  7. Right. N244 now sent and a refusal letter done to Mr Higley.. Just waiting for Cobbets next move.. If they offer charges + 8% and costs, its game over for me. Don't feel comfortable just chasing contractual at a highr rate. If not, i will just see what the fair winds bring...
  8. As always, thanks for your input Westy. I'd agree with your points that there are occasions when claiming contractual is completely justifiable, but the law behind the arguments can at times be a grey area, and open to interpretation. Because of the complexities with contractual, i don't advise people to go down this road.

  12. Firstly, go and wash your mouth out with soap!!!!! We would never advocate anyone using a third party, most are unlicensed and uninsured chancers.. Do it yourself and i guarantee that you will never have so much satisfaction..... well, almost never:) You should be ok with the CC, its under a sepeate agreement anyway.. The OD is a different ball game.. they MAY, and can if they wish, demand payment.. i would go for it anyway on the basis that the account is in dispute.. I would also open another account if need be to have your money paid into, then come to an arangement with them on paying the OD off... Some useful links..   15. My personal opinion is to accept your offer. Its for the full amount of your charges, what you asked for, and you haven't filed at court yet,(?). You could push on, you may be lucky and get some of it back. However, the banks are now fighting a bit harder on these cases and if it were to come before a judge, who knows what way it will go. And then there is a possibility of costs, even in SMC, to consider should it all go wrong.. I would say to accept what you asked for in the first place..

The process that you will follow is relatively easy but IS NOT a get rich quick scheme. Spend time reading the FAQ pages as this will stop you making mistakes along the way, and is the most important part. Read as many threads as your eyes will allow, you will gain invaluable knowledge which will give you the confidence you need. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere. Then start your own thread under the relevant bank and other users will help and guide you along the way. This site is all about EMPOWERMENT and you will gain the confidence that you will need. The excellent A-Z guide compiled by Michael is a fantastic source of information. But remember, this isn’t a game. You are taking on large institutions which MAY lead to court, so far it hasn’t, but it may do. We will all be there if you end up being the ‘chosen one’ so don’t worry, it’s a long way off. But you do need to be prepared. Everyone is very friendly and keen to help. Dave and Bankfodder have done a great job in producing the site, and all the moderators, helpers and current users really are a very nice bunch.
