  1. Hi, I'd send it again then file your claim. Don't think you have to send them a breakdown of the charges just the total claimed, then when you file your claim add the charges and interest due. Best wishes. Scott.

Hi Alison, Claims in Scotland can be between £750(small claims) and £1,500(summary cause) both forms are almost identical but I think If you loose using summary cause it could cost you up to £750 in fee's where as it will only cost you £39 if you were to loose using small claims. Nobody has lost yet so I'd use summary cause if I were you. Only put 1 claim in at a time, I think this is quite important. Have a look above your post for contact details for RBOS. Hope this helps.   6. I'm just about to claim against Cap 1. Sent all the letters ect.ect. It's now court time. My problem is I live in Edinburgh and do not know which court I should use. All my correspondance has been with their legal department in Nottingham. Any help would be appreciated. Thanks. Scott.

  8. Hi, I don't think you can claim the lot together, well maybe you could but I think it's better to stick to the small claim route. I claimed for £720 at first, then all I would have to lose was the £39 court fee. My next claim will be for £1,500 which still comes under small claims but would cost me more if I was to lose the case.I think you can claim for the lot at once but you have to claim them through the english courts as they have their head office in England, but you have to have an English address to do this.   10. Hi, I have just sued the Bank of Scotland for £720 + interest + £39 court fee. Your right about the 5 years, I think that's as far back as you can go. I live in Edinburgh and as the Bank of Scotland have a branch in Edinburgh it comes under the Edinburgh Sheriff Courts jurisdiction. My claim cost me £39 that's all I would have lost if the case had gone to court . which was very unlikley. They are still due me about £5,600 which I am about to claim using Summary Cause. In Scotand you can claim between £750(small claims) and £1,500 (summary cause) Go to "Forums - Bank Templates Library -Scottish procedure.   13. Hi Davedee, I sent them a letter asking for my charges back, they said there was no way I was getting any charges back. I then sent them my Letter Before Action giving them 14 days to return my charges, they then offered me £365.I was claming about £6,000. I then popped down to my Local Sheriff Court(Edinburgh) and filed my claim (£39) See below for my claim.Then sat back and waited for them to get in touch. The day before my return date in court they sent me a letter offering a full refund of charges. Their lawyer actually phoned me to make sure I got the offer, sounded like she did not want the case to go to court. I then phoned the court to tell them the claim had been settled. Look above your post to see the( partics of claim-business accounts.) You will get your money back, just takes a bit of time scouting round this site. Best wishes. Scott.

Hi, I am self-employed and have just had my claim for £720+interest+costs settled in full by the Bank of Scotland, they are still due me about £5,600 so i'm about to start a summary cause claim so I can get £1,500 back at a time. I live in Edinburgh and sued through Edinburgh Sheriff Court. Their charges have almost put me out of business a few times! Best wishes. Scott

  19. Hi Firey, I have a Business Account in Edinburgh with the Bank of Scotland. I have just sued them for £720 plus interest plus court fee £39. My claim was settled in full last week. I did everthing myself through this site. I believe you can claim for up to £1,500.00 in Scotland using Summary Cause. That's the route I'll be going next. When I mentioned this to my Lawyer some time ago he said he did'nt believe I could sue my Bank. Sometimes lawyers have'nt a clue what they are talking about. My advice would be to do it yourself.   24. When I told people I was going to sue my Bank everyone said I was Bonkers! Well I did and just received my first claim of £750 plus interest plus my £39 court fee. You must get your own money back, it was unlawfully taken from you. Best wishes. Scott.
  25. Ive just had my claim against the Bank of Scotland(Business Account) paid in full including court fee. The same rules apply just change the wording slightly, you will find them in the forums.
