HI,

 

Got my girlfriends provident agreement a few days ago.

 

It does have a few problems though.

 

 

1, It says on it "page 2" but there is no page 1

 

2, no terms and conditions are included

 

3, the section for providents signature is signed by the agent,

and also the witness's signature is also the same agent. :???:

 

4, The agreement seems to be from a microfiche copy and not a true copy of the original agreeement

 

Would also like to know if £130 interest charge

is about right for £200 over 55 weeks 177% p.a.

 

CK Edrupt & Co claim in their accompanying letter...."The enclosed documents are sufficient proof of debt."

 

Sorry Mr Edrupt, but I think I'll let the good people on the Consumer Action Group be the judge of that. ;)

 

I'm sure someone here can poke more than a few holes in it and sink providents/ ck edrupts ship.

The interest does seem about right I hate to say.

 

I've had Provident loans and from experience, the agreement is A5 sized with the terms and conditions printed in miniscule writing on the reverse, signed by the agent on behalf of Provident.

I noticed while scanning, that the dust/noise on the image are all a uniform size and made of square pixels, that suggests that the copy is from microfiche/computer stored and not therefore a true copy of the original.

Also if they had the original, they would also have the terms and conditions to send if they're written on the back of the agreement.

 

Should I send them a letter pointing this out and throw the whole thing into dispute until they can provide what I asked for under the terms of CCA 1974?

That is exactly what you get when you sign up with provident and other companies like greenwoods.

 

It has the amount and % and set weeks etc.

 

but someone who has better knowledge will be along

 

If this isn't compliant then every single customer has the same!

You could push for a copy of the T&Cs but I have to agree with IdaInFife, that document looks identical to the one(s) I've had in the past.

Think I'll go for the t&c's and also it being a printout from a microfiche/computer stored copy and not a true copy of the original agreement. Then wait for their excuses etc, then offer £30 as full and final settement. If they don't have the original, then they'll more than likely accept the offer. Will try and see how it goes anyway.

Hi there

 

well the document contains the prescribed terms and the APR and figures check out to the letter on the OFT Dualcalc checker so as far as that side of it goes it looks ok

 

i would ask for a copy of the T&Cs but remember a court may be able to enforce the agreement
