  6. Hi, and welcome to the site. You can claim between £750(Small Claims) and £1,500(Summary Cause) Both will cost you £39 at the Sheriff Court. If you go down the small claims route once you hand in your paper work the court do the rest for you. If you use Summary Cause the court will return the paperwork to you and you will have to get a Lawyer or Sheriff's officer to serve your claim. I believe they can charge between £15 and about £50. If you were to loose your claim it would only cost you £39 court fee using Small Claims, but I believe if you were to loose using summary cause it could cost you up into the high hundreds. Both claim forms are almost identical. I,ve been using the Small Claims route just to save the hasstle of paying a lawyer. When I say if you loose, you would have to be very very unlucky as I don't think anyone has lost yet. The bank of scotland have just informed me they are giving me 30 days notice to close my account.(nice people!) Best wishes with your claim. Hope Iv'e helped a little. Scott.
  7. Just received a letter from the Bank of Scotland where I have had this account for over 25 years! ............................................................................... I refer to the above account and write to advise that due to unsatisfactory conduct, the bank would now look for this account to be closed. I would advise that the bank will cancel any chequebooks, standing orders, direct debits and Keycard access on the account. Please note we are now providing you with 30 days notice to arrange alternative banking arrangements. In the event that we do not hear from you within this timescale the account will automatically be closed and any credit balance repaid to you by cheque...................................................... Wonder if this has anything to do with me taking them to court last month! Anybody with any suggestions ?

Hi, I forgot to add my interest in my court claim, I wrote to the solicitor that was dealing with my claim after they had settled and they put the interest plus my court costs into my account the next day.I'm not to sure how you stand legally if you did not add the interest when you file your claim. Hope you get it back. Scott.
  11. Hi, You can only go back 5 years in Scotland. I think if you go back 6 the bank will go to court and tell the judge your claim is Time Barred! Have a look at my claim below regarding interest ect. Best wishes. Scott.

I've got to say there is no better feeling than getting money back which has been unlawfully taken from you.There are lots of horror stories about people being put in dire straights by their banks unlawful charges.   14. Hi, and welcome to the site. In Scotland you can claim up to £750(Small Claims) or up to £1,500(Summary Cause) the forms are the same but with different titles. Both cost £39 in court fee's. I think most people are using these because all you can loose in the small claim is your £39 court fee. I have been told by a clerk of court if you loose using summary cause it could cost you hundreds rather than thousands. My first claim that was settled if full by the BOS including interest and court fee was for the sum of £720. I have just filed my second claim against them using Summary Cause(£1,500), once the court return my paperwork to me I have to get a lawyer or sheriffs officer to serve the claim on the bank.Could cost me between £15 and £50.I have'nt heard of anyone going over the £1,500 in Scotland. The clerk of court told me I would have to be very very unlucky if the bank went to court as none have done so yet! Hope this helps. Best wishes. Scott.

  17. Hi, I had a defaulted account with Cap 1, when I sent them my S.A.R. they then wrote to me saying they had 'bought' my accout back from the debt collectors, I claimed anyway and received a part offer, refused and on my way to Edinburgh Sheriff Court. Best wishes. Scott.

  19. Hi, Pauline, I've just sent my second claim against the bank of Scotland, My first claim was a 'Small Claim' max £750. I claimed for £720 and they paid my £720 plus Interest plus My court fee. My second claim is a 'Summary Cause' claim max £1,500. I beleive that when the Sheriff Court return my papers I have to employ a Lawyer or Sheriff's Officer to serve the claim. I've heard they can charge anything between £15 and £50 but I take it I can claim that back from the bank. There is someone on this site who has won 2 Summary Cause claims, I think here name on the site is Mairi. Have a look for her post and this should keep you straight.I think you have to have an English postal address to claim online. Best wishes. Scott.

  21. Hi willob, Statements held prior to May 2004 are stored on microfiche, I think you can obtain them from Barclays Customer Service Dept at a cost of £3 per statement.If your charges are more than that then it would be worth paying the £3 ? Best wishes with your claim. Scott.

Dan, You can claim up to £1,500.00 in Scotland using Summary Cause i have already had a claim for £720 settled in full by the bank of Scotland including over £200 in interest and my £39 court fee. My first claim was a small claim where if I was to loose the case I would only loose my£39 court fee, I beleive if I was to loose my Summary Cause claim(£1,500) I could loose a few hundered pounds.The clerk of court at the Sheriff Court in Edinburgh said I would have to be very unlucky to loose as not one case had went to court yet, they have all been settled before the court date. The banks do not want to go to court and loose! if the Banks thought they could win a case in court they would have done so a very long time ago! The link you are looking for......go to forums...scroll down to Guidance Notes then Scottish Procedure. You have given the Bank ample time to return the money they have unlawfully taken from you.
