SIP PCN - Walmer Street, Manchester
FTMDave replied to eveys1602's topic in Private Land Parking Enforcement
OK, excellent, that makes your case very easy from a legal point of view - you paid, they got their money, that's the end of it. If they were daft enough to take you to court the judge would chuck out their stupid claim immediately. Don't contact them any more now, but come back here when they reject your appeal (which they will), also keep on reading up, and please fill in Dx's sticky. -
Yes, please reply to the sticky honeybee posted. As you'll have worked out now, there was no point contacting UCS or their "solicitors" (probably the spotty office junior as you point out they share the same address). Not only are they fleecers, not only are they totally uninterested in the facts of the case, but even if they were honest brokers (they aren't) they couldn't do anything anyway as it's not their "debt". The dispute is with the private parking company. Who the hell advised your girlfriend to send a SAR to UCS, a totally uninterested third party in the case? Could you please upload a PDF of correspondence with the private parking company (all the rest is just toilet paper) suitably redacted of your girlfriend's details, the PCN number, etc. So UCS are not actually doing anything Of course not, it's not their debt. They can't do anything. More importantly, the PPC aren't doing anything.

Hope you enjoyed your holiday! They (or their DCAs) probably will send you more rubbish, but it'll just be more toilet paper from paper tigers. Ignore and just file it away. Do come back here if you receive a LBA though. -
Setting aside salford a ccj - defence sent to wrong court
FTMDave replied to keek's topic in General Legal Issues
Agree with Andy, if you're organised it will be HER in deep trouble for making false accusations. I'd keep a little "diary" of the few times you have been outside her home with dates & times. If she's daft enough to bring it up in court show the "diary" to the judge and point out you had a valid reason for taking the photographs. Oh, and that you weren't charged, cautioned or even asked to go to the police station, plus you are unaware if she has been charged with wasting police time or not. -

If you haven't sent the letter, best to keep the info. to yourself and then demolish them in court if it gets that far. I notice that, even though the LBA was your final, last, ultimate chance to pay before they took you to court ... they still haven't taken you to court and are still sending silly letters.
-
Why? They're not taking you to court. They're just sending toilet paper. Sitting idle is an excellent idea. In fact replying to them would show you're taking their silly threats seriously and you could admit to something and lose your rights under the POFA. So keep on enjoying ignoring their nonsense. Come back here though if they send an LBA.
-
No! Don't send anything to Trace. It's not their debt and so they can do nothing to you. Nor will they take a blind bit of notice of anything you say. Read Dx's posts 2 & 5 again. All that is happening at the moment is that you're receiving a lot of toilet paper in envelopes. Nothing is happening legally. Unless you get a LBA there is nothing to worry about.

Surprise Arrows/Restons CCJ for HSBC Debt
FTMDave replied to Hola-Amigos's topic in Financial Legal Issues
IIRC the time limit (statue barred) is six years, but even that's not a guarantee. Someone could sue you for a debt from 50 years ago and they would still win by default if you didn't get the court papers and couldn't defend it. Ring the court on Monday and get a PDF of the judgement sent to you. Don't worry, you have an excellent change of applying for judgement to be set aside as you didn't get the court papers. Indeed if it is a genuine debt you might be able to negotiate with the other party and get a set aside by consent. Anyway, get on to the court then come back to us on Monday. -
