Hi all. Hope someone can give me some advice.

About 4 years ago i got myself into some stupid financial difficulties.

I eventually contacted a debt management agency who i pay monthly and they distribute funds to my creditors.

About a year ago a company called Robinson Way began to ring my parents home demanding to speak to me regarding an unpaid account.

They sent letters to my parents home also, instructing me that they were acting on behalf of a catalogue company. The problem was that a separate company called CK Edrupt were being paid by my debt management company on behalf of the same catalogue.

I contacted Robinson Way by post, telling them this, unfortunately they would not accept this and threatened me with further action.

I had not heard anything since, until today. A rep from the company rang my home today. I tried to explain the situation to her and suggested that she contact the debt collection agency who would probably clear this up. The girl became very angry with me and said i was being uncooperative and therefore she would be sending bayliffs to my home. Can she do this? Please help.

NO she can't - NEVER SPEAK TO THESE PEOPLE - They will say anything to frighten you into paying....this si what you MUST DO...

First NEVER talk to these "people" on the phone as they will try and get you to agree to anything.

 

Before you even think about making any sort of acknowledgement or payment to a DCA you MUST ensure that they have the LEGAL right to collect the debt.

This is achieved by requesting a copy of the Signed, Executed Credit Agreement via a Consumer Credit Act (CCA) request.

Is it important to start the letter:

I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY in Big Bold letters.

 

It is best to send this request via recorded/special delivery as there are some important deadlines to observe.

 

After 12 WORKING days the "debt" is in default and stays that way until the request is complied with.

If a FURTHER month passes then the DCA has committed a summary criminal offence and the matter should be referred to Trading Standards for action once the DCA continues to demand payment. Also DO NOT HAND SIGN THE LETTER"

 

You must send a £1.00 postal order with this - not a cheque. Write on the back of the postal order what you want the £1.00 used for and keep a record of the number. Send it Recorded Delivery - yes expensive but completely guarenteed to get there and be signed for. Keep all postal reciepts.

 

AT THE BOTTOM OF THE LETTER ALSO WRITE - I WILL NOT ACCEPT ANY PHONE CALLS FROM YOUR COMPANY - PLEASE NOTE THAT ALL CORRESPONDENCE MUST BE IN WRITING - ANY CALLS MADE TO ME WILL BE REGARDED AS HARRASSMENT AND TREATED AS SUCH....
