    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. Anyway I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've been offline the past week and moving house, so not been able to update this thread.

 

I have had a reply to my nice letter to Midas Legal Services explaining exactly which bits of the CCA 1974 Mint's application falls flat on its ass with (and it covered 2 whole pages - took me ages to write it!).

 

Strange how the reply came back from Moorcroft :cool::cool:

 

And I quote...

 

"Thank you for your request for a signed copy of the relevant agreement under the Consumer Credit Act. At this stage we are currently unable to provide a copy of the agreement as we have been in contact with our client (Nat West Card Service) who have confirmed that to obtain a copy of the agreement under Section 78 of the CCA you must put your request in writing to the following address:-

For future reference here is a good thread for any complaints to the FOS (should you feel the need). Don't forget, the FOS charge the creditor £450 every time you make a complaint. :)

The response to your complaint from the FOS sounds v. familiar also..."fair and reasonable" - that's a word that got banded about by the FOS in my letters, although they did state that the courts would have to decide on the legality of the agreement. But are Mint and Moorcroft willing to take this to court? Maybe not :cool:

 

And thx for the link to that thread, I did start reading it a little while ago, but it seems it may have been added to quite a bit since then, so I'll go and check it out and get some useful tips :)

I think i have had all Moorcrofts letters. I did reply to them once heading the address to their Pre-School Division lol ;)

 

I would say these DCAs don't take people to Court unless they know the debtor has a Large house (and mortgage) and an expensive car in the driveway. And even then they try the cheaper alternative of payment demands in writing route first.

 

I myself, on Carer's Allowance, Renting with no savings and after 2 years of threats almost feel immune from legal action! :p

I thought of heading my letters in a similar manner, but thought if it ever got to court, the judge might look at me a bit funnily :oops::p

However, being on incapacity benefit, everything in hubby's name, and no financial connection, I think I could be immune too :D

Well, don't want to give you a false sense of confidence but yes, remembering at all times that DCAs are really really dim! :)

 

Actually it was headed pre school division on the address of the envelope. Not contained on the letter itself (so a Judge most likely would not see it or take an interest in the address anyway). :D

New letter today;

 

I am disappointed to note that despite our letters and attempted personal calls by our local representitive no satisfactory agreement has been reached regarding the balance outstanding of £****.** on the above account.

In one last effort to come to an arrangement to prevent more serious action being taken we will be prepared to accept repayments by installments of £50.00 per month. A Post Office paying in slip is attached to enable you to make your first payment. On receipt of this payment we will forward further payment slips to you.

Unless a payment is received by 10.00am on 22/1/2009 we may recommend court proceedings to be commenced against you without further notice.

Such action could incur you in further costs and may also affect your future credit rating. It is therefore in your best interests to give this matter your immediate attention.

Well, I'm going to give this letter the same attention they gave to mine - NONE :p

 

They can send all the local representatives they want, as well as I don't live there anymore and I told Mint that over 4 weeks ago.

 

This letter certainly sounds like they are getting desperate (not surprising considering the state of RBS today :D).

An update...

 

It seems Moorcroft have given up, and handed the file back to Mint. However, there is a new DCA now - First Credit Management Ltd (FCM). This morning I received their first letter..

 

IMPORTANT - DO NOT IGNORE THIS LETTER

 

Dear Ms xxxxxxxx

The above amount has been passed to us for immediate collection. Please read this notice carefully - it contains impertant information that you need to be aware of.

 

Payment should be made in full for £xxxx.xx by 26th February 2009. The following methods of payment are available to you:

If you are unable to pay in full you should telephone this office immediately so that an alternative ways to pay this debt can be discussed. Please do not ignore this letter, we will not send any 'reminders' before automatically instigating further action.

The first thing that sprang to my mind was the address on this letter. Mint have been notified of our change of address, and they've even updated my credit report to show the link, yet here we have a letter from yet another DCA that Mint have passed the file to, and they're using my old address. Cynical me is thinking, "why?"

 

Just trying to put together a reply to put them straight about this "debt", but am wondering whether they will back off if I show them what Mint think is a credit agreement, or whether to let them try and squeeze a copy out of Mint (which they obviously don't have).

 

How long to First Credit Management take to get the message, and hand it back? And what is with the final sentence "County Court filter (my postcode)? 8-)

So Wescot Moorcroft Midas and now First Credit......This has been going on for a long time too !!

 

Theres no shortage of info on CAG in relation to First Credit and their tacs.

Has this alleged debt ever been assigned ?

Thanks Martin for the title change :) This saga has been going on since October 2006, yet Mint have yet to sell the alleged debt - AFAIK, they still own it.

Duffer's Mum - I'm not too sure whether they are one and the same, but I'm going to check now (a good advantage of being an OU student - access to Companies House data :D) ...

Wow, has it been that long since they contacted me?? And there I was, thinking they'd forgotten all about me :rolleyes:

 

A letter from them today, still going to the wrong address (Mint definitely know where I live), advising me of a "home visit by a debt recovery officer". Don't think my tenants are going to be too pleased if that happens. So I've drafted a letted, taken from CAG, telling the to bog off as far as going to my address is concerned...

 

I note it is your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

 

There is only an implied license under Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and civil action will be taken.

 

 

Finally, I also note that you continue to use my previous address, despite Mint knowing my new address, and the fact it is at the top of all my letters to you. If you choose to continue sending mail to my old address, I will also invoice you for the cost of Royal Mail's Redirection Service.
