rules. On realising that even the Blue badge places were paid places and that you did not have the correct coinage you quite rightly decided to leave. Thus you had read their terms and until you have read them and signified your acceptance by either paying or staying, you are not classed as being parked.  You have a MINiMUM of five minutes  leave. Sadly Excel do not understand any words greater than two syllables which is where their problems start. Their greed, ignorance, inhumanity, etc etc all carry on from there. However they do know that Judges do understand what minimum means and are well aware of the Equality Act  so I wouldn't be too worried about what excel  will do. Plus we still have to see their PCN and when it comes to producing a Notice that complies with the Act relating to private car parks they do not excel at that. I hope that the Iceland MD will cancel the ticket. You still have a couple of other routes you could try. The first one is your Member of Parliament will probably be happy to help as they will need all the votes they can get with an election looming. Plus your local newspaper may also pitch in after hearing your story to go after Iceland and excel. [You may notice I have not merite them with a capital E as it is definitely undeserved.]

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Keep reading your thread over and over. Sent LBA today for my sons account. I'm a bit edgy but will keep going. More worried about court but will keep in touch and ask for your help if ok. So looking forward to a big family wedding next August. If I can take some of the worry away or even give them a honeymoon how wonderful. I can literally hear the laughter in your home just by reading your notes.

Maybe Moment means the part of the forum where we can show that case was WON etc.. and how many days it took to win?? the bit we do after winning with the survey?? But that's a collective figure of how many people won with like a running total isn't it?

no i wanted to see what having all that money in the bank looks like, especially after all the garbage and heartache that the bank has put catherinebear through - also to see the letter that accompanies the chq, to see how they word the fact that they have been defeated and have had to pay the money back.

 

and yes, when i get a refund i will scan the chq for all to see, proving that the advice offered on this site actually pays dividends

Moments - I see exactly what you mean now ha ha :D

 

Like you say having the satisfaction of putting that money back into an account must be a moment to "savour" - I recently got my son some money back off a different bank - and it was so nice - satisfying doesn't cover it really!!! (it was only a few hundred quids - but my sons money not the banks!!!

 

I like looking at the running total on here that shows that YES this site is marvellous in helping people win their money back etc.. - the survey figures keep changing and increasing showing that YES the people are winning despite the antics of the Banks!!:D I thought that was the part of the forum you meant - but it's a collective figure including all the Banks & Credit Card companies etc..

 

Goodluck with whatever you are claiming!!! Sometimes it's difficult to understand what is meant by a question (as you just saw) Don't be put off by that - keep asking questions - sometimes it's difficult to understand what a written question means - hence the different answers? Stick around this place is fun really - nothing nicer than coming here seeing people get the help they need to win back their money!!

Hi happy new year

I am in the process of claiming back £7500 from the abbey, they sent me a letter just before Christmas offering a good will gesture of £1300, which they said would be sent to their debt management to pay off what I owe them £800 overdraft, they have also closed my account.

Should I continue with the Letter Before Action

Hiya Concat,

 

You could accept their offer as "part payment" and tell them you are still going after the rest of your money - there is a letter you could edit in the template library.

 

Stick to your timetable and do the LBA as per your timetable etc.. to continue with your claim - don't let them fob you off - if you keep reading here you'll see what most of the tricks are etc.. You will win!!!:D

Your story is both heartening, but also a vision of the long journey ahead...

I am just looking into the fortunes that Abbey have been taking off us for years. I hope when I get the process underway I can get your help with all these forms and letters as it sounds rather confusing and scary.

I am so glad you got your money in the end and I hope your carpets are wonderful (to make up for the hardship you have faced).

Thank you for writing so thoroughly - at least I know what I am likely to face :eek:
