:-? Hi everyone ! Hope everyone is having success with there claims. Todate i have had one offer of less than half of the ammount the YB owe me wich i turned down and more recently i have registered my claim on line to which the YB have submitted a defence on the 1st december, to my supprise this morning i have recieved another offer in the post, this offer is for 3/4 of the ammount i am owed. As usual the stipulation is that i discontinue my claim and that it is a full and final offer. my worry now is that if i continue i may recieve nothing and also i am not sure how to reprisent myself in court. CAN ANYONE HELP ON THIS MATTER. THANKS IANTOOT -
Hello Again Can anyone tell me what happens when the claim goes to court? Do i need representation, or is it up to the judge solely to make a decission? Ian Toot

Nat West, denying reciept of request for statements
iantoot replied to Saoirse's topic in NatWest Bank
I do not know if this was a correct thing to do, when i sent my S A R i included that i wanted a letter of reciept and when i did not recieve one i went to my branch a got one from them personaly it has seemed to speed things up. As i see it the Banks want to remove the personal touch so i am going to force it back on them ! -
HELLO EVERYONE I AM TRYING TO FILL THE ONLINE CLAIM FORM IN AND I AM NOT SURE WHAT I HAVE PUT IN THE PARTICULARS OF CLAIM SECTION IS CORRECT. CAN ANYONE CHECK OR ADVISE ME WHAT TO PUT IN IT PLEASE? THIS IS WHAT I HAVE ENTERD SO FAR. I had an account with the Yorkshire Bank, which opened on 12-02-02 and closed on 29-09-05. During the period In which the Account was operating the YB debited many charges to my account in respect of my breaches of contract and also charged interest on these charges. I understand that the YB contends that the charges were debited in accordance with the terms of the contract between YB and myself. I contend that the charges debited to my account are punitive in nature and are not a genuine estimate of costs incurred by the YB and exceed any alleged actual loss to the YB in respect of any breaches of contract on the part of myself and are not intended to represent or relate to any alleged actual loss, but instead to create profit from these charges. The contractual provision that permits the YB to levy such charges are unenforceable by virtue of the Unfair Contract Terms in Consumer Contracts Regulations 1999 and the Unfair Contract Terms Act 1977 and the common law.
