Does anyone know who has legal rights to an untaxed car with outstanding PCNs? If the DVLA find it and clamp it what happens if the balliffs come along to do the same or visa versa...is it first to find it get to keep it?

DVLA are clamping on a statutory basis for a criminal offence; LA is merely clamping for enforcement of a civil warrant and can pursue via other avenues.

What happens if the baliffs arrive first and clamp the car, would DVLA have to wait until its declamped or can they just remove it to the pound?

DVLA can just remove.

 

They have no way of knowing whose clamp is on the car - other than it's not theirs. You could put your own on if this stopped DVLA removal...
