      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I had three charges on account yesterday... totally £95.. rang Barclays Customer Service and just asked for them back, no problem ... and true to her word the money is back in my account today. Was told that they are able to immediately refund up to £100 per customer. I did push my luck and asked for my 4 grand, (different account) but was told that as long as there is no activity ie any dd etc., they will not apply any charges to that account until after the result of OFT case.

A few weeks ago during Prime ministers questions, the libdems asked Gordon Brown if he was aware that 27,000 home repossessions were granted during 2007 and that the number was expected to double during 2008.

His answer was Quote We have to keep the economy on track Unquote

 

I take that to mean "Not my problem".

 

Sorry to mildly disagree.

 

Just a wee bit, anyway.

 

Prime Ministers don't get to be Prime Ministers cuz the pubic voted them there. They get to Prime Ministers because a confluence of moneyed and political forces put them there to serve their interests. Note: not the interests of the citizens of this nation.

 

Democracy as we know it today is not in the least bit representative in terms of the implied meaning of that word.

 

Decades ago it was described by the then Master of the Rolls as an "elective dictatorship" that definition holds good up to the point of the word "elective".

 

When the bare minimum choices of voting a representative into power (via a part machine) are as designedly inhibited as they are, then it is not so much an "elective" dictatorship as an "appointed" dictatorship.:eek:

 

Know and understand the actualite and not the smoke and mirrors we're fed since birth, I say.

The party's candidate's selection committee chooses its candidates to stand for election.

 

The idea is the Nominated candidate campaigns on issues that he and his staff feel that is important to the country.

 

On voting day the idea is that you select one of those candidates out of a number of party's standing for election.

 

What ever your personal opinion and believe me I respect that is the way this Labour government has made election policy.

Sounds like a republican to me.

I always thought the idea of democracy was to engage local residents and campaign on the issues they feel are of concern to them.

Good question. It was originaly ''OFT Test Case Moved To Tiny Room'' but since this turned out to be complete nonsense the title has been discretely altered to OFT Test Case.

 

So back on to the new original subject. The OFT gave an indication earlier this week as to when it expects to conclude and publish it's investigation and market study.

 

''With regards to the Personal Current Account investigation, we are continuing to request and analyse information from the banks and we therefore will not be concluding the investigation until after the judgment. The market study is expected to be published pre-judgment however this depends, to a certain degree, on when judgment is handed down.''

I confess that it was a little hard to believe that the OFT supported us when they wouldn't meet with us, but let's hope that they are genuinely trying to do the right thing for us now.

 

I would feel much more convinced had bank customers, or at least consumer groups been consulted, or able to give evidence during the test case or the OFT enquiry.

Would you agree to meet - and show support for - a bunch of placard waving street protesters outside your office? I don't think you would.

 

And you are incorrect. There were 4 consumer groups consulted before the test case announcement.
