  6. Hi, yes the Unfair Contract Terms 1977 does apply, thats the one of the one's I used when winning my claim against BOS back in October. Just sent my summary cause action today and have used it again. Best wishes with your claim. Scott.

Everything you need is on this site it just takes a few days to get your head around it. Go to your bank's forum and ask a question there are plenty of people there willing to help you.   13. Hi, I live in Edinburgh and had to go through the Scottish Small Claims Court. I think if you have an English address, you can claim online, and for more cash than you can in Scotland. Hi, You could claim 2 amounts of £1,500 in Scotland using (summary cause,) its almost identical to the small claims form.It will cost you the same £39 but the Sheriff Court will return your paperwork and you will have to get a lawyer or sheriff's officer to serve your claims.Also you must only do one claim at a time.   23. For my court papers I used my Branch address. Then it was the Bank of Scotland.Sorry for getting the banks mixed up! these things sometimes happen!
  24. Hi, and welcome. You only add the interest when you sudmit your claim in court. I forgot to do this with my claim, but after they settled I phoned them and asked for the interest, it was in my account within a couple of days. Best wishes with your claim. Scott.
  25. Hi, Chris. The defendant on your court claim is the Bank of Scotland not your Bank Manager.Its the bank your claiming against. I made the same mistake but the clerk at the Sheriff Court changed this for me. Best wishes with your claim. Scott.
