I emailed both Andrzej.Tuleja and James_Goldsmith at Whirlpool dot com. I got a phone call from their executive team a couple of days later, and a replacement part dropped on the mat a week after. She was quite apologetic, however, also reiterated the "90 day warranty" period on customer fitted parts, and did not comment when I mentioned that the CRA also applies as I was a consumer buying from them directly. So I now have a spare door switch if the machine decides to eat another in the future! Cheers all!   Note dx100 that the "Hotpoint CEO" you linked to is not related to the hotpoint appliances, but some kind of marketing app.

It seems that DVLA think that S.88 does apply for applications disclosing a new medical condition after all. Why might this be so, and what of “qualifying application" and "relevant disability"? S. 92(1) imposes on the driver a requirement to disclose a relevant disability. S.92(3) requires the Secretary of State to refuse such an application disclosing a relevant disability ….. EXCEPT S.92(4) requires the Secretary of State to grant such an application if the relevant disability is “adequately controlled”. Hence my belief S.88 can apply for medical conditions (if the driver meets the medical standard of fitness to drive) as the application remains a qualifying application IF the driver meets the medical standard of fitness to drive, until DVLA (on behalf of the Secretary of State) say it doesn’t, provided the driver believes they meet the (medical) standard. Additionally, at (or before) June 2013 (as noted in my previous post) the medical standard for fitness to drive for conditions involving excessive daytime sleepiness was changed from “completely controlled” to "adequately controlled".

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, first, can I check that the CCCS you are talking to is the consumer credit counciling service (i.e. it is a free service?)

 

We do need some more details before we can help:

 

1. What equity exists in the house

2. what are your monthly income / outgoings, before ANY of the credit is taken into account

3. What is the repayment on your secured credit

4. What is the repayment on your unsecured credit

 

Edit: BTW, although I'm the first of the debt bods responding, Lula has allerted five or six site helpers to the thread, so you should get some more help over the next couple of days:)

Rite l think what you need to do is stop using all cards if you have not already done.

 

One thing l would also do is sent all credit cards a CCA request.

 

You have done a bit of reasearch on this which is good.

 

I dont know if the personal loans will also be CCA covered as l have never dealt with personal laons before.

Don't panic we have a plan.

Now this will involve a flurry of activity and some serious letter writing, but should pay off in the end.

 

To business.

1/ NEVER talk to any of these "people" on the phone as they will say anything to secure payment.

2/ For all the DCA's you must ensure they have the legal right to collect on these debts. This is achieved by requesting a copy of the Signed, Executed Credit Agreement via a Consumer Credit Act (CCA) request.

Letter N.

Is it important to start the letter:

I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY in Big Bold letters. DON'T sign this letter simply print your name at the bottom. Best to send the fee as a postal order and recorded as there are time limits.

3/ Send a CCA for all the others to check exactly what was signed for on the agreements. PPI, etc.

4/ Once the agreements start rolling in scan and post them here and we'll help with them.

5/ If you've got here, it's time to sack CCCS as I don't think they have your best interests at heart

6/ Any PPI, charges, etc must be reclaimed as this will reduce the overall balance of the accounts. This is quite straightforward and involves a SAR to each lender for all the account transactions and anything else that is needed.

7/ Start to enjoy life again.

I posted CCA letters to DH's creditors on Tuesday.

Sorry Godmother.. I started to update this earlier then realised I had a hospital appointment and had to shoot off. :)

 

 

UPDATE:. All the debt figures below were as at the date of joining CAG. These would have gone up or down over the last few months depending on whether the creditor has continued to add interest or not and where payments have been made. Still waiting for CCA, there has been no response from the company at all since they signed for the CCA request No independant thread for this yet.

 

CAP 1 - Credit Card

A document was received and I assumed that it was correct. A monthly reduced payment based on percentage of debt/ income balance has been made. However, have since been advised paperwork not correct so I will wait and see if they start to get nasty before making any further decision on this one.

BC VISA - Credit Card

Document sent is apparently an application form. I have made a complaint to FOS and TS. Have been given reference number from FOS. TS not acknowledged email yet. Received telephone call from Local T/S 23.04.08. They requested copies of all paperwork I had including dodgy CCA and Default notice :) Posted today, 24th April. I splashed out on a Special Delivery fee so it will get there tomorrow.

 

BC M/CARD - Credit Card

CAGers agreed this was an enforceable agreement. A reduced monthly offer based on percentage of debt/income balance has been made. They are still adding interest and charges and I will make a claim for those soon. This thread has been merged with Visa as above.

 

HALIFAX - Credit Card

No CCA received. 31.03.08 received package dated 3rd March, sent 2nd class Mail. Documents included were an APPLICATION form and current T&Cs. A "You have not complied" Letter sent immediately. 12th April, received a letter advising that "My complaint, was being handled by one of their Advisors They require 4 weeks to respond to my complaint. Have received a Default notice and Formal notice this morning. Have put copies in thread for comments please.

 

TESCO Credit Card

Tesco have been reasonable from the first HELP letter. They have frozen interest, no charges added and are accepting reduced monthly payments. No independent thread.
