  2. Hi suuba, I have a business account with BOS and I used the Unfair Contract Terms Act 1977 in my claim, in the forums there is a business letter which differs from the norm. Best wishes with your claim. Scott.
  3. Yes I did, it was only £250, Have'nt paid it back yet ! they keep hitting me with Bank Charges...£20 if they phone me....£30 if they send me a letter....I'll pay them shortly, then claim the charges back. Best wishes. Scott.
  4. Hi, No you cannot use the bank manager as your defender, it's not him your claiming against it's the bank he works for. Thats what the Sheriffs Clerk told me when I took my claim into court.I have a claim against Capital One who's address is in England, I live in Scotland and the clerk at Edinburgh Sheriff Court put on the form...This claim comes under the jurisdiction of Edinburgh Sheriff because the persuer will be paid in Edinburgh ? I think you would be ok to use your local Barclays as the defender but I'm no expert. Hope this helps some. Best wishes with your claim. Scott.

  6. Hi Brian, My form was worded for claiming as a Business. I'm self employed so I had to use different Unfair Contract Terms Act's ect. But if you go to Guidance notes then Scottish Procedure the forms are there, you just have to fill in your own details, takes a bit of time, but once you get your head round it you'll be sound. Remember to attach your spreadsheet with the charges and interest but make sure the total does not exceed £1,500.Give me a shout if your toiling, took me donkey's to work it all out but i'm not to bad at it now. I was baffled by the spread sheets, but they work out the interest for you including the number of days since the charge was applied. I'm not sure the best court for you to use, I think it would be Gala if the bank has a branch there. Best wishes. Scott.

  10. Hi, I'd go down the Summary Cause route. You will get your money a lot faster than spliting two small claims. I was told if you loose using Summary Cause the most you would loose was hundreds rather than thousands ! My first claim against BOS was for £720 plus interest plus £39 court fee. They phoned me on my court return date to make sure I had received their offer of the full amount claimed. I had and accepted it. This morning I went down to Edinburgh Sheriff Court and filed my first Summary Cause claim. The sheriffs clerk said I would have to be the most unluckiest person on the planet if I lost my claim as he had yet to hear of a case that had went to court. They have all been settled before the court date set. The only thing with Summary Cause is that the court will send your papers back to you and you will have to get a Sheriff's Officer to serve your claim on the bank. Was told this would cost about £15. Also you cannot go over the £1,500.00 Limit. Oh Miss Universe, You will get more help if you start your own post, this one will get lost. Hope this helps Best wishes. Scott.

  12. Hi, don't give up ! that's what the banks want. I've mucked up my court forms a number of times and yes i've felt exactly the same as you. Just this morning I had to phone the sheriff court because I had put the wrong date when I used the Unfair Contracts Act, I put 1997 instead of 1977 ! Phoned the court today and I have to go in tomorrow to change the date. Just have to scribble out the 1997 and put in 1977, easy peesy. Best wishes with your claim. Scott.

  14. Hi Brian, go Summary Cause and get the lot back at once. Go to Forums......Scroll down to Guidance Notes then click Scottish Procedure..go onto the Scottish Courts site and down the left hand side click Summary Cause.....Bingo!!Its form 1a you need, fill it in online then toddle on down to your local Sheriff Court and hand them in. Summary Cause still costs you £39.00. but when the court return your papers with your return date and calling date you will have to take them to a Sheriff Officer's and pay them to serve them for you. I think it will cost you somewhere between £15 and £45. Depending on where your claim is going.I've just handed my first Summary Cause into Edinburgh Sheriff Court. Hope this helps.   15. Hi, i'm also in Edinburgh and in the process of getting my charges back from BOS. You can claim up to £1,500.(Summary Cause). The forms are almost identical the difference being when the court return your claim papers to you ,you have to get a sheriffs officer to serve the claim, this does not cost that much, somewhere between £12 and £45.I won my first claim against Bos, I went small claims(£750) But my second claim is Summary Cause(£1,500).I am claiming back about £6,000 but will have to split it into a number of seperate claims, takes longer but I will still get my cash back.   17. Hi, Yes you can write a cheque for the £39.00. I take it your in Scotland and going to your local sheriff court ? After you sudmit your papers, the court will then write to you with a return date and a calling date (the day you go to court). BOS phoned me on my return date and offered me the full amount I was claiming plus my £39 court fee and interest. Best wishes with your claim. Scott.

  20. Hi, When I filled in my spreadsheet, down the left hand collum I put Charges As Notified. I won my case so I'm sure that's the way to go. I'm also with BOS, and yes add your interest on the spreadsheet. Best wishes with your claim. Scott.

  22. Hi, and welcome. if you want your bank charges back this is the place to start. I,. like most people thought there's no way I'll be able to sue my bank. When I told my wife and family they all said the same thing....No way. Well I sat on this site for about a week then asked some questions and started the procedure. Couple of months later I had the banks Lawyers on the phone asking if all was well and had I received their offer to settle my claim.full amount plus my £39 court fee and Interest. Superb, great feeling getting your cash back ! I was'nt so happy when they closed my account but hey, I'm sure some other bank would like my business. Best wishes with your claim.   23. Hi, I'm also in Scotland. Don't think you can claim online without an English postal address.You can do everything yourself. Everthing you need is on this site, just takes a wee while to get your head around it. Go to forums, scroll down and in General click on Scotland, have a read or post your own question, there are plenty of people willing to help you. Go into your own bank's forum and someone will help you out. I've just succesfully sued the BOS, I just followed all the instructions on this site filled in my court forms online then popped down to Edinburgh Sheriff Court and filed my claim. It does take some time getting everthing right but It's worth it. It's your money, so go get it back ! Best wishes. Scott.

  25. Hi, with my first claim against BOS they phoned me on my return date to ask if I had received their offer of full payment in the post. I said I had that very morning. I forgot to add my court fee and interest so phoned them and they put both into my account within days. Best wishes. Scott.
