Thanks alot, i think there are very few people at this stage so i found it difficult getting help, but alls well that ends well, i'm still floating although you know us girls! it didn't stop me floating down to csl to order a loverly leather and chanile corner sofa and to die for dining table with six leather chairs! HAPPY DAYS. And i can finish off my extension, ( don't know if you read my builder did a runner with £19k after a few days work) so a happy christmas will be had in the Penny househould thanks to cag. Good luck with your claim, I know it seems like your never going to win but i was in the same position and here i am at last i have beaten the monster otherwise known as natwest. I wouldn't mind but this all started because they took over £800 in charges in one month, if they had of helped me then it wouldn't have cost them in excess of £6k, bet there kicking themselves now!

Thanks Karnevil, i did call the court and asked for 1 month adjurnment, is that ok, i thought best to cover myself just incase but i did make her swear on her mums life ( i really did!) that the cheque was being sent. I'm really gratefull for all your help. cheers.

Thanks Sharon, i have just spoken to the court again and they said it is ok to request it verbally but i think i will feel better if i put it in writing aswell so hubbys about to go to the court with the request for adjournment in writing, i agree, i don't want anything to go wrong now.

Now i know your a girl you will deffo appreciate the sofa thing, it is pretty gorgouse!.

Congratulations.

 

I sent off my 'rejection of partial offer' letter today. I'm claiming £4,438.11 in total and they offered me £2,150!

 

Your thread as given me real hope.

Quick update- Cheque for full amount recieved today made payable to the account the charges were taken from (bit crafty, i was thinking of banking it into my halifax account!) this has now been paid in so just have to wait for funds to clear. conditions of my settlement were 1 write to the court withdrawing claim and 2 not to disclose, so no full and final settlement which is good as i have further plans for nastywest! I'll wait until cheque clears before withdrawing claim.

are they allowed to stipulate which account it is paid into, it doesent seem right, and if they are doing that then why dont they pay it straight into the account, that way we wouldnt have to wait for the cheque to clear

I'm not sure about this, but don't/can you put in your Particulars of Claim how/where you want the payment or cheque sent??4_12_1.gif

 

It is something I did not do when filling in the N1 Form. I wish I did now, as I would have simply requested them to make it payable to ME, and it would have gone into another account out of the Natwests reach.

Hi and thanks for the congrats. I'm not sure if you can request that on the n1 forms but i had a different one from most, i think because of the amount i was claiming, but i'm sure once they agree to settle it could be a request that you would only settle if the cheque was made out to you. I don't mind to much as it was very gratifying going into the branch and handing over my cheque (an rbs cheque) and for once they didn't try to upsell me anything, she was just silent and this is a woman who would sell an insurance policy to a dead man! The second the cheque clears it will be whisked away to another account, not a natwest one either. Good luck with the claims, not to long now fingers crossed.

Just Got Back From Leeds At 3.30 This Morning,(should Have Been 9pm Last Night But Plane Was Cancelled Due To Fog And I Had To Be Coached Down To Bristol,what A Night Mare! Daughter And Grandsons Just Moved The Weekend And I Was Helping Them Move In.)

Was Already To Accept Partial Offer From Natwest But Having Read Your Success It Has Gave Me The Courage To Go On.

Still Very Scared And Confused About What I Am Doing But Will Need The Money To Go And Visit My Lovely Boys As Often As I Can.

 

So Enjoy Your New Furniture You Have So Earned It.!!

Hello and congratulations ! Was following your thread towards the end of last week and had to go away on holiday on the Friday as you were getting your court bundle ready - I wanted to take the laptop so I could keep up with your progress, but hubby wouldn't let me ! lol.

 

I was delighted to get home today and read of your success and it has certainly inspired me to go 'all the way' with this ! (Just starting our claim).

Thanks tigerlilly, everything was bobbing along smoothly and on track until the last leg then it all went a bit mad, but i got a great result in the end and suprisingly my cheque has cleared today, so i've transferred it all out of natwest and into my savings before i go after them for another £1.5k!

Good luck with yours, i know everyone says you will win in the end and it seems hard to believe at the time but clearly this process does work and we'll all be laughing in time for christmas.
