  1. Hello and welcome, Soloman15. I have already won 1 claim against BOS and that was a Business Account. The terms I used were 'the Unfair Terms in Consumer Regulations(1999) and the Unfair Contract Term Act(1977)' I have just started a Summary Cause action against them using the same terms. Due in court in March, I'll let you know how I get on.   4. Hello, In Scotland you can claim between £750(Small Claims) or £1,500(Summary Cause) Both will cost you £39 Court Fee. If you go Small Claims the court will do everthing for you and all you could loose would be £39.00. If you go Summary Cause the court will send back your papers and you will have to employ a Sheriffs Officer to serve your claim.This cost me £15.97. The court will send you a list of local Sheriff Officers you can use. If you were to loose your Summary Cause claim(very doubtful) you would have to pay somewhere in the high hundreds court costs.You would have to do your claims one at a time, takes a wee while to get all your cash back but Hey! you have nothing back at the moment. Take some time to read the F.A.Q.s and Step-By-Step Guides then have a look in your banks forum, read a few threads then start one yourself. There are plenty people willing to help you out.   8. Hi Helen, I think what I would do is deduct the £1,000 from your claim then file it. I'm not realy sure what the score is with your claim.   13. Hello and welcome, Yes you can claim back your charges from a Business Account. I have already claimed some charges back from BOS and i'm in the process of claiming back more with my first Summary Cause claim.You can go back 6 years in England and 5 years if your in Scotland. I think in England you can claim online for up to £5,000. but in Scotland you can only claim £750(small claims) or £1,500 (Summary Cause). You have to make your claim in Scotland at your local Sheriff Court. Have a read at all the F.A.Q.s and Step-By-Step Guides, the more info you take in now makes the whole process so much easier. Claiming as a business is slightly different from claiming from a personal account, there is a letter in the Bank Templates Library for Business Accounts.   14. Hi Donald, It cost me £15.97. for the sheriff's Officer, but as you say the bank will have to swallow that. I think the reason some people don't want to go down the Summary Cause route is when claiming Small Claims the only thing you will loose is your £39.00 court fee.(if you were to loose) but if you were to loose using Summary Cause it could cost you somewhere in the high hundreds.I was told by the Sheriff's Clerk I'd have to be the most unluckiest person on the planet to loose!   15. Hi abra15, Summary Cause will cost you £39.00. The court will then send your papers back to you and you have to get a Sheriff's Officer to serve them on the defender. This cost me £15.97.   20. Hello and welcome, Oscar99. I'm in Scotland so had to go Small Claims, I believe if you have an English Address you could use for correspondence you can claim online with the max claim £5,000. In Scotland you can also claim using Summary Cause, this lets you claim up to £1,500. I've just filed my first one.Hopefully someone more clued up on things will help you out.You should go for every penny they are due you, it's better in your pocket. Best wishes with your claim. I am totally useless with letters ect, it took me a while reading round this site and asking people for advice but I got there in the end.Just remember it's YOUR money. The banks will do all they can to put you off.
